addition to their home which will be in line with existing
deck. Located West Mill Creek Drive, Southold.

2. Land Use on behalf of ROBERT GALLAGHER requests waiver to

north side of house and 4' X 8' on one side and 4' X 4' on other
side of porch on south side of house. All work will be

4. J.M.O. Consulting on behalf of ROBERT So SEARLE requests a
waiver to the application requirement under Chapter 97-21(G) of
the Town Code which requires that one foot contours be depicted
on surveys. Applicant is seeking Board approval to allow for

5. ALVAH B. GOLDSMITH JR. requests a waiver for a temporary

X 14' wide and Will extend from bank to just beyond tide line
and will be removable. Located Main Road, SOuthold next to Mill
Creek Inn Restaurant.

6. JIM MC MAHON requests a waiver for Pipes Neck Road
Drainage Project to install a catch basin, leaching basin and
290' of corrugated pipe to correct a road flooding problem.

8. LAWRENCE MARKS requests an amendment to Permit ~2074 to turn
float (12' X 6') around so that its long axis will be in line

9. JOHN BURNS requests an amendment to Permit ~4152 to change
ramp from 3' X 15' to 3' X 20'° Located 755 Lighthouse Lane,

10. THOMAS ZUKAS requests a waiver to clear a 6' wide across
path so dock can be moved. Dock must be placed along land
within 90 days of the meeting or all permits will be revoked.

7:40 p.m. C&S Engineers, Inc., on behalf of ELIZABET~ FIELD
AIRPORT for the Town of Southold requests a permit for the
runway overlay project as described in file. Located Fishers
Island.
TRUSTEE BREDEF~q~ER: This is a project by C&S Engineers on
behalf of the Town of Southold for overlay of the runway to
provide improvements, it will bring the airfield to current
FAA standards, both as far as surfacing and lighting. Is
there anyone here who wishes to speak on behalf of this
application? Anyone here who wishes to speak against this
application? The Trustees have concluded the environmental
review in this process, in coordinating with approx. 13 other
involved agencies. We only received concerns that were
relatively minor related to identification that concrete

structure in the vicinity of airport was not of historical
value which it was found not to be. They were al derelict
structures of no historical use. Such that we have completed
the environmental review coordinating amongst both federal and
state agencies. The Town Conservation Advisory Council
representative Bruce Loucka and myself have inspected the site
on coming in and out of the airfield on Feb. 15. The proposal
includes a Coastal Erosion Permit Application for the Trustees
for a rip rap revetement structure and tidal wetlands permit
because the structure falls just within 75' of Wetlands. Anyone
here who wishes to speak on behalf of this application?

7:43 P.M. - J.M.O. Consultants, Inc., on behalf of CAROL
CASSEL requests permit to construct a single family dwelling,
associated sanitary system, gravel driveway, decking and 750
c.y. Of clean sand trucked in for grading and sanitary system.
A permanent natural buffer zone shall also be maintained all in
accordance with enclosed plans. Located Willow Point Road,
Southold.
TRUSTEE BREDEMEYER: We have some CAC co~nts.
BRUCE LOUCKA: We approved with some stipulation.
TRUSTEE BREDEMEYER: I'll read the CAC con,~,ents. Provided the
house is moved landward 10' to allow a larger buffer zone. This
application has gone through several changes. The proposed
building envelope you want moved landward by 10". This had DEC
approval in the late 80's. Is there anyone here who wishes to
speak on behalf of this application?
MS. CASSEL: May I ask why you want this moved landward?
TRUSTEE BREDEMEYER: The CAC provides an advisory opinion and
reflects a field inspection~that they did.
TRUSTEE SMITH: Well the building envelope is behind the
existing house that's there already.
MS. CASSEL: It's quite a bit behind.
TRUSTEE SMITH: You had a permit once before that was expired?
MS. CASSEL: Right, we went for an extension.
TRUSTEE KRUPSKI: What is to the east?
MS. CASSEL: A road. A paved Town Road. Willow Point.
TRUSTEE BREDEMEYER: I think John or myself went there on field
inspection. It's fairly ample.
TRUSTEE KRUPSKI: What's the vegetation there?
TRUSTEE BREDEMEYER: Vegetation is mixed high tide bush. It's
Southold Bay frontage.
MR. LOUCKA: That right of way, it backs up to a right of way?
TRUSTEE KRUPSKI: Yes.

~R. LOUCKA: What is the right of way?
MS. CASSEL: The right of way is for us in order to come into
our home. However it does not belong to us.
TRUSTEE SMITH: It belongs to Willow Point Association.
MS. CASSEL: We have dearly tried to purchase it.
TRUSTEE BREDES~EYER: Any further discussion pro or against?

