WORKSESSION
6:00 p.m. INTERNSHIP PROGRAM: Bruce Anderson recommended
through Suffolk Community College, Diane Mc Connell as a
possible candidate to help out in Trustee Office. Bruce will
submit a written proposal on this soon.
6:15 p.m. APPLICATION OF SERLE & PETRILLI & BEACHWOOD
ACRES: Trustees will refer these to Bruce Anderson for review
for completeness.
6:30 p.m. GUS WADE: Bruce Anderson reviewed this application
and rejected 2 versions of impact statement. On the 3rd he
suggested a bulkhead or barrier, to move equipment in by barge
in under high tide, and he deemed impact statement complete,
have a Public Hearing and get written comments from police, fire
department, etc., then do a FDIS. Jay will do a resolution.
6:45 p.m. LEAD AGENCY - BRICK COVE MARINA: Jay read from
Section 617.6 of SEQRA Code to Mr. Flynn. Mr. Flynn spoke
as did Mr. Anderson.
6:50 p.m. AIDES TO NAVIGATION - HALLOCKS BAY: A vote to
mark new channel was made. Mr. Richard Latham spoke.

I. MONTHLY REPORT: Trustees monthly report for MARCH 1993 and
APRIL 1993: A check for $11,829.32 and $7,704.48 respectively
was forwarded to the Supervisor's Office for the General Fund.
II. PUBLIC NOTICES:
Public notices are posted on the Town Clerk's Bulletin Board
for review.
III. AMENDMENTS/WAIVERS/CHANGES:
1. ARLENE & PATRICK CALLAHAN request an amendment to Permit
~3842 to add 10' X 16' deck attached to house approx. 54' from
MHW. Located 3900 Deep Hole Drive, Mattituck.
TRUSTEE BREDEMEYERmoved tO approve a waiver for the deck, but
to hold off for the dock for a Public Hearing next month.

2o FRANK L. ROESSLE requests an amendment to Permit ~1900 to
place a piling instead of the ramp & float that was damaged in
December storm. Located 720 Oak Streetr Cutchoque.
TRUSTEE BRED~EYER moved to approve the amendment, subject to
$40 fee, 'TRUSTEE ALBERTSON seconded. ALL AYES.
3. Edward Z. Wronsky on behalf of JAMES E. KLEIN requests an
amendment to Permit $3929 to construct a 10' X 16' deck instead
of a 10' X 60' deck. Located East Legion Road, Mattituck.
TRUSTEE TUTHILL moved to approve the amendment, TRUSTEE SMITH
seconded~ ALL AYES.
4. En-Consultants, Inc. on behalf of THEODORE PETIKAS to
amend Coastal Erosion Hazard Ac~ Permit ~i35-1-27 located Middle
Road, Southold immediately west of Town Beach.
TRUSTEE BREDEMEYER issued the following Resolution:
WHEREAS, Coastal Erosion Hazard Area Permit ~135-1-27 issued
March 24, 1993 originally based on the R. Van Tuyl survey of
January 8, 1993:

6. Samuels & Steelman on behalf of JOHN VASSIL to amend
waiver granted on February 20, 1993 to include an open roof
structure over the deck and steps on the water side of
referenced property. Applicant has also agreed to install
drywells to contain rainwater runoff from roof. Located Salt
Lake Lane, Mattituck.

7. Burger Construction on behalf of' LINDA KLEIN requesting an
amendment to existing Permit ~I617 to include b~lkhead under

8. FL%RTHA HUSING requests a waiver to construct 100+/- 1.f.
of timber walkway to be 4' wide and 1' above grade with handrail
leading to a 5' X 4' stairway over bulkhead, due to March 13,
1993 blizzard. Located Peconic Bay Blvd. approx. 147.12' west
of Sigsbee Road, Mattituck.
TRUSTEE ALBERTSON moved to approve the waiver, TRUSTEE SMITH

9. Diane Herold on behalf of ROBERT CELIC requests a waiver
to raise house to the required tidal floodplain elevation for
V-4 zone. House and decks will be raised and placed on a pile
foundation. Located Park Avenue Extension, Mattituck.

10. JON C. KERBS requests a waiver to 1. construct a 22' X
30' addition to the building as shown on the attached survey.

Building Permit ~84742) with a roof. 3. Screen in the lower

11. Land Use Company on behalf of LOUIS CORSO requests a
waiver to construct a stairway 4' wide and range in length from
100' to 140' which will access to beach area from lot $10.6.

