Krupski, Jr., Trustee John Bednoski, Jr. Trustee John B. Tuthill, Trustee Jill M. Thorp, Clerk WORKSESSION: 6:00 P.M. 7:15 P.M. Called meeting to order Pledge of Allegiance NEXT TRUSTEE BOARD MEETING: Thursday, November 15, 1990 7:00pm NEXT FIELD INSPECTION: Friday, November 9, 1990 8:00pm I. MONTHLY REPORT: Trustees' monthly report for September, 1990: A check for $1,529.57 was forwarded to the Supervisor's Office for the General Fund. II. PUBLIC NOTICES: Public notices are posted on the Town Clerk's Bulletin Board for review. III. AMENDMENTS/WAIVER/CHANGES: 1. John Geideman on behalf of CRESCENT BEACH CONDO ASSOCIATION to amend permit 93780 to add a 15' section to existing fixed dock and a 25' section to form an "L" in westerly direction. Location: Foot of Maple Lane off North Road on Gardiners Bay, East Marion. A motion was made by JOHN BREDEMEYER and seconded by ALBERT KRUPSKI to approve the amendment for permit 93780. ALL AYES. 2. RICHARD SNOW request an amendment to permit 99-1-89-55-7-3 to add 12' X 4' and 8' X 4' floating dock in a "T" Board of Trustees 2 October 25, 1990 configuration. Location: 1585 Long Creek Drive, Southold. SCTM #1000-55-7-3. A motion was made by JOHN TUTHILL and seconded by HENRY SMITH to approve this amendment. ALL AYES. 3. Donald McGayhey on behalf of JANET MALONEY request a waiver for existing 14'8" X 31'6" deck, located approximately 33'7" landward of their bulkhead. Location: 30 West Lake Drive, & 2505 Little Peconic Bay Lane, Southold. A motion was made by ALBERT KRUPSKI and seconded by HENRY SMITH to approve this waiver. ALL AYES. IV. PUBLIC HEARINGS: A motion was made by ALBERT KRUPSKI and seconded by HENRY SMITH to enter the public hearings. THIS IS A PUBLIC HEARING IN THE MATTER OF THE FOLLOWING APPLICATIONS FOR PERMITS UNDER THE WETLANDS ORDINANCE OF THE TOWN OF SOUTHOLD. I HAVE AN AFFIDAVIT OF PUBLICATION FROM THE SUFFOLK TIMES AND AN AFFIDAVIT OF PUBLICATION FROM THE LONG ISLAND THAVELER-MATTITUCK WATCHMAN. PERTINENT CORRESPONDENCE MAY BE READ PRIOR TO ASKING FOR COMMENTS FROM THE PUBLIC. PLEASE KEEP YOUR COMMENTS ORGANIZED AND BRIEF: FIVE (5) MINUTES OR LESS, IF POSSIBLE JOHN BREDEMEYER: 7:28 P.M. - In the matter of the application of JOHN J. HAGERTY, III requests a permit to construct a 4' X 50' catwalk; a 3' X 16' ramp and a 5' X 20' floating dock with two (2) sets of 10" diameter piles. Location: 1100 Beachwood Lane, Southold. Fronting Goose Creek. Is there anyone here who wishes to speak on behalf of this application? Anyone here who wishes to speak against this application? MR. HOLZAPFEL: The only comment we had was the one about mowing the spartina. In terms of the project we have no problem. MR. SMITH: I think that they just bought the house. They might not even be aware. MR. KRUPSKI: That is a good opportunity to make them aware. MR. BREDEMEYER: We had told them of this. "Trustees request devegetation and mowing to cease before a permit can be issued." We can make that a condition of the permit. O.K. Any additional Trustee comments before we have a motion to close this hearing? A motion was made by HENRY SMITH and seconded by ALBERT KRUPSKI to close the hearing. ALL AYES. A motion was made by HENRY SMITH and seconded by ALBERT KRUPSKI to approve this application subject to all mowing and devegetation to cease before a permit will be granted. ALL AYES. Board of Trustees 3 October 25, 1990 MR. BREDEMEYER: 7:30 p.m. - In the matter of James Volney Righter Architects, Inc. in behalf of GEORGE E. DE MINEL request a permit to renovate existing garage/apartment and construct an 800 s.f. wood frame addition on sono tube piers as per revised survey dated August 1, 1990. No excavation will be done except for piers. Location: Fishers Island, NY. Fronting Brickyard Pond. Anyone here who wishes to speak on behalf of this application? Anyone who wishes to speak against this application? This application here at the request of the Board and CAC for relocation for the sanitary system have been met. They have relocated the sanitary system in front of there property. The sanitary system was initially shown to the wetlands side. A motion was made by HENRY SMITH and seconded by ALBERT KRUPSKI to close the public hearing. ALL AYES. A motion was made by ALBERT KRUPSKI and seconded by HENRY SMITH to approve the application. ALL AYES. MR. BREDEMEYER: 7:31 p.m. - In the matter of J.M.O. Consulting on behalf of BAGLEY REID request a permit to allow applicant to, on a bi-annual basis, selectively hand cut, hand prune or hand trim vegetation within 75' of the freshwater wetlands as delineated by the staff of the N.Y.S.D.E.C. as depicted on the survey. Vegetation should not be trimmed lower than 18". Location: Central Avenue, Fishers Island. Fronting Barlow Pond. Is there anyone who wishes to speak on behalf of this application? Is there anyone wishing to speak against this application? Trustees? CAC? A motion was made by HENRY SMITH and seconded by ALBERT KRUPSKI to close the public hearing. ALL AYES. A motion was made by HENRY SMITH and seconded by ALBERT KRUPSKI to approve this application. ALL AYES. A motion was made