DENNIS~KEDJIERSKI requests an amendment~to Permit 94215 to replace the existing 44' X 10' solid filled pier with a 44' X 6' open piling pier and a 40' X 5' floating dock, remove all remaining existing concrete from the property and replace with the ground level timber deck connecting the house and pier, in same configuration and dimensions as concrete patio, area on eastern side of pier is extremely steep with broken concrete rubble, and upon removal of this rubble there will be an acute erosion problem and to alleviate the situation it is proposed that approx. 40 s.f. of th~ top of the bank be cut back and approx. 30 s.f. of lower bank be filled with 3 c.y. of clean sand which will result in less severe slope (approx. 30 degrees) which will be able to be planted with spartina alternaflora. Also to add a set of stairs 2'10" X 13' leading from the upper deck to the ground level and would come off a 4'6" X 3' platform at northwestern corner of the deck. CAC recommends approval provided all decks are a minimum of 4' above the ground and all exposed areas be planted with American Beachgrass. TRUSTEE HOLZAPFEL: My only concern is was the platforms, you know the 4' X 8'. TRUSTEE KRUPSKI: Well, do you want to reduce the size of the platforms? That's a little large. We have a probIem with platforms at the top of bluffs, because they tend to collect and direct rain water. But I think we. would want to reduce in size some of these. This platform is already on a slope (indicating on map)coming down. You have your 80' contour and your 70' contour, so your already coming down this slope here and You don't want to cr. eate a problem. I'll take a motion to close the hearing. JIM FITZGERALD: I don't have anything-to add, but would be happy to discuss this if there is a problem. TRUSTEE KRUPSKI: Anyone here who' would like to speak against this application? CAC reco~end disapproval because it is not needed. The CAC suggests the applicant stop the runoff from the lawn and provide a buffer of natural vegetation or a berm to prevent the runoff. Council also suggests the applicant stop throwing lum~er and other materials off the cliff.' This is a Suffolk County Soil & Water Conservation Dept. plan. Do we have that plan in the file? MR. FITZGERALD: I don't think so, but it could be. Among the things he talks ~bout is cutting back the ..... eliminating the ' much of the gullies that are fo£a~ed and the water running down the base of the bluff. And of course as the CAC says, taking measures of top soil to keep water from coming off the property and running down the face of the bluff. TRUSTEE KRUPSKI: Could we get a copy of that? We would like to have that. I guess we'll vote on this upon receipt of that. SPEAKER: (did not get name) Are we convinced that south construction is the way to go in terms of soil erosion? Are you guys convinced of this? TRUSTEE HOLZAPFEL: We've gone through this for the last 4 months or so at least. Talking about just what your asking. It. was one of my concerns in particular that the hardened structure would cut off the beach flow, that the beaches there are due by and large through the natural flow of the sand down to the beach. We had considered making this a major statement and starting a~whole new policy and what I did in between is I contacted Jay Tanskywho is the Coastal Erosion expert for Sea Grant and I talked to DECks Coastal Erosion people. We came up with this as a...and I'm gonna use the word "compromise" but in a very loose sense, in the sense that this bulkhead "would be put into the espartment" into a sudden drop, so that there'll be a natural...and beach grass is gonna be on top of it so that there'll be a natural beach grass flowing all the way down the bluff face and this structure will only become apparent in a major storm. TRUSTEE KRUPSKI: Hop~fully we'll have a few years for the beach grass to establish itself, but this one like the next one on our list they tried to re_vegetate but it didn't work. TRUSTEE HOLZAPFEL: They tried the soft approach a couple of times and we thought this might be a way to mitigate some of the problems and yet give the home owner protection of the. foot of the bluff. It's something that we're trying and both the home owners have been cooperative in developing this and DEC has been cooperative. DEC normall_v gives a permit for the hardened structure with rock revetment in front of it a~d they're willing to give away that rock revetment with soft covering' and try this as a step, MR. FITZGERALD: Would we discuss in some detail the design of the structure. However I would request that since it is "experimentaI" from the construction stand point in determining how well the burying