AMENDMENTS/WAIVERS/C~6ES~ 1. 5L~TTITUCK PARK DISTRICT-.BREAKWATERBEACH~requests a permit to place sand from west end of parking area over top of cement that was placed on east end of parking area. Parking area was damaged during Winter storms. Board to waive fees for this nonprofit organization. Located Luthers Road, Mattituck. TRUSTEE SMITH moved to approve, TRUSTEE ALBERTSON seconded. ALL AYES 2. MARIE SHACK>requests a waiver to construct a 14' X 32' deck attached to existing dwelling not to extend beyond width of house. Located Shore Drive, Greenport. TRUSTEE ALBERTSON moved to approve, TRUSTEE TUTHILL seconded. ALL AYES 3.. WUNI4~WETA POND ASSOCIATION requests an extension on their permit to dredge to run with DEC permit, June 1997. TRUSTEE SMITH moved to approve, TRUSTEE TUTHILL seconded. ALL AYES 4. EUGENE PERINO requests an extension to permit %3864 to expire September 1994 for stairs and two landings. This would be the last extension. Applicant is still waiting for DEC permit. Located Trumans Path, East Marion. TRUSTEE SMITH moved to approve and to start work as soon as possible, TRUSTEE ALBERTSON seconded. ALL AYES 5. DR. CAMPBELL requests an amendment to permit ~71-2-6 to add a 4' X 10' float against the bulkhead to act as a barrier between boat and bulkhead. Located 215 Harbor Lights Drive, Southold. TRUSTEE SMITH moved to approve with stipulation not to exceed 1/3 across the canal, TRUSTEE ALBERTSON seconded. ALL AYES 6. FERUCIO FRANKOLA requests an amendment to permit %57 to include the existing ramp and 140' bulkhead to existing 212' bulkhead as area needs to be repaired. Located 1900 Glenn Road, SouthoId. PLEASE KEEP YOUR COM~T~S ORGANIZED AND BRIEF: FIVE (5) MINUTES OR LESS~ IF POSSIBLE 7:15 p.m. - In the matter of Eh-Consultants Inc., on behalf of EUGENE BURGER to construct a timber dock consisting of a 4' X 40~ f~xed eievated (min. 4' above grade of marsh) pier (plus steps), a 3' X 16' hinged ramp, a 6' X i6' float secured BY (2) pilings. Place approxo 10 c.y. of sand and grade into a berm approx. 3' wide at the base and 1.5 high to extend the width of the parcel (68' +/-) above AHW and wetlands. Following grading berm will be planted with ~tm~ophilia breviligulata on 18" centers. Located 2515 Pine Tree Road, Cutchogue~ TRUSTEE KRUPSKI: Do I have any comments from anyone? In favor? Do I have any co~m~nts against this application? LAUREN GRANT: I represent the Nassau Farms Association~ It seems the property is adjacent to the Right of Way, which it seems the boats come in and out of the water. It's also at a very narrow part'of that creek where the channel comes in from the Peconic Bay to the Creek. They are very concerned with navigation of boats and all boats moored in that area. We think this will be hazamdous to people boating. TRUSTEE KRUPSKI: Are there any other comments? We have on file a rough sketch here~ I believe John and Bill inspected this° It was last months inspection. Here's the Right of Way~ and here to the east is the Burger house and cottage. The proposed be~m would be just ~hove mean high water and the float and ramp, 40' fixed float, 16' ramp, 56 and a 16' pier, which would be 72' out. It's low water, so its about half that distance out from low water. I was there yesterday. (The follow is spoken by people who live in the Association). JACK GRANT: But is there enough water to get by. If you come down here and put a boat out is there enough room to go out beyond here. My further question is there's a spit of land here that's like a mushroom and is visible at low water. More of the point Al, within the last six weeks I was out there at low tide right off the ROW in a row boat. Now if Gene puts his pier, let's say to the south of the center line of his property it's going to infringe on navigation to the people with small boats going out this way. Because you can't go out this way (pointing to map) because of the mud flat, you have to go this way. So there's a problem of the location of the pier in regard to the use of the right of way. And a more appropriate location would be to the center of the property or the north center of his property. TRUSTEE KRUPSKI: Bear in mind this will only stick out about 30 or 35' from mean low water. So it won't stick out that far. Now do we have any information from the neighbor to the north? ENID ROTHLEDER: Furst is the name. TRUSTEE~KRUPSKI: Do they have a dock? ENID ROTHLEDER: No, the house is up for sale. They did have a mooring out in front if it though. TRUSTEE KRUPSKI: Now our general rule of thumb is that we make an applicant, unless physically impossible, keep a structure 15' off his property line. We can recommend that, that he keep a 15' off from the northern property line. We can't put anything