IV. PUBLIC HEARINGS:
A motion was made by TRUSTEE ALBERTSON and seconded by TRUSTEE

hearings. ALL AYES.
THIS IS A PUBLIC HEARING IN.THE ~ATTEROF THE FOLLOWING
APPLICATIONS FOR PERMITS UNDER THE WETLANDS ORDINANCE OF THE
TOWN OF SOUTHOLD. I HAVE AN AFFIDAVIT OF PUBLICATION FROM THE
SUFFOLK TI~ES AND AN AFFIDAVIT OF PUBLICATION FROM THE LONG
ISLAND TRAVELER-WATCHMAN. PERTINENT CORRESPONDENCE MAY BE READ
PRIOR TO ASKING FOR COMMENTS FROM THE PUBLIC.
PLEASE KEEP YOUR COMMENTS ORGANIZW~ AND BRIEF:
FIVE (5) MINUTES OF LESS, IF POSSIBLE
7:20 P.M. - In the matter of the application of S~N
SPARACINO request a permit to construct a 4' X 70' timber
walkway elevated 4' above grade and a 5' X 20' fixed dock
structure. Located Willis Creek Drive, Mattituck.
TRUSTEE KRUPSKI: CAC approved.
TRUSTEE WENCZEL: I suggest we limit the size of the walkway to
3' and make sure the dock is as close to the bog as possible.
TRUSTEE KRUPSKI: Yes, we measured it. It is hugging it.
TRUSTEE WENCZEL: I just want to reinforce that.
TRUSTEE KRUPSKI: O.K. I'll entertain a motion to close the
hearing.
TRUSTEE HOLZAPFEL: So moved.
TRUSTEE ALBERTSON: Second. ALL AYES.
TRUSTEE WENCZEL: I make a motion that we grant this
application as it is worded except that the width and size be 3'
X 70'.
TRUSTEE KRUPSKI: To address what you said about your other
comment, .they have a nice cross section as to where that 5' X
20' fixed dock will be. I think that is where your want it.
TRUSTEE WENCZEL: Right.
TRUSTEE HOLZAPFEL: Second. ALL AYES.
7:27 P.M. - In the matter of En-Consultants on behalf of GEORGE
So CASE, JR. request a permit to construct a 198 1.f. of timber
retaining wall extending from landward end of return to south to
corner of retaining wall to north. Wall will run generally
along toe of bluff and approx. 50' landward of AHW.
Approx. 300 c.y. of clean sand will be brought in via ROW 400'
north off Nassau Point Road, Cutchogue.
TRUSTEE KRUPSKI: Do I have anyonehere to speak against this
application? Do I have anyone here to speak in favor of this
application?
ROY HAJE: For the applicant, Roy Haje, En-Consultants. You
have visited the property. 'I think you would recognize that
there has been significant erosion to that property. It is in a
stretch of Nassau Point which is largely bulkheaded. There
are bulkhead immediately north and south. The bulkhead which we
propose will be line with the one to the north and will be
Board of Trustees 4 February 24, 1994
considerably landward of the one to the south. It is well above
the high water line. It will only be touch when and if we have
another significant storm.
TRUSTEE KRUPSKI: What about that beach house?
ROY HAJE: He doesn't have a proposal for that, but he does want
to replace the stairs.
TRUSTEE WENCZEL: Is that going to be removed?
ROY HAJE: Sure.
TRUSTEE GARRELL: Is there any thought given to more protection
of the bluff itself? Any revegetation?
RQY HAJE: He will probably do that. We haven't put that in our
proposal to you. He does realize that it is in his best
interest to stabilize it.
TRUSTEE KRUPSKI: One more thing. I don't know if you are aware
of it, but we are working with the high way dept. now as far
as bonding contractors to do repairs at the end of Town roads.
There has been complaints about damage to Town roads and damage
to right-of-ways. This is a private row. In the future they
will have to go to the highway dept. and place a certain bond
and Ray Jacobs is the one to bond the right amount to improve
the ROW~ We would like a letter from the Property Owners
Association to use that road way for access since it is their
private property.
ROY HAJE: How are you working with it with the town as far as
timing goes? Do you hold it up until a person goes to highway?
