Albertson, Jr. Main Road Southold, New York 11971 Res Klaffky minor subdivision Dear Mr. Albertson: At a regular meeting of the Southold Town Planning Board held October 28, 1975 the proposed map for the minor subdivision of land of Klaffky dated September 9, 1975 was reviewed. There appears to be sufficient acreage to constitute a four-lot minor subdivision. However, there is a question as to the property lines concerning lot number three. The structure shown on lot number three if under new construction would be in variance to the zoking ordinance. In a minor subdivision there can be no more than four lots. Therefore, covenants and restrictions will have to be drawn up that there will be no further subdivision as to lot number four. A sample of the form we require is here at the office.-if you would like a copy. On April 10th I received a map pencilled in with four lots from Mr. Van Tuyl along with a copy of the letter which he sent to you. If you go for a minor subdivision now of four lots we will require that you file covenants and restrict- ions in the County Clerk's Office to the effect that this land will never be resubdivided. As I understand it, if kr-decide in the future to change this to a major sub- division you will have to abandon this map, .rescind the covenants and restrictions and go through the regular ocedure for &..major subdivision. We are glad that you think so highly of the property but this is a lot of money for us end we do not wish to take any subst_ntiel chances. The one question remaining unanswered is : If we go now for four, can we later go for five or six even if we sell one or moreof the 'ou in the interim. In other words let us assume we w n for four; sold three end had three left; could ti.e then tey to dJvJ de this into three plots, assuming youwaivethe playground situation; and if you do not can we go for a di vi si on into two plots of the remaining three. Robert Spies, Esq. 25 St. Pauls Place Hempstead, New York 11550 Dear Mr, Spiess In answer to your letter of April 6, 1975 addressed to this board, we have checked with your engineer and find that there is not enough area there to make six 40,000 square foot lots and provide Sive percent of the area for park and playground. Since we have been told repeatedly by the Town Attorney that all major subdiv- isions should have park and playground and since we feel so strongly that this magnificent plot of land should not have minimum sized lots, this board at this moment is not willing to waive the park and playground provision. This means that you will either have to have a five lot major or as we have so strongly suggested a four lot minor subdivision. We still feel that it would be greatly to your advantage economically and every other way to have four large lots. This could be done more speedily and would save you interest. It would require less redtape With other agencies such as the county and it will provide you the quickest means of disposing of one or more lots. In conclusion, let me say that what;we are actually saying is that .you must meet the town requirOXOnts as everyone else is required to do, . If you are going on with this as a major subdivision, I think it would be wise for you to have a copy of the Rules and Regulations for the Subdivision of Land from the Southold Town Code. This booklet costs $2.14 and I'll be happy to send you one upon receipt of same. If you went ahead and made it a minor subdivision now you could come back in the future to make if a major but, as I understand it, only if you have not sold any of the lots. Whichever way you choose to go, have the maps sent to me and I will have another appointment made for you to discuss your ultimate plan. He read your letter of March 21, 19759 and has suggested that you come to our next meeting and discuss this with the Planning Board. Our next meeting is March 31st and I have made you at appointment for 9:30 p.m. I am sorry the hour is so late but I have four public hearings that night and it is impossible to make it any earlier. Our next meeting will not be until April 21st and I know you would like more information before that time. We would like very much to purchase this property but wanted to clear up a few things: Minor Development. I understpnd this could be cleared -way by may 15 or bfore. What would we have to do to insure this. Major Development. It se.zs to me thatunless there is a mandatory numerical qualification up or down, inview of the fact that the lay out as we sent to you, showing 6 plots, including the re-idence and the barn, does not req uire any road building (all of theparcels having adequate road frontage for direct driveways uff a public road,))that the fact we wish to divide the property into the six plots ri ther than the four shou.d not require this classification to come in as a Major. I note that in 1973 when Van Tuyl prepared the plot plan you have, he referred to it as a minor development even although it did show 6 plots. Now as to a Major Development, what is the time expectancy to dispose of any of the plots. Just what do we have to do in case of Major or Minor. Wehave to make a rather quick decision now and would appreciate your submitting this Tatter to Mr. Rainder? and letting us keO,, at your earliest convenience. I did not quite grasp the matter of the Count/ and State Health and other authorities in case of a Major Development Please clarify. Time is now of the essence.
