Board of Trustees 2 January 16, 1992
Approve Minutes of regular meetings of November 14, 1991 and
December 12, 1991. A motion was made by TRUSTEE TUTHILL
seconded by TRUSTEE SMITH. ALL AYES.
I. MONTHLY REPORT:
Trustee monthly report for December 1991: A check for $2,642.61
was forwarded to the Supervisor's Office for the General Fund.
II. PUBLIC NOTICES:
Public notices are posted on the Town Clerk's Bulletin Board for
review.
III. AMENDMENTS/WAIVERS/CHANGES:
1. Diane Herold on behalf of NOREEN GIACONE request a
waiver to move the existing location to permit the construction
of an enclosed porch on the southwest sides. The house is to be
raised and placed on a pile foundation.. Located at Bungalow
Lane, Mattituck.
A motion was made by TRUSTEE SMITH and seconded by TRUSTEE
KRUPSKI to grant a waiver for this proposal. ALL AYES.
2. En-Consultants on behalf of JOHN CROSSLEY request waiver
to construct up to 80' of bulkhead located on 912 Peconic Bay
Boulevard, Laurel.
A motion was made by TRUSTEE TUTHILL and seconded by TRUSTEE
SMITH subject to applicant applying for a grandfather permit.
ALL AYES.
3. NORTH FORK COUNTRY CLUB request waiver to rebuild the tee
off green for the 15th hole. Located Rt. 25, Cutchoque. A
motionwas made by TRUSTEE BREDEMEYER and seconded by TRUSTEE
KRUPSKI to approve waiver subject placing hay bales along
perimeter and inspection of haybale line. ALL AYES.
IV. PUBLIC HEARINGS:
THIS IS A PUBLIC HEARING IN THEM ATTER OF THE FOLLOWING
APPLICATIONS FOR PER~4ITS UNDER THE WETLANDS ORDINANCE OF THE
TOWN OF SOUTHOLD. I HAVE AN AFFIDAVIT OF PUBLICATION FROM THE
SUFFOLK TIMES AND AN AFFIDAVIT OF PUBLICATION FROM THE LONG
ISLAND TRAVELER-WATCR~4AN. PERTINENT CORRESPONDENCE MAY BE READ
PRIOR TO ASKING FOR CoMMENTs FROM THE PUBLIC.
7:15 P.M. - In the matter of Proper-T Services on behalf of
JOSEPH CORNNACHIA to construct 390 1.f. of bulkhead within
18" of existing functional, bulkhead & Maintenance dredge 4000
c.y. of material from naturally filled channel to depth of 6'
below MAK4. Located Kimberly Lane, Southold.
TRUSTEE SMITH: This is u~der that bridge to keep the creek open?

TRUSTEE BREDEMEYER: That is correct. Is there anyone here who
wishes to speak on behalf of this application?
MR. FITZGERALD: There is nothing new that isn't the file, but
if you questions or comments I will be happy to answer or
address.
TRUSTEE BREDEMEYER: I think properly scoped this out and the
requirement that we reopen the entrance there, I think is
certainly welcome. I am glade that Mr. Cornacchia is working
with us on that. I think that would be functionally good for
the creek.
MR. FITZGERALD: A long those lines, the Dept. of State was
interested in knowing how far out into the Bay we intended to
dredge. I responded to them that the intention was merely to
open to natural flow and not for navigational purposes so that
it would probably be something to improve.., the water°
TRUSTEE BREDEMEYER: I believe that would be the understanding
of the Board when we discussed it with you. We understood what
the foot bridge precluded normal navigation. We wanted just for
flushing.
MR.'FITZGERALD: Yes.
TRUSTEE BREDEMEYER: Is there anyone here who wishes to speak
against this application? There being no comment, any members
of the Board?
TRUSTEE Kt~UPSKI: Just one thing that we discussed before. Is it
possible to put a gate on the foot bridge to keep dogs out of
the turn nesting area.
MR. FITZGERALD: I am sure that can be done.
TRUSTEE SMITH: I don't think that would be necessary.
TRUSTEE KRUPSKI: You don't think so, O.K.
TRUSTEE BREDEMEYER: There being no further comment, I take a
m~tion to close the hearing in this matter.
TRUSTEE SMIT~: So moved.
TRUSTEE TUT~ILL: Second. ALL AYES.
TRUSTEE SMITH: I make a motion that we accept this application
in favor of.
TRUSTEE KRUPSKI: Second. ALL AYES.
TRUSTEE BREDEMEYER: The next hearing originally scheduled 7:16
p.m. in the matte~ of Docko, Inc. on behalf of HAT HARBOR CLUB
request to maintenance dredge the entrance channel into Hay
Harbor approximately 1,000. c.y. to depth of 4' at MLW.
Located at Fishers Island. Is there anyone here who wishes to
speak on behalf of this application? Is there anyone here who
wishes to speak against the application? I just want to say the
people of fishers Island are in favor of this application
because the water quality of Hay Harbor has been a problem and
they feel the flushing will be beneficial.
TRUSTEE SMITH: I make a motion to close the hearing.
TRUSTEE TUTHILL: Second.
TRUSTEE SMITH: I make a motion to approve this application.
TRUSTEE TUT~ILL: Second. ALL AYES.
TRUSTEE BREDEbIEYER': 7:17 p.m. in the matter of Frank DeNicola,
Jr. on behalf of ROBERT MCGUIRE request to construct 24' X