CLERK DOHERTY: What is going to happen is that a form is going
to be included with the application and when you submit it ~to
us, we will submit it to Highway. Highway will get back to you.
They would have to approve the bond before we approve your
application.
TRUSTEE KRUPSKI~ The highway approves the bond. They have to
determine what amount of money it would be tc fix the road. For
this application we will not hold it up. We are going to vote on
it. We would need the letter before we issue the permit. They
have complain quite a bit down on Nassau Point, contractors
destroying the right of ways and then they just leave.
ROY HAJE: So the letter will say that we have no objection to
contractor X using right of way...
TRUSTEE KRUPSKI: Absolutely, because they can make an agreement
with them to repair it. They said they have had trouble with
some. When they press the contractor, the contractor did a fine
job repairing it. They are afraid if they press the wrong
contractor they will say forget it.
ROY HAJE: O.K. I will get that letter.
TRUSTEE KRUPSKI: Any other comments.
TRUSTEE G~/{RELL: Move to close the hearing.
TRUSTEE ALBERTSON: Second
ALL AYES
TRUSTEE GARRELL: Move to approve subject a letter from the
Association.
TRUSTEE HOLZAPFEL: Second.
ALL AYES.
NOTE: Mr. Haje added to application to remove beach house and
not rebuild as per Trustees request.
Board of Trustees 5 February 24, 1994
7:35 P.M. - In the matter of Eh-Consultants on behalf of RAYMOND
GOODWIN requests a permit to remove and replace an existing
concrete block wall and construct a 65' retaining wall and 34'
return on south side. W~ll will attach to and be in line with
railroad tie wall to north and will be above AHW. Backfill
with 150 c.y. of clean fill to be trucked in from upland
source. Construct a dock consisting of a 3' X 50' fixed
elevated walk, a 3' X i4' hinged ramp and 6' X 20' float secured
by (2) 2 pile dolphins. Board recommends dry wells, french
drains, planting plan, ~utters, and a non-turf area 10' behind
the wall. Located 2445 Pine Tree Lane, Cutchoque.
TRUSTEE KRUPSKI: Is there anyone here to speak against the
project? Is there anyone here who would like to speak in favor
the project? CAC Co~ents: Disapproval of the wall because
there is no evidence of erosion therefore no need is shown. The
council do~s recommend approval of the dock and catwalk.
ROY HAJE: There is now a very low homemade wall of concrete
blocks.
TRUSTEE KRUPSKI: We saw it before the snow.
ROY HAJE: O.K. What had happened was that during the storms it
went over that as if it was not there. There is now a low
entrance to the house and it went right in~ The new owner wants
to prevent the recurrence of that situation byputting in a more
substantial wall, blocking off that low entrance, filling around
there and.making his entrance on the other side where it is
considerably hire. While there wasn't a lot of erosion, there
was the flooding that really closed the problem. It is a two
fold approach to try to prevent that situation, There is an
existing wall i~mediately to the north and then on the south
side you have approved a sand berm for Gene Burger. He has
nothing over there. The portion of the dock is standard. It
will be about the same length as Gene's. The other part I think
is beyond your jurisdiction, that is a garage.
TRUSTEES KRUPSKI: Yes it is.
ROY HAJE: 'The recommendations that you made are acceptable to
him and I received a copy of a letter that he sent to you.., he
will incorporate that into his plans...
TRUSTEE KRUPSK~: The Planting plan, one of the really imPortant
components in this Would be re-vegetation of the beach in front
of there. The reason he has got a low area that is scouring his
beach is because it has be devegetated throughout the years. So
that is one of the key components of this application. The
Boards intent is to have that area revegetated And that in fact
will be your best protection from storm damage. Grantedthe
flooding part, raise the elevation...as far as holding his beach
in, if you do get a big storm like that and it hits that wall it
is just going to whip the beach right out into the creek.
ROY HAJE: So you want the planting plan in front of the wall?
TRUSTEE KRUPSKI: In front of the wall, that is right.
ROY HAJE: We had interpreted to be behind the wall.
TRUSTEE KRUPSKI: No, we want it in front. The beach, by the
previous owner has been de-vegetated. We want it in front of
the wall.
