Marratooka Road, Mattituck, New York.
Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on July 2, 1980,
reviewed the proposed subdivision plat entitled, "Minor Subdivision - Stanley Chase",
referred to it pursuant to Section 1333 of the Suffolk County Charter. After due
study and deliberation it resolved to disapprove said map for the following five
reasons:
1. The configuration of Lot 2 does not meet generally accepted planning stan-
dards and is not conducive to maximum enhancement of residential amenities.
2. If the area of the panhandle is deducted from the area of Lot 2 the area
of the lot would be less than 35,000 square feet. It is felt that pan-
handle lots should not be created where the main portion of the lot is
less than 1 acre and not of optimum shape approximating a rectangle or
square.
3. The creation of this subdivision will increase residential density in the
vicinity of the airport, thereby increasing all the potential conflicts
that occur between an airport and residential land uses.
4. Any residential structure that is erected upon proposed Lot 2 will be
situated between 250 and 400 feet of the center line of the runway of the
airport subjecting the residence to the impacts resulting from aircraft
taking off and landing, noise, aircraft malfunctioning, etc.
5. No evidence has been provided to show that consideration has been given
to the shoreline erosion problem in the area as evidenced by erosion con-
trol structures along the shoreline as it relates to the creation of a new
building lot on this site.

The Commission is of the oplnlon that consideration should be given to re-
quiring an alternate design that will result in a better lot configuration, greater

The following actions were taken by the Southold Town Planning
Board at a regular meeting held June 2, 1980.
RESOLVED that as a result of the action of the Zoning Board
of Appeals in 1975, the Planning Board is forced to give approval
to the sketch map of the property of Stanley A. Chase ,located at
Mattituck. The Board is not in agreement with this poorly planned
subdivision.
RESOLVED that the Southold Town Planning Board declare itself
lead agency for the subdivision of property of Stanley A. Chase
located at Mattituck. This project is unlisted and an initial
determination of non-significance has been made.
RESOLVED to set 8:00 p.m., Monday, June 30, 1980, at the
Town Hall, Main Road, Southold, New York, as the time and place
for a public hearing on the question of the approval of the minor
subdivision of property of Stanley A. Chase located at Mattituck.

Gentlemen:
I am enclosing herewith an application for a minor subdivision. six copies of the
minor subdivision map, a short form environmental assessment form and my
attorney's check in the amount of $50.00. Please be advised that the property is
presently owned by Klam Properties Inc. and formerly owned by Stanley A. Chase.
n is anticipated that the property will shortly be deeded by the corporation back
to Stanley A. Chase, individually.
This is one of those situations where I submitted the minor subdivision sketch to
the Planning Board by letter dated January 2, 1975. The matter was not accepted
by the Board because it was considered at that time to be strictly a subdivision to
be handled by the Zoaning Board of Appeals. Accordingly. I submitted an applica-
tion to divide the property in 1975 (appeal #2017) and the subdivision was approved
on March 6, 1975. A copy of the Zoning Board decision is enclosed.
Mr. Chase now has purchasers for both parcels one and two for substantial pur-
chase prices. Last week I applied for a vacant land certificate of occupancy for
parcel two. George Fischer, the building inspector, advised me that he had been
instructed by the town attorney on similar instances (where there was only Zoaning
Board approval and no Planning Board approval) not to issue a certificate of
occupancy and that it would be necessary for me to make application to the Plan-
ning Board.

but the Board refused to consider this matter as it was deemed to be strictly a

Zoning Board issue, I would appreciate that you give immediate sketch plan ap-
proval tonight and also pass a resolution tonight setting this down for a public
hearing at the next meeting. I also realize that you must submit this to the Suffolk
County Planning Commission which I request you take care of right away.
Of course, in 1975, the Zoning Board submitted this to the Suffolk County Planning
Commission. I am enclosing herewith copies of the correspondence of the chair-
man of the Zoning Board of Appeals dated March 25, 1975 and the decision of the
Suffolk County Department of Planning dated March 28, 1975.
Again, I would request that you take immediate action on this file since the pur-
chasers are most anxious to close title in time to enjo house for the summer
months.

After investigation and inspection the Board finds that
the applicant proposes to divide waterfront lot with an area
of 82,000 sq. ft. into two lots. Existing dwelling is located
approximately in the middle of the property, thereby creating
a topographical hardship. The westerly lot to be created will
have only 35,000 sq. ft. and the original owner will have 47,000 ...
sq. ft. of area. The new westerly lot to be created will have
only 65 ft. frontage on the right-of-way which is also due to
the location of the existing dwelling. The Board is of the
opinion that it would be an economic hardship to deny the
division of this property and generally agrees with the
reasoning of the applicant. ' ,
The Board finds that strict applicat'ion of the Ordinance
would produce practical difficulties or unnecessary hardship1
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property
and in the same use district1 and the variance will not change
the character of the neighborhood, and will observe the spirit
of the Ordinance. .