24' attached garage with a pervious gravel driveway.. Located at
North Parish Drive, Southold. We have in the file now, cross
sections and diagrams which should more properly indicate to the
Trustees how they would proceed. They tidied it up a lot.
TRUSTEE KRUPSKI: I still have a problem with that. I don't have
a problem with the location, I have a problem with the
driveway. They could bring the garage around to the west and
eliminate most of the driveway and allow for better drainage.
As it is now the water is going to shoot right down there. If
they change their driveway entrance to here they can still have
a large turn around area.
TRUSTEE BREDEMEYER: They indicated that it was a preference not
ta do that. Why doesn't the Board consider requiring berming
then.
TRUSTEE KRUPSKI: I would like to see adequate drywells here that
take all runoff from this driveway. You know it is going shoot
right in.
TRUSTEE BREDEMEYER: The applicant is fixed on the orientation,
but he indicated over the phone that he would be willing to put
such additional drainage or those things that would be
required. We can impose a requirement to contain drainage for a
2" rain fall in the driveway surface.
TRUSTEE KRUPSKI: Who would tell us that?
TRUSTEE BP~BEMEYER: We could ask the capacity be gauged by the
Town Engineer if you want. It's a simple matter of taking the
area off the survey. We could move it along with respect to a
condition for rainfall containment and ask for a calculation.
We ask for an additional inspection to inspect the size of the
drywell. Are there any other additional concurrents with respect
to this application? I'll take a motion to close the hearing.
TRUSTEE SMITH: So moved.
TRUSTEE TUTHILL: Second. ALL AYES.
TRUSTEE BREDEMEYER: A solution on the matter?
TRUSTEE KRUPSKI: I'll make a motion that we approve the matter
to construct the garage and the pervious gravel driveWay with a
condition that he provide adequate driveway drainage for 2"
rainfall from Town Engineer, and that the final grade be
bermed so that no runoff be allowed to be vegetated.
TRUSTEE BREDEMEYER: Motion's been made, is there a second?
TRUSTEE TUTHILL: Second. ALL AYES.
V. ASSESSMENTS/ENVIRONMENTAL DECLA/~ATIONS:
1. Land Use Company on behalf of VILLAGE MARINE request permit
to reconstruct and extend existing boat ramp utilizing
pre-cast concrete slabs. Said ramp will extend approx. 20'
beyond existing ramp terminus. Additionally applicant proposes
to maintenance dredge approx. 1500 s.f. of the existing marina
to provide a 4' depth at MLW. Approx. 140 c.y. of sand/silt
to be removed via crane with clam shell and trucked off site for
upland disposal. Located Bay Avenue, Mattituck. TRUSTEE SMITH
made a motion to give a negative declaration, and not accept the
application until our recommendation are filled, TRUSTEE KRUPSKI
second. ALL AYES.