is gonna Stand up under-the wind to ask that there be some flexibility in what turns out to be the maintenance of this structure.. TRUSTEE KRUPSKI: I think you raised a good point. And it brought something to mind that I just thought of. I think if we erect a couple of snow fences on the bluff face so that we don't get a tremendous amount of wind erosion, the winter time is a good time to plant the beach grass, and it will grow in the spring. It's survival is all conditioned about how much it speeds up in the winter. TRUSTEE GA~RELL: What's the angle of the siope there? TRUSTEE WENCZEL: It's pretty steep. TRUSTEE KRUPSKI: It's gonna be redefined. TRUSTEE GARRELL: But whe~ you get through, what will it be? TRUSTEE WENCZEL: One concern I have is that there is no revised plans here. ~R. FITZGERALD: If you want to make the sufficient revised plans a condition of the approval, that's fine by me. TRUSTEE WENCZEL: I would think .... it seems to me I understand what we talked about and I feel fairly comfortable with it but just seems we're putting the cart before the horse here without adequate plans. I'm not necessarily saying we have to hold off, but I don't really quite understand why... MR. FITZGERALD: I think we all understand as you do what you want to do and I'm confidant that I can put that on paper. ~nd I witl do so. TRUSTEE WENCZEL: It just seems appropriate to' have them before. Tonight we're ready to vote on this and we're having a public hearing but we don't have plans. TRUSTEE HOLZAPFEL: Do you want us to vote on what you're going to hand in? MR. FITZGERALD.: I would like you vote on those things that we've all discussed and agreed on and in the absence of any further comments from anybody else that may change it again I will make a drawing that will satisfy you, and if it doesn't satisfy you, ~11 you've got to do is say no, thatts not what we want, you've got to fix it. And one of my questions is, with the next one, there's a relatively wide beach at the point where we want to put this bulkhead, and that means that if this 6' high retaining wall is buried on the beach side with beach sand at its' natural angle of repose, it's gonna stick out a few feet. My question now is, what happens when we, the people of Southold Town want to do this in a place where the beach is only twelve.feet wide? TRUSTEEKRUPSKI: That's something I hadn't considered. In that case you might have to armor it with stone. Maybe this solution isn't gonna work. MR. FITZGERALD: JUst in passing, assuming that just because the angle of r~pose ak the beach end is 45 degrees, and that we're gonna put about as much in back as we put in front, it's gonna take about 600 c.y. of sand to bury that. TRUSTEE KRUPSKI: I thought you got that from the top, when you regrade, it. I thought it was sort of shaped like that and you have to cut the bluff to make it at that angle. MR. FITZGER~I~: Yes, but somehow or other, the space that has to be filled up with something, regardless of where it comes from is a lot. TR~STEEKRUPSKI: Any other comments? Motion to close the hearing? TRUSTEE GARRE~J,: So moved. TRUSTEE HOLZAPFEL: Second. ALL AYES TRUSTEE KRUPSKt: Motion on the project? TRUSTEE HOLZAPFEL: I'll make a motion that we approve project, and you have to bear with me because we're gonna have to ad-lib, and I'm looking for input as I go through this, that the 410' retaining wall will be placed in the cliff buried with sand and re-vegetated. The top of the bluff will be mounded to prevent any runoff from the edge of the property down the bluff and that the vegetated plan of the Suffolk County Soil and Conservation will be followed. Do we need filter cloth and all that? MR. FITZGERALD: Routinely filter cloth behind the bulkhead. TRUSTEE WENCZEL: The slope of the bluff is gonna be adjusted, MR. FITZGERALD: No, the slope of the whole bluff is not gonnabe adjusted, it's just gonna be adjusted at the top, because now it's going down relatively steeply and then falls off, 50 - 55 degrees. TRUSTEE WENCZEL: Do you have a figure on that? How you're gonna regrade the top of the bluff? TRUSTEE KRUPSKI: That should be in the SCSWC plans. MR. FITZGERALD: I don't think it is. We could, from the contour lines on the survey where the project is, we could do a typical cross section. TRUSTEE KRUPSKI: But you know what we mean, we want it graded up at the top. Second on that motion? TRUSTEE ALBERTSON: Second. ALL AYES 8:05 p.m. In the matter of En-Consultants on behalf of LOUIS a Coast~.Erosion &Wetland Permit to construct of armored ~er retaining wall plus (2) 12' angled returns completely filled with sand. Wall will be at toe of bluff. Approx. 