by ALBERT KRUPSKI and seconded by JOHI~ BEDNOSKI to go back on the regular agenda. ALL AYES. MR. BREDEMEYER: V. ASSESSMENTS/ENVIRONMENTAL DECLARATIONS: 1. DIAMOND SCARDUZIO to construct a single family dwelling. Location: Budd's Pond Road, Arshamomaque. This application was tabled until a determination was received by the Health Department, which was received on October 11, 1990. A motion was made by HENRY SMITH and seconded by JOHI~ BEDNOSKI to grant a negative declaration. ALL AYES. 2. Land Use Company in behalf of TORSTEN JOHNSON requests permit to construct a single family dwelling a minimum of 75' landward of the tidal wetland boundary and install a sanitary system greater than 100' from the tidal wetland boundary. Location: Cedar Point Drive East, Southold. Fronting pleasant Inlet/Cedar Beach Harbor and Inlet. Board of Trustees 4 October 25, 1990 A motion was made by ALBERT KRUPSKI and seconded by HENRY SMITH to table the assessment until a field inspection can be made. VI. RESOLUTIONS: (off agenda item) THOMAS GALLIGAN - Board to set public hearing for November 15, 1990 for a public hearing for a catwalk, ramp and float. A motion was made by ALBERT KRUPSKI and seconded by HENRY SMITH to set the public hearing. 1. Costello Marine on behalf of JOSEPH SUCHER to extend permit #365 for maintenance dredging from January 21, 1990 to January 21, 1991. If granted this will be the last extension. Location: Dawn Drive, Greenport. Property fronting dawn Lagoon. A motion was made by HENRY SMITH and seconded by ALBERT KRUPSKI to extend permit. This will be the last extension on this permit. ALL AYES. 2. BRICK COVE MARINA- Board to obtain Bruce Anderson to do environmental work for this project. A motion was made by JOHN BREDEMEYER and seconded HENRY SMITH that the Town Trustees contract Bruce Anderson at his ordinary and usual $35.00 per hour rate to do a SEQRA analysis for Brick Cove Marina subject to the applicant paying an estimate of charges for the service with a final adjustment upon completion of SEQRA. 3. (Off Agenda Item) West Lake Association. A motion was made by ALBERT KRUPSKI and seconded by HENRY SMITH to accept the withdrawal of the permit of the West Lake Association to dredge before this Board. ALL AYES. 4. A motion was made by HENRY SMITH and seconded by JOHN BEDNOSKI to set public hearings for November 15, 1990. VII. GRANDFATHER PERMITS: 1. EDWARD BRENNAN request Grandfather application for bulkhead and the other structures on this property that were built in the early 1970's. Location: 1865 Little Peconic Bay Lane, Southold. After a discussion a motion was made by JOHN BREDEMEYER and seconded by JOHN TUTHILL to grant a grandfather permit of the bulkhead/retaining wall subject to a restoration and replanting on the north end and revegetation across the face and that the Trustees deny without prejudice the grandfather application to dredge or permit the catwalk, ramp and float. ALL AYES. VIII. MOORINGS: A motion was made by HENRY SMITH and seconded by ALBERT KRUPSKI to approve the moorings for November. ALL AYES. Board of Trustees 5 October 25, 1990 1. JOHN SAHM requests mooring in Jockey Creek for a 23' sail boat with a 200lb mushroom. A motion was made by HENRY SMITH and seconded by JOHN BREDEMEYER to approve the mooring location subject to the use of for and aft anchors. ALL AYES. 2. Ann Baydala requests to transfer mooring #629 (offshore stake) to Harold Schwerdt for a 12' power boat in Goose Creek. Location: In front of Mr. & Mrs. H. Schwerdt's property, Goose Bay Estates, Southold. A motion was made by HENRY SMITH and seconded by JOHN BEDNOSKI to approve request. ALL AYES 3. STEPHEN & RITA GLEDICH request mooring in East Creek for a 31' Silverton inboard with a 2501b mushroom. Mooring to be in front of their house on Oak Street. A motion was made by ALBERT KRUPSKI and seconded by HENRY SMITH to approve location of mooring subject to the use of for and aft anchors and that the boat be kept 10' west of the channel. ALL AYES. Off agenda Items: 1. A motion was made by ALBERT KRUPSKI and seconded by JOHN BREDEMEYER to reco~u,end to the planning Board on the Laurel Lake application of JOHN MCFEELY revegetation of all eroded areas within reason and removal of dilapidated dock structure and the dilapidated buildings, the removal of all activities on the site plan landward of 75' from the wetland area outside of Trustee jurisdiction. ALL AYES. 2. A motion was made by JOH~ BRRDEMEYER and seconded by ALBERT KRUPSKI to accept Bruce Anderson's recommendation on the application of ANNETTE ZABAHONSKI that all building envelopes have activities greater the 100' feet from the wetlands. This way it will be beyond the jurisdiction of the DEC and the Trustees. ALL AYES. 3. A motion was made by JOHN BREDEMEYER and seconded by ALBERT KRUPSKI to approve the report of Bruce Anderson as submitted for the subdivsion of SUNDANCE SHORES. A request is made to Bruce Anderson to determine on the survey where the Osprey Nest is located. Also a note to the Planning Board that Lot #1 will have to have a waiver or a permit, from the Trustees, to build. ALL AYES.
