The Zoning Board granted approval to divide property with two existing buildings with insufficient area on the south side of Peconic Bay Boulevard. This was subject to site plan approval of the Planning Board which was granted on February 3, 1975. The Planning Board took action on September 22, 1980, which action was ratified by the Town Board on September 23, 1980, to approve certain actions of the Board of Appeals taken between January 1, 1971 and September 5, 1979. The consensus of the Planning Board was that there appears to be no problem with the proposed change of right-of-way. It is also their feeling that lots 2 and 3 as shown should be one lot. Upon inspection of the premises, the Board has found that the dwellings on Lots land 2 are preexisting of the Town zoning ordinance, and that the width has also preexisted zoning. The Board during June 1974 granted approval of insufficient area in Appeal No. 1914, and it is the feeling of the Board that to deny the area variance requested herein would cause applicant extreme hardship or practical difficulties. However, it is also the feeling of the Board that no action is necessary in regard to the width variance inasmuch as the width has been existing prior to zoning. The Board finds that the circumstances present in this case are unique, and that strict application of the ordinance would produce practical difficulties or unnecessary hardship. The Board believes that the granting of a variance in this case will not change the character of the neighborhood and will observe the spirit of the ordinance. On motion by Mr.' Grigoriis, 'seconded by Mr. Douglass, it .. was RESOLVED, that VICTOR E. TASKER TOWN ATTORNEY 11944 August 14, 1974 Mr. John Wickham, Chairman Southold Town Planning Board Main Road Southold, New York 11971- . 1 v Dear John: Mrs. Brush has advised me that you wish that I advise the Planning Board concerning the question of the approval by the Planning Board of minor sub- division maps in cases where the Board of Appeals has previously granted a variance reducing the size of one or more lots below that required by the zoning ordinance. As I have indicated to both you and Mr. Gillispie, Chairman of the Board of Appeals, it is my opinion that once a variance has been granted by the Board of Appeals permitting the reduction in the size of one or more lots, that thereafter such lots are to be considered as legal size lots. It would be my further opinion that in cases where the Board of Appeals has granted a variance to reduce the size of one or more lots, that thereafter when the Planning Board is considering the approval of a minor sub-division, that the Planning Board cannot deny minor sub-division approval on the basis that one or more lots shown thereon are of a size less than that provided in the zoning ordinance. The foregoing, however, is not to be construed to mean that the Planning Board must as a matter of course approve the minor sub-division map. It should consider the map and it should make it's decision based upon all other matters which the Planning Board is to consider when an application for a minor sub-division is presented to it. It is approxi- mately 550 feet in length extending to peconic Bay, and consists of 1.17 acres. Prior to zoning the applicant constructed two houses on this property as shown on the survey attached to the application. A family situation exists which they would like to resolve at this time by the subdivision proposed on the attached survey. In granting variances of undersized lots the Appeals Board is required to consider the character of the surround- ing area. In this case, the land immediately to the east was divided into four presently undersized lots of approxi- mately one half acre each. Across the street, on the north side of Peconic Bay Boulevard, are a number of undersized parcels ranging from one quarter to one half acre in size. To the west, separated by two full lots from applicant's property, there are a considerable number of undersized lots as shown on the attached tracing of the tax map. Accordingly, the Appeals Board views the application favorably and has so resolved the matter subject to approval of the Planning Board. .. . . . , Southold Town Board of Appeals -2- June 14, 1974 The applicant has created a road and deeded right of way for the rear lots. It seems to the Appeals Board that applicant's proposal is a most favorable disposition of the property.
