Dear Mr. Uhl:
The Southold Town Board of Trustees reviewed the site plan prepared by John Metzger
last dated August 5, 2005 and determined the proposed building envelopes of the five
(5) lots to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland
Code and Chapter 37 of the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, or within 25' landward from the top of the bluff, without
further authorization from the South old Town Board of Trustees pursuant to Chapter 97
and/or Chapter 37 of the Town Code. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetiandsjurisdiction and
----coastal Erosion Hazard Area;-which may result from-your projecCSuch precautions
may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay bale berm.

However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion
Hazard Area would require permits from this office.
This determination is not a determination from any other agency.

Flower Hill Building Corp. hereby requests a letter of Non-Jurisdiction for the 27 (#'
acre property bounded by Ackerly Pond Road, Main Road (Rte 25) and Blossom Lane in . 0
the Town of South old (Southold Tax Map # 473889 69.-3-10.1). \
Flower Hill Building Corp. is the owner of the property described above. A
Conservation Subdivision has been proposed for the site with 80% open space and 60%
less density.
Development Rights for the 23.9 acre parcel (Lot 1) will be sold to the TQWIUlL
