A motion was made by TRUSTEE KRUPSKI, seconded by TRUSTEE
TUTHILL.
I. MONTHLY REPORT:
Trustees monthly report for May 1992: A check for $7,723.33 was
forwarded to the Supervisor's Office for the General Fund.
II. PUBLIC NOTICES:
Public notices are posted on the Town Clerk's Bulletin Board for
review.
III. AMENDMENTS/WAIVERS/CHANGES:
1. Henry Smith request amendment to permit 91609 to add a pile
to help tie off boat to Town Creek, located Hobart Road,
Southold. Pile is approx. 10' off end of float towards
inshore end of float. Motion to approve was made by TRUSTEE
KRUPSKI and seconded by TRUSTEE Tuthill. ALL AYES.
2. Jay Wooster request amendment to permit %2228 (formally
Stanley Mackiewicz) to add onto the south end of existing dock

to go no closer than 5 1/2 feet to property line. Ail other
existing docks with stay the same. Located 710 Maple Lane,
Greenport. Jay inspected the area and suggested south side
instead of north side originally requested. A motion was made
by TRUSTEE PRESIDENT JAY and seconded by TRUSTEE KRUPSKI. ALL
AYES.
3. Ezio Vlacich request waiver to clear property located on
Goose Creek for possible sale. Property located on Gagens
Landing Road, Southold. Applicant can clear his property
provided he went no closer than 100 feet to MHW. Motion was
made by TRUSTEE PRESIDENT JAY and seconded by TRUSTEE SMITH'.
ALL AYES.
4. Gladys Milne request waiver to construct deck on west side
of house. Located Knollwood Circle, East Marion. Trustee
agreed that drywells should be placed also. Motion was made by
TRUSTEE KRUPSKI seconded by TRUSTEE TUT~HILL. ALL AYES.
5. Kathleen Collins request waiver to construct additions to
existing single family dwelling. Property on Darby's Cove,
Fishers Island. Motion was made by TRUSTEE TUTHILL seconded by
TRUSTEE SMITH. ALL AYES.
6. Windsway Building Corp. request an amendment to permit
number 4015 to have a 36" fixed dock and walkway instead of a
30'. Located Indian Neck Lane, Peconic. Richmond Creek. This
increase was due to a large man who needs theincr~ased width
and support. A motion by TRUSTEE SMITH and seconded by TRUSTEE
KRUPSKI. ALL AYES.
IV. PUBLIC HEARINGS:
7:19: In the matter of application of John Fiore to construct
a 20' X 40' inground swimming pool and to construct a 14' X
32' ramp and a 6' X 24' floating dock with (2) 2 1/2" galvanized
pipes attached to existing bulkhead. Old dock will be removed,
new dock will extend no further seaward than 1/3 across the
channel at MLT with boat at dock all in accordance with
revised survey dated June 22, 1992. Located 50 Sunset Way,
Southold. A recommendation for an amendment and request owner
to put retaining wall on east side and drywell. Pool was
reduced to 16' X 40'
TRUSTEE KRUPSKI: It's going to be a formidable ramp, 14 X 32'.
BRUCE LOUCKA: Did they relocate the swimming pool?
TRUSTEE BREDEMEYER: Yes they have. We will be voting to do an
amendment ahead of doing a final vote on this. It's now been
brought within the confines of the back yard. This conforms with
what the board looked at, and we discussed in the field.
TRUSTEE KRUPSKI: We also have a retaining wall at the edge of
the fence.
TRUSTEE BREDEMEYER: The pool itself had been reduced in size to

