Because of litig&~ion concerning the zone change on ~. Norris' adjacent property, the cluster realty subdivision application was held in abeyance. An order was entered in the Supreme Court, Suffolk county, on December 10, 1975 dismissing this complaint. Even though an appeal .has been filed, Mr. Norris is under no judicial stay and he w~uld like :to proceed expeditiously with the project. I have been informed by the Southold Town Planning Board that pursuant to the provisions of Section 281 of the Town Law approval will have to be obtained from the Town Board as to the location of the cluster realty subdivision before the Planning Board can grant preliminary approval. Would you kindly bring this matter to the Town Board's attention for the adoption of a resolution authorizing the Planning Board to grant approval for the cluster development of this subdivision so that I might proceed with the application. Please be advised: I see nothing wrong with your proposal to divide the ten acres ~ into four lots for one family dwellings, tIc~¢eker~ this will be subject to the approval of the Planning Board as a minor s~divisiont and with lots of that size they will require a legal instrument in recordable £orm that the lots as divided will not be further subdivided in the future. I would recommend that you bring or send a survey of the property with the proposed division marked on it to the Planning Board as soon as possible as they are Jammed with work at the present time. They meet at least every two weeks~ and will give you an answer as soon as they look it over.
