Terry, Building Inspector Town of Southold Main Road Southold, New York 11971 Re: Land Subdivision in Vicinity of Airports Dear Mr. Terry: Enclosed is a memo prepared by a member of the staff on the question of land subdivision in the vicinity of airports. This memo summarizes the material contained in publications in the Planning Department's library. If you wish to come in and consult these publications for detailed information on the various aspects of the subject you may do so. As you can see there does not appear to be any definitive answer on how to regulate a residential subdivision in close proximity to an airport. Zoning the adjacent lands to a low intensity, non-residential use appears to be the most effective method to use in order to avoid the problems created by residential subdivisions adjacent to an airport. It is doubtful if this approach can be initiated now that an application to subdivide has been filed. Basically, the approach will have to be one of persuading the applicant to voluntarily cluster his house lots as far from the edge of the runway as possible by indicating the psychological, physiological, social and safety problems involved. There may be grounds for denying the subdivision on the grounds of the safety, health, and welfare of the future residents of the subdivision and the community. Terry, Building Inspector Main Road Southold, New York 11971 FROM: Frank Dowling, Subdivision Review Section Suffolk County Planning Department RE: Land Subdivision in Vicinity of Airports With reference to residential development adjacent to airports, we have researched various sources and have noted the following points for your consideration. 1. Modern Planning Theory recommends that the area surrounding airports should be free of residential development because of safety, noise, and other environmental factors. The type of land use recommended is agriculture, truck farming;. landscape nurseries, golf courses, low density industrial uses, or open space. It is important to prohibit this area from becoming built-up with homes by appropriate non-residential zoning. 2. The rights acquired in conducting an airport cannot be abolished there- after by a zoning ordinance. Therefore it is desirable that local ordinances require persons contemplating purchase, rent, or lease in high noise areas be fully informed of such noise. 3. restrict airports An increasing number of communities are adopting zoning ordinances to the use qf land adjacent to, or in the immediate vicinity of, the to activities and purposes compatible with normal airport operations. 4. Tall structures or objects of natural growth should not be located near airport boundaries or approach areas. 5. Noise annoyance in the vicinity of airports is psychosociological in that it interferes with such activities as speech, listening to radio or tele- vision, and reading. It disturbs sleep, and creates a subjective feeling of annoyance. An excessive amount of noise may lead to complaints and organized protest. 6. There is evidence of severe hearing loss especially among children, and increases in high blood pressure and heart disease among persons with a low noise threshold. 7. Extensive buffer zones with thick screening between the airport facil- ities and surrounding communities are recommended for noise absorption and privacy. 8. With reference to the application of zoning ordinances to properties adjacent to airports, the Courts have said: "An anthority may not under the guise of an ordinance acquire rights in private property which it may only acquire by purchase or by the exercise of its Power of Eminent Domain." . . } -2- Bibliography The following books and catalogues with reference pages noted are~ailable in our department for your inspection.