7:45 P.M. - En-Consultants~ Inc., on behalf of PAUL RACANO
requests permit to construct a timber dock consisting of a 4' X
72' fixed elevated (4' ~hove grade marsh) walk, a 3' X 16'
hinged ramp, a 6' X 10' float with a 6' X 30' outer float
arranged in a "T" configuration. A 4' wide X 60+/-' path will
be cut through brush on slope leading to dock and surfaced with
wood chips. Located 1265 Calves Neck Road, Southold.
TRUSTEE BREDEMEYER: The CAC has no objection to this
application. How do the Trustees feel?
TRUSTEE SMITH: It's got to go out about 90'. There'~ nc water
under it.
TRUSTEE BREDEMEYER: I'll take a motion to close the hearing in

7:47 P.M. - Eh-Consultants, Inc., on behalf of KENNET~
RAT~GEBER requests permit to construct approx. 160 1.f. of
tiz~er retaining wall plus (2) 15' returns. Wall will be
approx. 8' back of face of 'existing bulkhead which will
remain. Backfillwith 300+/- c.y. of clean fill which will be
trucked in from upland and delivered over bank which was eroded
by waves which overtopped bulkhead during 12/11/92 storm.
Located Nassau Point Road, Cutchogue.
TRUSTEE BREDE~EYER: Is there anyone here who wishes to speak on
behalf of this application?
FS~o SAMUELS: Mr. Haje is on vacation, and I'll be happy to
answer any questions you might have.
TRUSTEE SMIT~: How high is this structure gonna be behind the
bulkhead?
MR. SAMUELS: Four feet above the grade of the backfill. Which
will give them top elevation of the secondary retaining wall
above the flood plain elevation.
TRUSTEE KRUPSKI: So its gonna actually slope back toward the
house.
TRUSTEE BR~EMEYER: CAC had no problem with it.

TRUSTEE KRUPSKI: Are they gonna armor between the two
bulkheads, because it seems if it overtops it will scoop that
out pretty quickly.
MR. SAMUELS: That's proposed and will probably be done in the
future. Its a question of cost right now, they took a huge hit
and lost a lot of fill.
TRUSTEE BREDEMEYER: Is there anyone here who wishes to speak

7:50 p.m. - J.H. Geideman on behalf of ANGELA RADOVIC
requests permit to construct 134' of timber bulkhead with 10'
returns at property lines to prevent erosion of existing earth
bank at foot of lawn. Located 2060 Clearview Ave., at
Oaklawn Ave. Southold.
TRUSTEE BRE~EMEYER: We do not have anything from CAC. We
have comments from 1992. CAC recoKgdends disapproval because
the project is not needed and wetlands will be destroyed, also
there is a violation of state and town codes. Applicant has
mowed the lawn to waters edge.
TRUSTEE SMITH: I feel they show no need to construct this.
TRUSTEE BREDEMEYER: This is the one when we went there again
they had pulled the structure landward and wasn't like initially
applied. It looked like a bulkhead but it had been landward so
there was a retaining wall.
TRUSTEE KRUPSKI: I agree with Henry, there is really no need
fOr this.
TRUSTEE BREDEMEYER: anyone where who wishes to speak against
this application?
TRUSTEE SMITH: I make a motion we close this hearing.

7:52 p.m. - LAURENCE & DIANE NIEBLING requests permit to
const~ruct a 3 1/1' high bulkhead at the toe of the ba~_k in a
straight line as per amended drawing dated6/3/93. Land
disturbed during construction will be reclaimed with the
planting of native vegetation such as sea grass, rosa rugosa
or shore juniper. Located 10020 Nassau Point Road, Cutchogue.
TRUSTEE BREDE~EYER: ~e CAC gave us comments on the initial
application which has since been amended. 'CAC rec~m~ends
disapproval of the bulkhead because no needis shown. Thehouse
and bluff are not endangered, the bluff is following the natural
process. Council suggests the gazebo be located in a more
landward site or on pilings.
TRUSTEE KRUPSKI: They lost a considerably amount there.

ASSESSMENTS/ENVIRONMENTALDECLARATIONS:
1. En-Consultants, Inc., on behalf of EUGENE BURGER to
construct a timber dock consisting of a 4' X 40' fixed elevated
(min. 4' above grade of marsh) pier (plus steps), a 3' X 16'
hinged ramp, a 6' X 16' float secured by (2) pilings. Place
approx. 10 c.¥. of sand and grade into a berm approx. 3'
wide at the base and 1.5' high to extend the width of the parcel
(68+/-), above AHW and wetlands. Following grading berm will
be planted with Ammophilia brevilig~lata on 18" centers.
Purpose of berm is to prevent occasional flooding of upland as
secured during 12/92 & 3/93. Located 2515 Pine Tree Road,
Cutchogue.
TRUSTEE KRUPSKI moved to give a Negative Declaration, TRUSTEE

2. En-Consultants, Inc., on behalf of ANT~O~ SCARMATO to
replace (within 48") 124 1.f. of timber retaining wall. Repair
inkind/inptace 73 1.f. of easterly return. Approx. 100
c.y. of clean fill will be trucked in from upland source.
Construct a 4' X 4' platform, 4' wide steps from proposed
retair~ng wall to beach. Distance between new and old retaining
walls is necessitated by presence of improvements such as fish
pond located close behind existing wail which will not allow tie
back system to extend very far landward. To compensate, new
wall will be 4' out so a 10' tie road and deadman system can be
utilized to afford adequate lateral stability. Located 235
Huckleberry Hill Road, East Marion.
TRUSTEE SMITH moved to table this application until the whole

3. ~ATTHEW MC KIERNAN requests permit to construct a 1 1/2
story residence. All material will be re-distributed on
property to establish proper grade. Construct a 4' X 50'
catwalk 3' over marsh land and install post to secure small
boat, as per survey dated November 17, 1982.

storm damaged concrete seawall with 98 1..f. of navy style timber
bulkhead and a 45 1.f. return along the western property line,
as shown in plans stamped NYSDEC approval April 21, 1993.
Located Route 48, Greenport next to Soundview Restaurant.

permit to construct a one-family dwelling and decks, sanitary
system, bluestone (or similar pervious driveway). Approx. 700
c.y. of fill will be trucked in to raise grades to those shown.