2. Land Use Company on behalf of WINDSWAY BUILDING CORP.
proposes to construct one 4' X 50' and one 4' X 40' timber
stairway from top of bluff to base of slope. Stairway will lead
to a 4' X 225' elevated timber catwalk constructed along slope
toe to a 4' X 60' timber catwalk connecting adjoining property
staircase (4' X 40' ) and common beach area. Catwalks will
provide beach access over wetland area. Additionally, applicant
proposes to construct a 4' X 100' elevated timber catwalk
leading to a 3' X 10' ramp and (2) 6' X 20~ floats in "T"
formation secured by 8" pilings. Catwalk will be elevated 4'
over TWL area. Located Indian Neck Road, Southold. TRUSTEE
SMITH moved for a negative declaration, approval for catwalk
only with a letter from neighbors, TRUSTEE KRUPSKI second. ALL
AYES.
3. Latham on behalf of Forman for Calves Neck dock. TRUSTEE
KRUPSKI moved for a negative declaration, TRUSTEE SMITH second.
ALL AYES.
4. Mc Goldrick - TRUSTEE SMITH moved for a lead agency and
complete application, TRUSTEE BREDEMEYER second. ALL AYES.
VI. RESOLUTIONS:
1. Board to set public hearings for application which request
negative declarations and the following actions for the February
27th regular meeting.
a. Proper-T Services on behalf of JOSEPH FRIEDMAN request
permit to construct fixed open walkway 3' X 35'; hinged
ramp 3' X 12'; two floating docks, each 5' X 15';
floating docks secured by four spiles; all per
drawings and diagand diagrams submitted. Located 590
Riley Ave., MattitucMattituck. TRUSTEE KRUPSKI moved,
TRUSTEE ALBERTSON second. ALL AYES.
2. Glenn Just on behalf of ALBERT CRABTREE request
grandfather permit for 78' bulkhead and to reconstruct same
within 18" according to DEC Permit. Located 3080 Peconic Bay
Blvd, Laurel. TRUSTEE TUTHILL moved, TRUSTEE ALBERTSON
second. ALL AYES.
3. Glenn Just on behalf of ARTHUR GATE~OUSE request
grandfather permit for 148' bulkhead and to reconstruct same
within 18" according to DEC Permit. Located 2870 Peconic Bay
Blvd, Laurel. TRUSTEE TUT~ILL moved, TRUSTEE ALBERTSON
second.
4. Glenn Just on behalf of Madeline Bitner request
emergency permission to reconstruct bulkhead. TRUSTEE SMITH
moved to approve subject all plans and specifications of DEC
Permit and completed application filed by Glen Just for the
Bitners, TRUSTEE KRUPSKI second. ALL AYES.

5. CHARLES SIDOROWICZ request grandfather permit for dock
constructed prior to 1978. Located 3300 Cox Neck Road,
Mattituck. TRUSTEE TUTHILL moved, TRUSTEE ALBERTSON second.

6. FRANK BURR request grandfather permit for dock as per
application and DEC permit. Located Hedge Street, Fishers
Island. TRUSTEE TUTHILL MOVED, TRUSTEE ALBERTSON second.

7. FEE SCHEDULE for chapter 32. TRUSTEE SMITH moved, TRUSTEE
TUTHILL second. ALL AYES.
8. COREY CREEK ASSOCIATION - Re: Shellfish closure. TRUSTEE
SMITH moved to table until we receive a letter from DEC.
TRUSTEE KRUPSKI second. ALL AYES.
VII. MOORINGS:
1. RICHARD OSMER, JR. request mooring in Corey Creek for a
22' Catalina with a 150 lb. mushroom. Access: Corey Creek
Association. TRUSTEE BREDEMEYER moved to table this, TRUSTEE
TUTHILL second. ALL AYES.
2. EDWARD HALPERT request mooring in Town Creek for a 28' E &
D Stuart with 300 lb. mushroom at bow/200 lb. mushroom at
stern. Access: Goldsmith's TRUSTEE SMITH moved to approve
subject to a temporary buoy to be checked by Bay constable.
TRUSTEE KRUPSKI second. ALL AYES.
3. MARIE FERNANDEZ request mooring in Town Creek for a 27'
Sloop with a 300 lb. mushroom. Access: Young's Road. TRUSTEE
SMITH moved to approve same as above. TRUSTEE KRUPSKI second.
ALL AYES.