12. TOWN OF SOUTHOLD requests a waiver to construct a concrete
block walkway and a wood walkway to provide public access to
Pipes Creek and Peconic Bay. Located ROW off Bayshore Road,
Greenport.
TRUSTEE SMITH moved to approve the waiver, TRUSTEE SMITH
seconded. ALL AYES
TRUSTEE moved to go off the regular meeting and go onto Public

IV. PUBLIC HEARINGS:
THIS IS A PUBLIC HEARING IN THE MATTER OF THEFOLLOWING
APPLICATIONS FOR PERMITS UNDER THE WETLANDS ORDINANCE OF THE
TOWN OF SOUTHOLD. I HAVE AN AFFIDAVIT OF PUBLICATION FROM THE
SUFFOLK TIMES AND AN AFFIDAVIT OF PUBLICATION FROM THE LONG
ISLAND TRAVELER-WATCHMAN. PERTINENT CORRESPONDENCE MAY BE READ
PRIOR TO ASKING FOR COMMENTS FROM THE PUBLIC.

7:45 P.M. In the matter of J.M.O. Consulting on behalf of JOHN
BRIM requests a permit to place rock slope extending easterly
which will vary in height from 6-7 feet in area recentlydamaged
by the storms to a height of 2-3 feet the easterly end near the
property line. Located Private Road, Fishers-Island.
TRUSTEEBREDEMEYER: Is there anyone here who wishes to speak on
behalf of this application.? Anyone here who wishes to speak
against this application? The Trustees and represented by
myself and Bruce Loucka for the CAC conducted the
inspection. At the time our initial request was to have it meet
up with the neighbor to the east, but the recommendation was not
continue that when we found that's the only riparian access for
the owner for small sailboats and other sailcraft. So it's a
good project, it's stabilizing the shoreline very similar to the
n~tive distribution of rocky erratic boulders that exist in the
area. So it's gonna look very nice. Any additional

Town Wetland Ordinance and for Coastal Erosion.
7:47 p.m. - In the matter of the application of J.M.O.
Consulting on behalf of DOROTHY HOADLEY requests storm permit
to repair 107' of stone revetment, construct 25' of stone wall
in line with existing wall, remove wood ramp, regrade and
replace ramp with 3.5' wide wooden stairs in accordance with
plan approved by DEC. Located Penninsula Road, Fishers Island.
TRUSTEE BREDEMEYER: Is there anyone here who wishes to speak on
behalf of this application? Anyone who wishes to speak against
this application? Trustees again inspected this on March 15,
myself, Bruce Loucka. We had no problems with this
application at that time. We did request this to connect with
the stable portion with the neighbors en the east and west. I
believe that was amended to include, was those comments similar
to the DEC?
GLEN JUST: They had requested the same application the second
time.

7:49 p.m. - In the matter of the application of JOHN DOROSKI,
JR. requests permit to construct a one-family dwelling with
sanitary system and driveway as per survey dated April 22,
1993. Located Madison Street, ~reenport.
TRUSTEE BREDEMEYER: Is there anyone here who wishes to speak on
behalf of this application? Anyone who wishes to speak against
this application?
BRUCE LOUCKA: Do you want to read CAC co~f~ent?
TRUSTEE BREDE~EYER: Yes, and also I want to see the survey
because wewere still awaiting the return survey after the
inspection. Wehad given a prior approval on this lot. Is that
a new transmittal? Only because the clerk didn't have it.
Oh, it's right here. "Resolved, Steve Angel seconded by John
Holzapfel resolved to reco~end to the Southold Town Trustees
disapproval of John S. Doroski, Jr. to constr~ct a new single
family dwelling with sanitary system and driveway. The Council
reco~,~ends disapproval because the cesspool system would be a
contaminant to the pond. The house is too close to the pond

area, and human activity would have a detrimental effect on the
pond area. In the opinion of the CAC a Type I action is
ndtcated . I believe they had prior County Health Department
approval on that. They could be wrong too.
BRUCE LOUCKA: Well how close to the ....
TRUSTEE EREDEMEYER: It's probably less than 100 feet. The
predominant ground water flows for this hydrologic region are at
that point towards the Sound.
BRUCE AOUCKA: A lot of that's gonna go down hill the other
way.
It's gonna hit south up to a point then it's gonna hit
north.
Isn't it all down hill?
TRUSTEE BgV, DEMEYER: Well water tends to flow downhill and then
seem tO go level. The co..t~ents of the Conservation Advisory
Council are duly noted. Is there anyone else who wishes to
speak on behalf or against this~ application at this time?