200 c.y. of clean sand will be brought in via Duck Pond Road. Applicant attempted to stabilize the bluff hut failed. Unless the toe is stabilized, slope will continue to move. Following the installation of wall, slope will again be planted in accordance with plan of Suffolk County Soil & Water ConserVation. Located 1020 Glenn Road, Cutchogue. SCTM 983-2-10.4, 10.5 & 10.6 TRUSTEE KRUPSKI: Anyone here who would like to speak in favor or against this application? This is the exact same concept as the Stritzler file. They came in with a plan a number of years ago for this for a conventional bulkhead and we recommended they try the planting, and they did and it washed out. This property slopes away from the bluff and its a lot easier to manage than the Stritzler property which part of it slopes and wants to go dow~ towards the bluff. TRUSTEE WENCZEL: Do we have a detailed plan for this? TRUSTEE KRUPSKI: Actually we do on this. TRUSTRRWENCZEL: Do we want to take this and set it into the bluff? TRUSTEE KRUPSKI: We can approve it based on. a re-submission of. a Plan showing the bulkhead in the face of the bluff. Motion to close? TRUSTEE GARR~rI.: Motion to close. TRUSTEE HOLZAPFEL: Second. ALL AYES TRUSTEE KRUPSKI: I'll make a motion to approve this -application based on a a new plan submitted showing the retaining wall buried :inside t?:~ face of the bluff, showing a planting plan to stabilize the bluff and plans showing that the is not a~mored. TRUSTEE WENCZW. L: My opinion is this stuff can be worked out ahead of time and when we get to the point where we approve a pex~tr especially on a project of this magnitude, there's no reason not to have a complete accurate plan. TRUSTEE KRUPSKI: Yes, but the Board knows what the Board wants to approve. TRUSTEE WENCZEL: I'm aware, of that, but I think we should have accurate stuff. TRUSTEE HOLZAPFEL: Second. ALL AYES In the matter of Karen Oxholm on behalf of WILLIAM requests a Wetland Permit to construct a two-story dwelling. Plans include to retain as much vegetation as possible and foundation to be constructed on slope of land eliminating full height of basement construction. Located north side of Soundview Ave., 606' west of Horton Lane, Southold. SCTM $54-5-46.1 TRUSTEE KRUPSKI: Would anyone like to speak in favor or against this application? CAC recommends disapproval because it would not be Within 75' of the wetlands if the house was located on the property and if applicant builds a smaller house to fit the lot size. They have the 50' setback here. The Pond gets closer'. TRUSTEE HOLZAPFEL: The setback...going that way isn't going to make it any further away from the wetlands, going the other way increases it by 5 feet maybe. You're only talking about 5 feet anywhere. TRUSTEE KRUPSKI: They have some kind of setback here constrained here. We'd rather not push them any further back into the property because this is all undeveloped here and as a buffer here for the wetlands. There are already houses here. We'll put a limit on the clearing to the 15' contour. I think I'll take a motion to recess this. TRUSTEE ~OLZAPFEL: Second. CAC recommends disapproval the buLkhead and recoi~L~ends stabilizing' vegetatively following recommendations which can. be obtained from Soil Conservation. the Council suggest the applicant remove the bulkhead nort~ of the dock and plant spartina. The bulkhead south of the dock should not be re_moved or repaired but allowed to fail-naturally. MR. LOUCKA: It doesn't sccm to be doing, anything, it's there. TRUSTEE WENCZEL: It is a policy to not to let bulkheads with new bulkheads. There's not much left to this one. There's not much there at all. It's essentially not There. TRUSTEE KRUPSKI: If you look at it in a different way, I don't know if you could stop them from replacing what they have, second of all. if we allow it to fail, what happens is tb~ ground slopes off more, the grass gets fertilized more,- and the water runs more rapidly into the estuary. If you allow them to replace the bulkhead we could put in a condition of a 18-15 non-turf area which will stop anything running off directly into the creek. Any other comments? TRUSTEE WENCZEL: If we approve this thing, we should ask that any disturbed vegetation be restored. Motion to close the hearing? TRUSTEE ALBERTSON: So moved. TRUSTEE HOLZAPFEL: Second. Permit was extended to Feb. 23, 1994, but for reasons of: 1) owner's original decision not to have the contractor return to complete work (owner changed his mind after receiving complaints of boats striking the bottom in area of low tide) 2) contractors availability for such a small job and difficult access, & 3) ice conditions that prevented work being done in Jan. 1994 asscheduled by the contractor.