TRUSTEE KRUPSKI: The only thing I don;'t see is the ramp and
floating dock.
TRUSTEE BREDEMEYER: Is there anyone who wishes to speak on
behalf of this application?
TRUSTEE SMITH: It's a 14 X 32" ramp, is that correct?
TRUSTEE KRUPSKI: It's not shown on the survey. Its 1/3 way
across the channel. With the boat?
WOMEN IN AUDIENCE: I'll try to answer your question.
TRUSTEE SMITH: Do you have a survey with the dock and where it
going?
TRUSTEE SMITH: Never mind, we have it. Its at the end of the
creek and I don't think there is any problem. Its community
access. Just put it down that it with boat at the end of the
dock that it can't exceed one third the distance.
TRUSTEE BREDEMEYER: Is there anyone who wishes to speak against
this~ application? There being no further co~muents I'll take a
motion to close the hearing in this matter.
TRUSTEE SMITH: So moved
TRUSTEE KRUPSKI: Seconded. ALL AYES
TR~USTEE BREDEMEYER: Motion to move the minor amendments that
were included. Including the 16 X 40' inground pool, and 14 X
32" ramp.
TRUSTME KRUPSKI: Seconded. ALL AYES
TRUSTEE: BREDEMEYER: A pleasure to vote to approve in this
matter.
TRUSTEE SMITH: So moved.
TRUSTEE KRUPSKI: Second. ALL AYES.
7:19 P.M. In the matter of the application of William Schneider
request to construct approx. 100' of timber bulkheading with
a 16' return at the southern terminus, to backfill structure
with approx. 300 c.y. of clean sand which shall be trucked in
from an upland source and reconstruct existing stairs to beach.
Upon completion applicant will assist in preparation of bluff
planting plan. Located 3675 Nassau Point Road, Cutchogue.
TRUSTEE BREDRN~FER: We previously granted a negative
declaration. Anyone here who wishes to speak on behalf of this
application?
TOM SAMUELS: If you have any questions I'll be glad to answer
for you.
TRUSTEE KRUPSKI: What does this mean, applicant will assist in
preparation of the bluff planting plan?
MR~ SAMUELS: I don't know what that means, but my assumption is
they would supply you with plans to plant before you grant the
permit.
TRUSTEE KRUPSKI: It should be but its a little confusing.
MR. S~UELS: they plan to plant Rosa Ragosa and stuff like that.
TRUSTEE SMITH: Upon completion, the .applicant will assist in
preparation of planting, in other words it sounds like a an
estimation.
TRUSTEE KRUPSKI: They could have toe failure, because the area
you could have water come above the bulkhead.

~LR. SAMUELS: There is no question the east side of Nassau
Point, sooner or later you'll have over topping.
TRUSTEE BRE~EMEYER: I don't think there is any question on the
plan. Anyone here who wishes to speak against this application?

TRUSTEE SMITH: So moved.

TRUSTEE BREDEMEYER: Motion in the matter of the application of
William Schneider?
TRUSTEE SMITH: So moved°
TRUSTEE KRUPSKI: Second. ALL AYES.
7:24: In the matter of the application of David Weild request
permit to increase height of existing bulkhead, raise garage to
higher elevation, renovate existing driveway. Location 10450
New Suffolk Avenue, Cutchogue.
TRUSTEE BREDEMEYER: I'm at a loss because I don't have a score
sheet on SEQRA here and I don't know if we have another file or
not. I'm missing some material. I have some CAC comments.
If there anyone here who wishes to speak on behalf of this
applicant? I'm not entirely sure,,but we may have to recess this
hearing because of possible process error that we never
concluded SEQRA on it.
TRUSTEE SMITH: When we looked at it, we weren't very happy with
it I remember that. We would have no objection if they raised
the grade but let the bulkhead at the same height.
BRUCE LOUCKA: We said raise the house, but leave the bulkhead
the same~ on the east side.
TRUSTEE BRED~MEYER: CAC recommends disapproval of bulkhead
and retaining wall. Counsel recommends approval raising of and
grading. Counsel stipulates that if a retaining wall is
necessary it be placed within proximity of thehouse within 15
to 20 feet of the house. So the feeling was, provide the needs
of the house and avoid the structure on the edge of the marsh.
The Trustees similarly felt that we preferred that we not seeing
the retaining wall on the east side in proximity of the
wetlands. I think there was concern there of the overtopping
'or storm event there would be .washing and disrupting the
wetlands that was there, which was nice healthy merging
vegetation. We do have a problem, I don't know if was just
misplaced or if we ever properly handled our SEQRA review.
MR. SAMUELS: It was on the agenda last time. and I think you
were doing the SEQRA review.
TRUSTEE BREDEMEYER: I thought we had done a negative
declaration which may mean there was a misfileor inadvertently
the fly leaf which has all the pertinent information is severed
from the file.
BRUCE LOUCKA: We can check with the agenda.
TRUSTEE BREDEbIEYER: Obviously it wouldn't have come up for a
hearing if we hadn't voted it.
MR. SAMUELS: On the east side therefore you want no bulkhead
along the property line but planting 15 or 20 feet from the
house a retaining wall to retain fill around the house.
TRUSTEE SMITH: Correct.