Board of Trustees 6 February 24, 1994
ROY HAJE: Then we misunderstood your letter. We thought you
wanted 10' in back of the wall.
TRUSTEE KRUPSKI: We want a standard non-turf area. 10' is the
minimum we would prescribe up to whatever our jurisdiction will
be.
ROY HAJE: Do you want plantings in that area (behind wall)?
TRUSTEE KRUPSKI: It can be sand, gravel whatever. It doesn't
have to be plantings.
TRUSTEE HOLZAPFEL: As long as there is no turf in that area.
That you don't have a lawn up to that wall.
TRUSTEE KRUPSKI: We would like to see a one foot pattern along
the property.
ROY HAJE: ~here is patents there now. My sketch shows were it
is to the south of the pier. To the north is where you have
virtually nothing.
TRUSTEE KRUPSKI: That's right. We would like to see that area
re-vegetated.
TRUSTEE WENCZEL: Do we want to consider reducing the size of
the catwalk?
TRUSTEE KRUPSKI: Let's finish with this. Is there a problem with
the re-vegetation?
ROY HAJE: I'll say no.
TRUSTEE KRUPSKI: That is a key component to it. We will spell
it out to be spartina patents, spartina altorna flora.
Spartina altorna flora to the tidal zone and spartina
patents up to the wall on 1' centers. I imagine that material
is available commercially.
ROY HAJE: It is. O.K.
TRUSTEE KRUPSKI: Peter you had a question.
TRUSTEE WENCZEL: Reduce to a 3' wide catwalk
TRUSTEE KRUPSKI: I believe we already requested it. This is
standard for all creeks.
ROY HAJE: It seems to come up in a cycle. We have discussed
this in years past and then abandon it and then comes up. 4' is
really a standard with that seems to have been accepted by
everybody until this. I always question why because when you
get narrow, 3' is narrow, what benefit are your reaping from
that. The shading issue I question the validity of that to
because you are up so high and so forth. I am afraid when you
get to 3' width you are verging on safety problems. You don't
want to make these things to narrow so people aren't paying
strict attention. They have the possibility of falling off. I
don't know how often that would happen, but it is certainly a
possibility. The narrower you go the more likely that is going
to occur. I think that the 4' width has always been approvable
by the DEC, by the Corp., the Dept. of State and soforth. I
really think it is a reasonable width and when you go below
that, I think you are getting to narrow and I don't see any
benefit to it.
TRUSTEE KRUPSKI: Basically it is the Board's desire to reduce
the size of the structures in the creeks. As far as the length
goes, it is pretty standard for that area. The Board feels if
we can reduce any kind of impact it is better in the long run.
Board of Trustees 7 February 24, 1994
TRUSTEE GARRELL: If you are dealing with people that genuinely
need the access. We had somebody in a couple of meetings ago
they wanted to be able to carry in a larger sailboat. We talked
about it and approved the 4' If somebody needed wheel chair
access or if you had somebody was handicapped and they really
needed 4',5' or whatever we would have no trouble with it. I
guess it is just that the policy now is that the preference is
3' If you really need one or if you can say why you got no
trouble having it.
ROY HAJE: I can't say that there are those situations here, but
again i would turn the question to you what 3'? Is there a
benefit to be gained. Are we going to go to 2, a balance beam...
TRUSTEE WENCZEL~ I don't think so.
TRUSTEE KRUPSKI: At our last field inspections we did look at
smaller width catwalks. Particularly a 2 1/2' wide one and we
thought it was a little narrow. It was a Grandfather permit
that is why we got to see it.
TRUSTEE WENCZEL: I will just make one last co.~,ent on this.
It is the feeling of this board and the feeling of many people
in this Town that to a certain extent a lot of the structures in
our creeks are over built. That they are taking up more of the
Trustee land that is necessary. We have struggled to try and
find a way to address this. We feel that a one foot reduction
is not significant in the use. The ability of the individual to
use the catwalk. After all it is a catwalk. By definition a
catwalk is meant to be a narrow walkway. 3' we just felt is
adequate.
JAMES FITZGERALD: May I say something on the general subject?