7:5~ p~m. - In the matter of the application of J.M.O.
Consultants on behalf of ARTHUR TOAN request permit to
reconstruct an existing stairway which consist of a 3.25' X
3.25' landing, a 3' X 12' stairs, a 6' X 5/5' landing and a 3' X
11.5' stairs. New stairway shall be reconstructed in he same
dimensions except existing 6' X 5/5' landing shall be enlarged
to 6' ~ 8'. Applicant also proposes to construct a 4' X 24'
catwalk (elev. 4 over grade), 3' X 12' ramp, 5' X 16' float
andto linstall two 2 pile dolphins. Located Ruch Lane

TRUSTEE BREDE~EYER: CAC had no problem with this. Is there

7:55 p.m. - In the matter of the application of J.M.O.
Consultants on behalf of WILLIAM EDGET requests a permit to
constr~ct 4' X 40' elevated catwalk, a 3' X 12' ramp, and a 5' X
16' fldat. Located 200 Deep Hole Drive, Mattituck.
TRUSTEE BREDEMEYER: There anyone here who wishes to speak on
behalf of the application? CAC had concurrents. They approved
provided catwalk is elevated 4' above the grade of the marsh as

stated in the project description and not 4' above low water as
shown the on the plans. There was a discrepancy so that should
be noted that it should be 4' above grade. Anyone against?

7:59 p.m. - In the matter of the application of J.M.O.
Consultants oh behalf of FRANCES MC LAUGHLIN to construct
100' of timbe~ bulkhead with a 20' return at its eastern end.
Structure shall then be backfilled with approx. 350 c.y. of
clean sand which shall be trucked in from an upland source.
Applicant also proposes to reconstruct stairs and landings which
along with bluff had been severely damaged during this past
storm. Located 505 Soundview Ave., Mattituck.
TRUSTEE BREDEME~: Is there anyone here who wishes to speak on
behalf of this applicant? Anyone here who wishes to speak
against this application? The CAC recommends disapproval of
bulkhead because the house is not in jeopardy, therefore the
bulkhead is not warranted; there is no policy for bulkheading
along the Long Island Sound and although there is no established
poli~y the long range effects of the butkheading along the
Sound must be considered. Council approves the stairs and
landing. Actually there is a policy now because the Trustees
have ~een approving these by and large. We went out to the site
and the Board did not have a problem with this application on
the inspection. The Coastal Erosion Hazard Area Ordinance
actually does provide for specific language allowing erosion
protection structures. The philosophy concerning wether you
allow them or not runs with the Board.
BRUCE LOUCKA: There again it gives reasons why you would
allow. If his house was going to be falling in you'd have no
problem.
TRUSTEE BREDE~EYER: I think the Trustees on a number of
occasions have looked at these and to be honest with you and
typically allow earlier intervention I think as a point of
philosophy then the CAC does. We simply have a somewhat of a
different idea on property protection when we see it there. Is
there any additional comments on this? I'll take a motion to
close the hearing.

8:03 p.m. - In the matter of the application of Costello
Marine on behalf of ANT~O~f VITALE requests a ten year
maintenance dredge permit to dredge 6'MLW approx. 100 c.y.
of sandy material at entrance to Fair Haven Inlet to provide

boating access to property owners. Approx. 50-75 c.y. will be
dredged each year. Located Inlet Way, Southold.
TRUSTEE BREDE~EYER: Is there anyone here who wishes to speak on
behalf of this application?
BRUCE AOUCKA: Our question on it was, we just want some
clarification, we tabled it. Where's the fill going and if
they're gonna dredge it where they're gonna put it?
TRUSTEE BREDEMEYER: I believe it's up for disposal.
TRUSTEE ALBERTSON: Question. It says approx. 50-75 c.y.
will be dredged each year. Is that wether they need it nor not?
TRUSTEE BREDEMEYER: No, that would be something that we would
have to discuss presently because we usually only give a two
year permit, unless we would make a special permit run
concurrent with the Army Corps. or the DEC° It would only be a
two year permit from us. They do show the spoil site as being
the Suffolk County Department of Public Works spoil site across
the Creek.
TRUSTEE SMITH: They're asking for a ten year maintenance.
TRUSTEE BREDEMEYER: I don't have any objection with this
particular location having ten year maintenance, "cause it sandy
and continued to fill in. If they are prepared to .pay for it
themselves. Any other comment? I guess we can close the
hearing.
TRUSTEE ALBERTSON: Motion to close.

concurrent with Army Corps., and DEC.