TRUSTEE BREDEMEYER: Is there anyone here who wishes to speak
otherwise of this application? Any further comments? There
being none, I'll take a motion to close the hearing in this
matter.
TRUSTEE SMITH: So moved.

TRUSTRE BREDEMEYER: What's your pleasure on this application?
TRUSTEE SMITH: They're going to have to make a revised
application~ to us and then we can approve it at that time.
TRUSTEE BREDFAMEYER: Depending how it's revised, it may even be
waiverable if its a retaining wall on the lawn area.
TRUSTEE SMITH: Correct.
TRUSTEE BRRnEMEYER: Do you want to take a motion to table a
vote in this matter?
TRUSTEE SMITH: I'll make a motion to table the vote until we
see their revised application and we will review that for a
possible waiver.
TRUSTEE KRUPSKI: Second. ALL AYES.
TRUSTEE B~DEMEYER: Dr. Samuels are you acting to communicate
this or would.you like a separate co~u~unication confirming the
discussion we had?
DR. SAMUELS: I'll speak to them.
TRUSTEE BREDEMEYER: Ok when we hear back we'll automatically
put it on for next months agenda.
TRUSTEE SMITH: ~d as soon as you get it back give a copy of it
to the CAC.
7:33 In the matter of the application of Mattituck Park
District request permit to construct 135' of existing timber
bulkhead and two returns totalling 45' within 18". Applicant
proposes to reconstruct within 18" existing 50' of timber jetty
at la~$ching ramp. Located on Route 48 and Love Lane, MattitUck.
TRUSTEE BREDEMEYER: Is there anyone here who wishes to speak on
behalf of this application?
TRUSTEE SMITH: We had no problem with this.
TRUSTEE BREDEMEYER: Anyone who wishes to speak against this
application?
BRUCE LOUCKA: I don't think we saw this application.
TRUSTEE SMITH: This is just the park district in Mattituck.
TRUSTEE BREDEMEYER: I don't have CAC comments entered in the
fly leaf. It's a rebuilt essentially in place. Do you want to
take a look at it now Bruce?
BRUCE LOUCKA: No.
TRUSTEE SMITH: Do YOU want to approve it Jay, with the
stipulation that the CAC could return comments?
BRUCE LOUCKA: How is it?
TRUSTEE SMITH: Its basically straight forward, its maintenance.
TRUSTEE BREDEMEYER: It was sent to the CAC on May 19th.
TRUSTEE BREDEMEYER: ~uyone here who wishes to speak against
this application? There being no further comment I'll take a
motion to close the hearing in this matter.
TRUSTEE SMITH: So moved.
TRUSTEE TUTHILL: Second. ALL AYES.

TRUSTEE BREDEMEYER: Motion in the matter of this applicant.
TRUSTEE SMIT~: I make a motion that we accept this application
and approve the Mattituck Park District.
TRUSTEE ALBERTSON: Second. ALL AYES.
7:35: In the matter of the application of Gerard Keegan to
construct a 4' X 30' fixed dock elevated a minimu~ of 4' over
existing IM, a 4' X 12' ramp and a 4' X 24' float. Located
100 Beachwood Lane, Southold.
TRUSTEE BREDEMEYER: A CAC co~mLlents, we do have. Provided
subject to maintaining 25' of vegetated buffer. Is there anyone
here who wishes to speak on behalf of this application.
TRUSTEE SMITH: I looked at it and didn't have any problem with
it.
TRUSTEE BREDEMEYER: Is there anyone who wishes to speak against
this application? No further co~L~,ent, I'll take a motion to
close the hearing.
TRUSTEE SMITH: So moved.
TRUSTEE KRUPSKI: Second. ALL AYES.
TRUSTEE BREDEMEYER: Motion in this matter?
TRUSTEE SMITH: I make a motion to approve this application as
stated with the 25' buffer with the CAC's recommendation.
TRUSTEE ALBERTSON: Second. all ayes.
7:37: In the matter of the application of Geoffrey Penny to
construct a 4' X 80' catwalk and 3' X 14' ramp and 6' X 20'
floating dock. Location at 2420 Deep Hole Drive, Mattituck.
TRUSTEE BREDEMEYER: If you recall we previously required
soundings which were provided with the basis when we voted. We
decided to put this back on for hearing. We do have the
soundings here if anyone wishes to check them. It clearly shows
the dock is no where near the navigable channel~ Anyone who
wishes to speak on behalf of this applicant? Anyone wishes to
speak against this applicant? there being no other comments
TRUSTEE SMITH: I make a motion to please close the hearing on
this applicant.
TRUSTEE ALBERTSON: Second. ALL AYES.
TRUSTEE BREDEMEYER: Motion in the matter to approve or deny the
applicant.
TRUSTEE SMITH: I make a motion we approve the application.