in that'would restrict or make a hazard to navigation. Let's read the concerns of the CAC. (Trustee Krupski read from the comments of the CAC as stated in Burger file). MR. GRANT: I don't know if there's any col~L~ent among us but I'm not opposed to the berm, my main concern is the location of the dock. TRUSTEE KRUPSKI: We understand that. MR. GRANT: And I think obviously the berm is apart from the dock structure because of the storm is the problem. TRUSTEE KRUPSKI: But with the dock he just wants to access the water. And its rare that we would deny someone normal access. I think we're gonna entertain a motion to table this and go down and reinspect it. TRUSTEE SMITH: I make a motion we close the hearing and we'll go and reinspect this. TRUSTEE TUTHILL: Second. ALL AYES 7:30 p.m. - In the matter of MATTHEW MC KIERNAN requests permit to construct a 1 1/2 story residence. Ail materials will be redistributed on property to establish proper grade. Construct a 4' X 50' catwalk 3' over marshland and install post to secure small boat, as per survey dated June 18, 1993. Located ROW off Indian Neck Lane, Peconic. TRUSTEE KRUPSKI: Are there any co~Lu~ents in favor of the application? Are there any comments against the application? The CAC says "the approval of the dock provided it does not hinder navigation". I think that dock is gonna barely reach the water. It's really at the end of that creek. I just want to make sure this is properly graded. This is the final plan. BRUCE LOUCKA: We thought where he was gonna put it, it was very narrow. There's somebody on the other side. TRUSTEE KRUPSKI: There's a proposed house to the north and a new house next to that property. Do I have any more c~m~,ents? If not can I have a motion to close the hearing? ALL AYES 7:33 p.m. - In the matter of ONNIKIARSLANYAN~requests permit to replace storm damaged concrete seawall with 98 1.f. of navy style timber bulkhead and a 45 1.f. return along the western property line, as shown in plans stamped NYSDEC approved April 21, 1993. Located'Route 48, Greenport. TRUSTEE KRUPSKI: Do I have any comments in favor of the application? Do I have any comments against the application? Is the Board interested in any comments? BRUCE LOUCKA: We OK'd it. TRUSTEE SMITH: I make a motion we close the public hearing. TRUSTEE ALBERTSON: Second. ALL AYES TRUSTEE SMITH: I make a motion we approve the application and the CEHA. TRUSTEE ALBERTSON: Second. ALL AYES 7:35 p.m. - In the matter of En-Consultants on behalf of CLEAVES POINT VILLAGE to modify an existing dock consisting of a fixed pier, hinged ramp, floating docks; floating wave curtain. Proposed dock will retain existing 9'6" fixed inner section; and will extend existing 6' X 90'6" fixed pier to 6' X 235' with an outer "L" of 6' X 32'. The overall length of the proposed fixed pier is equal to the length of the present fixed pier, ramp, float and floating wave curtain. A tongue and groove wave curtain will be attached to center of fixed pier. A new 6' X 8' fixed platform will be added to west side of fixed pier and the existing 3' X 14' ramp and (6) 6' X 20' floating docks placed on west side of fixed pier and secured by additional pilings. (11) pilings will be~placed at various distances west of fixed pier; (5) pilings will be placed 20' east of fixed pier to create slips. Additional pilings will of course be needed for fixed pier and floats. Located Cleaves Points Village, East Marion. TRUSTEE KRUPSKI Do I have any co~ents in favor or against? CAC reco~nds approval. (Trustee Krupski read from a letter written by Mark Solomon, President, Cleaves Point Village. SUE HALLOCK: Permit shows two piers together, however our application involves just one of the pier. Both piers were built and were damaged in storms. We're just applying for some modifications to easterly dock which is to protect. We don't really intend to have any long term dockage. Repair in place 73 1.f. of easterly return. Approx. 100 c.y. of clean fill will be trucked in from upland source. Construct a 4' X 4' platform, 4' wide steps from proposed retaining wall to beach. Land Use on behalf of ROBERT ALCUS requests a permit to construct a 4' X 30' timber dock elevated a minimum of 4' over grade with a 3' X 10" ramp and a 6' X 20' float for the private dockage of a recreational vessel. LocatedCedar Point Drive East, Southold. TRUSTEE SMiTH moved for a Negative Declaration, TRUSTEE TUTHILL seconded. ALL AYES 6. En-Consultants on behalf of ROBERT TAYLORto construct a 58' retaining wall no more than 2' in front of existing retaining wall, with a 30' return on the east property line. Wall will be back filled with 350 c.y. of clean backfill to be trucked in from upland source and delivered over owner's property.
