The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Department of Real Properties Office as a notice covenant and deed restriction to the deed of the subject parcel. Southampton, NY 11968 RE: BARBARA KAPLAN 1700 INLET WAY, SOUTHOLD SCTM#92-1-7 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on Wed., August 22, 2007 regarding the above matter: WHEREAS, En-Consultants, Inc. on behalf of BARBARA KAPLAN applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated March 25, 2007, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6 of the Local Waterfront Revitalization Program to the greatest extent practical through the imposition of the following Best Management Practice requirements: the installation of a 10' non-turf buffer landward of the bulkhead, and the decrease in the size of the deck seaward of the bulkhead from 11'X 14' to 4'X 8', and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 22, 2007, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of BARBARA KAPLAN to replace (within 18") approx. 126 linear ft. of existing timber bulkhead with recycled plastic bulkhead; backfill with approx. 15 cy. clean sand fill to be trucked in from an upland source; remove the existing deck located over and seaward of the bulkhead and replace with a 4'X 8' deck and stairs, and construct a 4' wide walkway landward of the new bulkhead, with the condition of a f 0' non-turf buffer landward of the bulkhead, and as depicted on the plans prepared by En-Consultants, Inc. last dated August 6, 2007. Box 1179 Southold, NY 11971 Re: Barbara Kaplan August 7, 2007 Dear Mr. King: As requested during the public hearing on the captioned application, please find attached (3) copies of a revised project plan, last dated 6 August 2007, depicting a nonturf buffer that will extend 10 feet landward of the new bulkhead and include an area up to 6 feet wide landward of the retaining wall, which is to be legalized through issuance of the subject permit. Please note that in response to a request by the New York State Department of Environmental ~. Conservation, the existing deck located over and seaward of the bulkhead will be removed in 'favor of a 4' x 8' deck seaward of the new bulkhead, which will attach to the stairs to be reconstructed. Please also note that a 4-foot wide wood walkway is being proposed landward of the new bulkhead, between the bulkhead atad re~ining wall. Although it is my hope that these minor changes can be incorporated administratively into the pending wetlands permit, please let me know if a formal application to amend the Board's approval needs to be submitted. SCTM# 1000-92-1-7 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP: Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The proposed action does not comply with § 275-11. Construction and operation standards. Section (BI) item (a). "(1) Bulkheads, retaining walls, revetments and gabions. (a) Only in-place replacement of existing functional bulkheads (as defined in § 275- 2) is permitted. In-kind replacement relates to the position and dimensions and does not necessarily require or allow for the use of the same materials. At its discretion, the Board may allow for a one-time projection of the replacement structure seaward of the original, only if such placement will not project the proposed strneture seaward of adjacent, neighboring structures and if the proposed installation is in close proximity to the original structure. Any subsequent repair or replacement following the first replacement requires the structure to be built on or landward of the original structure." The proposed action will proiect further seaward of the existing wood bulkhead to the west of the property. There is no bulkhead to the east of the property. Please require that the applicant amend the application to meet the above policy to the greatest extent possible.