V. ASSESSmENTS/ENVIRONMENTAL DECLARATIONS:
1. Eh-COnsultants on behalf of Sharon Li to construct 206+/-
1.f. of timber retaining wall including (2) 18" returns. Wall
will be landward with line of Wernick to west. It will be
above ~ and be ~hout 10' out from toe of bluff. Approx. 350
c.y. of clean sand will be brought in from access point at Duck
Pond Road, East Mattituck, approx. 1 mile to west. Wall will
be secured with 3+,/- ton stone and have stone splash pad

behind. Rebuild a portion a 3' wide steps destroyed by
Halloween storm and add 4' X 4' platform and steps for access to
beach. Located Bridge Lane, Cutchogue. TRUSTEE SMIT~moved to
give this a negative declaration. ~RUSTEE KRUPSKI seconded.
ALL AYES.
2. Vollmuth & Brush on behalf of William Johnson request
permit to construct 40' X 55' house with 20' X 25' garage, 15' X
70' driveway, 45' X 40' parking area, 20' X 40' pool, 4' X 80'
walkway, 15' X 22' sitting area, 6' X 24' floating dock.
Located' Gagens Landing Road, Southold. Board to ask them to
move the deck landward to 3 foot contour. A motion was made by
TRUSTEE KRUPSKI and seconded by TRUSTEE SMITH. ALL AYES.
3. Glenn Just on behalf of William Riley to construct 145' of
bulkhead with approx. 20 c.y. of clean sand. Applicant has
DEC permit. Located Cedar Point Drive, West, Southold. Board
to rescind positive declaration and move with negative
declaration.
TRUSTEE SMITH moved~ to rescind our positive declaration, and
refer to CAC. TRUSTEE SMITE Made a motion to grant a negative
declaration, TRUSTEE KRUPSKI seconded. ALL AYES.
4. Robert Dwyer on behalf of Aristides Giosasi to
construct decks as shown on survey dated March 27, 1992.
Property located in ROW off Indian Neck Lane, Southold. TRUSTEE
KRUPSKI made a motion to a negative declaration, TRUSTEE SMITH
seconded. ALL AYES.
5. Aubrey Consulting, Inc. on behalf of Burton Tremain, Jr.
to construct a rock revetment on property located on Fishers
Island near West Harbor. Trustees agreed they need a coastal
erosion hazard act. Tabledv incomplete application. No fee
tendered~ TRUSTEE SMITH made a motion to table, TRUSTEE' KRUPSKI
Second. ALL AYES.
6. Glenn Just on behalf of Stewart Rauch to construct a
single family dwelling with associated sanitary system stone
driveway, dock, garage and etc. as ~er plan dated APril 28,
1992. Located off Equestrian Ave. Fishers Island. Motion to
table this application made by TRUSTEE SMITH, TRUSTEE TUT~ILL
SECONDED. ALL AYES.
7. Glenn Just on behalf of James Bailey to construct a stone
wall by realigning boulders and constructing garden as per
enclosed plans as prepared by Chandler, Palmer & King dated
April 7, 1992. Located private road off of Oriental Avenue,
Fishers Island. Tabled until completion of Coastal Erosion
Permit and a Wetlands Permit. No fe~s were collected. TRUSTEE
SMITH moved to table, TRUSTEE KRUPSKI second. ALL AYES.
8. Walsh service on behalf of John Irwin to construct 17' X
17.4' dick at the rear of the Irwin cottage. The deck will be
on approx. 7 - 8' sonotubes 36" deep which will be the only land