One of the things that ought to be kept in mind is that the
person with a disability or the sailboat or whatever may not yet
own the property that has the 3' catwalk on it. It would seem
that once a 3' catwalk is in, it is in. That means that if a
owner comes along to whom you might have granted a 4' catwalk,
he is going to be out of luck. Either that ar the structure will
have to be rebuilt.
TRUSTEE KRUPSKI: I think it there is a need we listen to it and
it is a matter of monopolizing ToWn bottom. Any other co~,ents?
A motion to close the hearing.
TRUSTEE GARRELL: Move to close the hearing.
TRUSTEE WENCZEL: Second. ALL AYES.
TRUSTEE WENCZEL: I think we should request on the approval
that they slLbmit a plan with all the changes on it. (planting
plan...) So~ we can have a proper record.
TRUSTEE KRUPSKI: I will entertain a motion for a 55' retaining
wall with a 34' return on south side. Backfill 150 c.y. of
clean fill, a non-turf area 10' landward of the retaining wall,
planting plan - i' on centers, spartina, altorna flora
within the tidal area and spartina patents between average
high water and the wall itself on 1' centers, ~utters and
drywells on the residence and the dock to be 3' X 50' elevated
walkway, 3' X 14' hinged ramp and a 6' X 20' float with two
2-pile dolphins. I need a motion on that.
TRUSTEE HOLZAPFEL: So moved. ~
TRUSTEE ALBERTSON: Second. ALL AYES.
Board of Trustees ~ February 24, 1994
TRUSTEE KRUPSKI: 7:55 tn the matter of John Geideman on behalf
of VICTOR E. RERISI requests a permit to construct a
one-family dwelling. Located Snug Harbor Road at Marine Place
on Gull Pond, East Marion.
Do I have anyone here against this application? Do I have
anyone here who would like to speak in favor of this
application? Do I have any CAC comments?
CAC recommends approvals with provisions .... on the south side
where there is no bulkhead the applicant plant a natural
vegetated buffer to direct the water away from the creek. There
also should be a ten to fifteen foot buffer between the lawn and
the bulkhead either natural vegetation or gravel. I am
p~esuming that the water from the property now runs into the
creek in that corner.
BRUCE LOUCKA: South corner.
TRUSTEE KRUPSKI: So you are requesting regrading to direct the
water from the creek. The vegetated buffer is vegetated? I am
not sure what sure your looking for. To me it seems you already
vegetated.
BRUCE LOUCKA: They can't regrade it because that part has no
bulkhead there.
TRUSTEE HOLZAPFEL: It just drops. It is almost a ramp.
TRUSTEE KRUPSKI: I know. I am just trying to figure out the
C~C was looking for there.
BRUCE LOUCKA: We did not want any runoff. Once they build a
house and put a lawn in everything is going to run that way.
TRUSTEE HOLEAPFEL: Can I suggest a 20' natural buffer along the
whole width.
BRUCE LOUCKA: We would go with something like that.
TRUSTEE KRUPSKI: It has to be something that they can maintain
so it doesn't grow up and.block there view. You have to do it
practically so that it dan be done and it is not going to be a
hassle to them to always keep it maintained the way we want it
to be maintained.
TRUSTEE WENCZEL: I think we have to ask them to submit a plan
to mitigate runoff in that area. It is not our job to do a plan
for them.
TRUSTEE KRUPSKI: Table application and get a landscape plan
showing a non-turf area seaward of the 6~ contour as shown on
survey of OCtober 12, i993. Drywells, gutters and Haybales.
Help can be found at the Soil Conservation office.
TRUSTEE WENCZEL: So moved.
TRUSTEE ALBERTSON: Second. ALL AYES.
TRUSTEE WENCZEL: Move to close the hearing.
TRUSTEE ALBERTSON: Second. ALL AYES.
TRUSTEE KRUPSKI: 8:0'9 In the matter of LOUIS FORMIC request a
permit to construct a single family dwelling with well and
septic system and a 3' X 60' walkway. Distributed soil will be
used on site. Located Westphalia. Would anyone like to speak
against this application? Would anyone like to speak in favor
of this application?
