Re: Barbara Kaplan
August 7, 2007
Dear Mr. King:
As requested during the public hearing on the captioned application, please find attached (3)
copies of a revised project plan, last dated 6 August 2007, depicting a nonturf buffer that will
extend 10 feet landward of the new bulkhead and include an area up to 6 feet wide landward of
the retaining wall, which is to be legalized through issuance of the subject permit.
Please note that in response to a request by the New York State Department of Environmental
~. Conservation, the existing deck located over and seaward of the bulkhead will be removed in
'favor of a 4' x 8' deck seaward of the new bulkhead, which will attach to the stairs to be
reconstructed. Please also note that a 4-foot wide wood walkway is being proposed landward of
the new bulkhead, between the bulkhead atad re~ining wall.
Although it is my hope that these minor changes can be incorporated administratively into the
pending wetlands permit, please let me know if a formal application to amend the Board's
approval needs to be submitted.

Re:
Proposed Wetland Permit for Barbara Kaplan
SCTM#1000- 92-1-7
BARBARA KAPLAN requests a Wetland Permit to replace (within 18") approx. 126 linear ft.
of existing timber bulkhead with recycled plastic bulkhead; backfill with approx. 15 cy. clean
sand fill to be tracked in from an upland source; and construct 11 'X 14' wood deck and 3' X 6.5'
stairs in same location as existing structures to be dismantled for bulkhead construction. Located:
1700 Inlet Way, Southold. SCTM# 1000-92-1-7
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is INCONSISTENT with the Policy Standards and therefore is
INCONSISTENT with the LWRP:
Policy 6 Protect and restore the quality and function of the Town of Southold
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions.
The proposed action does not comply with § 275-11. Construction and operation standards.
Section (BI) item (a).
"(1)
Bulkheads, retaining walls, revetments and gabions.
(a) Only in-place replacement of existing functional bulkheads (as defined in § 275-
2) is permitted. In-kind replacement relates to the position and dimensions and does not
necessarily require or allow for the use of the same materials. At its discretion, the Board
may allow for a one-time projection of the replacement structure seaward of the original,
only if such placement will not project the proposed strneture seaward of adjacent,
neighboring structures and if the proposed installation is in close proximity to the
original structure. Any subsequent repair or replacement following the first replacement
requires the structure to be built on or landward of the original structure."
The proposed action will proiect further seaward of the existing wood bulkhead to
the west of the property. There is no bulkhead to the east of the property.
Please require that the applicant amend the application to meet the above policy to the
greatest extent possible. Pursuant to Chapter 268, the Board of Trustees shall consider this
recommendation in preparing its written determination regarding the consistency of thc proposed
action.

Re: Barbara Kaplan~ 1700 Inlet Waw Southold
Dear Mr. Terry:
Attached please find an LWRP Consistency Assessment Form, which is being submitted in
association with an application to the Board of Trustees for a Town Wetlands Permit to replace
an existing timber bulkhead with a recycled plastic bulkhead to be located immediately seaward
thereof (within ! 8 inches).
I have indicated that ail policies are "Not Applicable," because pursuant to Town Code §95-5(A)
and the corresponding definitions of "action" and "minor action" by §95-3, the submission of a
LWRP Consistency Assessment Form is not required for this application, as the proposed work
entails only "maintenance or repair involving no substantial changes in an existing structure or
facility."
Respectfully yours,

A. INSTRUCTIONS
LWRP CONSISTENCY ASSESSMENT FORM
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Sonthold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail~ listing both supporting and non-
suooortine facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's website
(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local
libraries and the Town Clerk's office.