disturbed. The dirt will be placed against the foundations to
help keep water out of the basement. TRUSTEE TUTHILL moved for
a waiver, TRUSTEE KRUPSKI seconded. ALL AYES.
9. En-Consultants on behalf of Roger Vorce to construct 200
1.f. of timber retaining wall to connect to and be in line with
partially constructed wall on other land of Vorce directly
east. Armor retaining wall with 1 ton rip-rap. An 18' return
will be constructed on west side. Approx. 350 c.y. of clean
sand will be trucked in for backfill. Wall will be above spring
high water. Located ROW off Bridge Lane, Cutchogue. A motion
was made by TRUSTEE KRUPSKI to table this application, seconded
BY TRUSTEE SMITH. ALL AYES.
VI. RESOLUTIONS:
1. Board to set public hea~ings for the July 23, 1992 regular
meeting.
2. Severus De Leo request grandfather permit for bulkhead as
noted on survey. Property located at Cedar Point Drive East,
Southold. TRUSTEE requested an approval subject to TRUSTEE
SMITH'S INSPECTION. JAY approved motion, TRUSTEE KRUPSKI
seconded. ALL AYES.
3. Docko, Inc. on behalf of Fishers Island Development
Corporation request grandfather permit for thereconstruction of
an existing fixed wood dock. Location near East Harbor, as
shown on enclosed map. TRUSTEE TUTHILLmade a motion to approve
grandfather permit, TRUSTEE KRUPSKI seconded. ALL AYES.
4. Luis Portal request an extension for Permit ~16121 to expire
on Sept. 29, 1992 to construct 4' X 20' catwalk, 4' X 10' ramp,
6' X 18' float, install 8 pilings. Dredge to 3' below MLW on
south side of float to max. of 20' out from MHW. JAY made a
motion that this will be his final extension, TRUSTEE SMITH
seconded. ALL AYES.
5. Aaron Avent requests permit for duck blind in West Creek.
JAY approved the permit and motion, TRUSTRR KRUPKSI seconded.
ALL AYES.
6. Cutchogue Harbor Marina request a waiver. A motion to grant
a waiver made by TRUSTEE SMITH, seconded by TRUST. EE TUTHILL.
ALL AYES.
7. Deborah Penny request a change of name on permit ~197o
Property located at 1 Sailors Needle Road, Mattituck. TRUSTEES
suggested they notify Town Attorney. TRUSTEE SMITH made a
motion that the Tachets use the east side of dock and Penny's
use west Side until attorneys can solve problem. TRUSTEE
KRUPSKI seconded. ALL AYES.

VII. MOORINGS:
1. James B. Fogarty request a 10' duck blind in West Creek
TRUSTEE SMITH motioned to table until we inspect it, TRUSTEE
TUTHILL seconded. ALL AYES.
2. Richard C. Hilary request a duck blind in Corey Creek with
4 anchors @ 80 lbs. each. TRUSTEE SMITH motioned to approve,
TRUSTEE KRUPSKI second. ALL AYES.
3. Burak A. Gunbay request mooring in Richmond Creek for
19' boat with a 200 lb. mushroom. TRUSTEE SMITH approved
subject to Bay Constables inspection, JAY seconded. ALL AYES.
4. Joseph E. Merker request a mooring in Goose Creek for a
26' inboard with a 150 lb. mushroom, in Richmond Creek. TRUSTEE
SMITH approved subject to Bay Constables inspection, JAY
seconded. ALL AYES.
5. Timothy Mc Kiernan request a mooring in Goose Creek for a
17' outboard for offshore stake with pulley. TRUSTEE SMITH
approved, TRUSTEE KRUPSKI seconded. ALL AYES.
6. Alfred Kettenbeil request a mooring for a 14' outboard in
Goose Creek. JAY moved that we deny stake without prejudice,
TRUSTEE SMITH seconded. Approved mooring in Goose Creeks. ALL
AYES.
7. Karl P. Johnson request a mooring for a 20f outboard in East
Creek with a 150 lb. mushroom. TRUSTEE KRUPSKI moved for
approval subject to inspection from Bay Constable, JAY
seconded. ALL AYES.
8. William Childs request a stake on Brushes Creek for a 21'
outboard. JAY moved approved subject to available space when
Mr. Murray completes his project, TRUSTFR KRUPSKI seconded.
ALL AYES.
At 9:13 p.m. TRUSTEE SMITH made a motion to adjourned the
meeting, TRUSTEE KRUPSKI seconded. ALL AYES.