Board of Trustees 9 February 24, 1994
LOUIS FORMICA: Just a minor correction, we are reducing the 3' X
60' walkway to a 3' X 40' stairway and submitted a plan on
2/15/94 to your office for that.
TRUSTEE WENCZEL: Did he submit a plan showing a 25' buffer?
TRUSTEE KRUPSKI: You can trim by hand for a view is acceptable,
put keep it there for erosion purposes.
LOUIS FORMICA: Thank you.
TRUSTEE KRUPSKI: Do I have a motion to close the hearing?
TRUSTEE ALBERTSON: So moved.
TRUSTEE HOLZAPFEL: Second. ALL AYES.
TRUSTEE WENCZEL: I make a motion that we approve this subject
to the submission of a accurate plan showing the 25' buffer.
(Mr. Formica wrote buffer on plan and initialed.)
TRUSTEE HOLZAPFEL: Second. ALL AYES.
TRUSTEE KRUPSKI: 8:12 In the matter of James Righter on behalf
of KIM CAMPBELL requests a permit to reconstruct a wood frame
quest cottage with addition on landward 15' from pre-existing
location. Old foundation will be removed, regraded and
reseeded. Eaybales and silt fence will be used during
constructionl A buffer area will be planted 10' at interface of
wetland and lawn as non-tUrf area. All subject to receipt of
revised plans. Located East Harbor, Fishers Island.
Do I have anyone who would like to speak against this
application? Do I have anyone here who would like to speak in
favor of this application.
GLENN JUST: Hi I just want to repeat what was discussed at last
Thursdays meeting before inspections. We are more than happy to
do. We are working on the drawing now as far as moving the
house back ten feet, regrade it, reseed it ar~ then down the
bottom of it we will plant a 10' strip with Rosa Regosa or some
salt tolerant species that will hold the soil and not grow to
high.
TRUSTEE KRUPSKI: (read part of letter from Stephen Ham)
...relocate the guest cottage and addition to a site
approximately 15' west of where they are currently proposed.
They are also willing to abandon a ten foot wide portion of the
lawn in the vicinity of the cottage where the la~n interfaces
with the high marsh and to plant Rosa Rugosa or another
salt-tolerant, s~iI retaining plant in its place.
We would appreciate your granting approval of the project as so
revised at tonight's hearing subject to our providing to you
revised plans showing the foregoing changes a~d reflecting' the
removal of the remnants of the existing foundation and the
~e-grading and re-seeding of the foundation area... They gave us
all that we asked for. They ask that we give them a conditional
permit based on receipt of those materials. Any other co~,~ents.
Board to close the public hearing.
TRUSTEE ALBERTSON: So moved.
TRUSTEE GARRELL: Second. ALL AYES.
TRUSTEE GARRELL: Move to apprQve subject to receipt of revised
plans.
TRUSTEE HOLZAPFEL: Second. ALL AYES.
Board of Trustees 10 February 24, 1994
TRUSTEE KRUPSKI: 8:18 In the matter of Proper-T Services on
behalf of ROBERT H. HALL request a permit to construct 100 1.f.
of replacement bulkhead no more tb~n 18" in front of existing
bulkhead, fill behind existing bulkhead and/or new bulkhead, as
necessary with not more than 100 c.y. of clean material from
upland source. Located 75 Harbor Lights Drive, Southold.
Is there anyone here who would like to speak on behalf of this
application.
JAMES FITZGERALD: The concern with the accuracy of the survey,
we have not had an opportunity to have a new survey made
accurately showing the new return.
TRUSTEE WENCZEL: I don't think we have to have a licensed
survey. We just an accurate sketch. You can take this survey
that is submitted here and correct it. We are not here to incur
out an expense to the landowner. We just want accurate records.
Mr. Fitzgerald corrected the the survey and initialed same.
TRUSTEE KRUPSKI: Do I have anyone who would like to speak
against this application? Do I have any further comment from
the Board?
I will entertain a motion to close the hearing.
TRUSTEE ALBERTSON: So moved.
TRUSTEE HOLZAPFEL: Second. ALL AYES.
TRUSTEE GARRELL: Move to accept the application according to
revised sketch.
TRUSTEE ALBERTSON: Second ALL AYES.