8:10 p,m. - In the matter of the application of ROEERT HAMILTON
requests a permit to construct a timber dock consisting of a 4'
X 20' fixed elevated walk (4' above marsh grass); a 4' X 12'
hinged ramp; a 6' X 20' float secured, by (2) pilings. Located
1180 Smith Drive, Southold.
TRUSTEE BREDEMEYER: Is there anyone here who wishes to speak on
behalf of this application? Any other co~tu~ent? Pro or con?
Seeing none I'll take a motion to close the hearing.

8:12 p.m. - In the matter of the application of ARTHUR TORELL
JR. requests to construct a one family dwelling with pervious

driveway as per revised plans dated April 9, 1993. Located 365
Westwood Lane, Greenport.
TRUSTEE BREDEMEYER: Is there anyone here who wishes to speak on
behalf of this applicant?
MR. TORELL: That is my application. May 3 is the latest
revised drawing.
TRUSTEE BREDEMEYER: Anyone here who wishes to speak against,
any CAC co~ents?
BRUCE LOUCKA: We sort of disapprove. What we had we
disapproved.
TRUSTEE BREDEMEYER: The sanitary system was required to be
removed from in front of the property only because the Health
Dept. is the same distance from the pond. They didn't want to
have a s~stem behind the house that might be inaccessible due to
vegetated growth. It couldn't be serviced. This is another
situatian no seriously disadvantaged. The ground water flows.
Certain subsurface should take the pollutants away from the pond
boundary.
BRUCE LOUCKA: We recommend disapproval because it a little
close to the wetland.
TRUSTEE BREDEMEYER: Duly noted this is one of those old single
and separate lots that we were lucky we can get it out of the
wetland. Are there any additional co~m~ents? The Board looked
at it and felt that the siting was the best we could do. The
specific layout of the driveway and the house was at a request
of the Trustees to have everything to the upland side of the 9
foot contour. This has been through several revisions by all
the involved agencies to try to amend this and Mr.. Torell has
indicated that he is willing to leave the entire property in its
natural state except for the amenities of getting on his
driveway pretty much and the sanitary system disturbance. Being

8:15 p.m. - In the matter of Latham Sand & Gravel, Inc. on
behalf of MARTIN & SHIRLEY ZACHARIUS to construct a 70'
retaining wall to tie into existing 30~ retaining wall on east
end due to sever erosion of bluff. Wall to be 3' in elevation
above existing rOCks. Approx. 200 c.y. of backfill from
upland source to be placed and planted with Rosa Rugosa.
Located 1055 Soundview Road, Orient.
TRUSTEE BREDEMEYER: This previous structure broke apart of
similar design. It was so substandard constructioning, I think
they're trying to upgrade this and I know they're going to have
a joint project with neighbors to protect their property. Is
there anyone here who wishes to speak on behalf of this
application? Is there anyone here who wishes to speak against
this application? This is before we amended the forms to have a
referral and a date coming back from the CAC. And some of
these we had incomplete application review that went out late
and some of these did not get processed through the CAC. This
has an existing rock wall and washed out and they're essentially

trying to reestablish what they had. Motion to close the

TRUSTEE BREDEMEYER: What's your pleasure in this matter? Now
there was a question here we had already discussed the fee
forgiveness because a lot of this was storm damage but this
structure was an extension of an existing. And I think the
Board laid it to rest when we discussed it in the field and you
said they had to pay a full fee. Motion to approve?
TRUSTEE BREDEMEYER: I'll make a motion to approve this
application.
TRUSTEE TUTHILL: Second. ALL AYES.
8:20 p.m. - In the matter of En-Consultants on behalf of SUSAN
TASKER to construct ~ one family dWelling, deck, retaining
walls, sanitary system, bluestone (or similar pervious driveway)
underground utilities and approx. 200 c.y. of clean sand as
per survey dated May 18, 1993. Located Route 48, Southold.
TRUSTEE BREDEMEYE~: This hearing is for the Wetland Ordinance,
we held on-under the Coastal Erosion Hazard Act. The result of
that hearing is the Trustees approved the Coastal Erosion Hazard
Act application and I have drawn up the relevant permit history
and the conditions which are consistent with the application to
date t~at we could c~nsider. Anyone here to speak on behalf of
Susan Tasker or against?

TRUSTEE BREDEMEYER: Yes we did. To disapprove which we noted
last mOnth and the CAC feels it's an entirely substandard
lot. This sort of a! lot really is one of those difficult
situations similar if you will, to what Bruce Anderson outlined
before on Gus Wade excepting we don~t have a vegetated tidal
wetland and we have further: mitigation here because of the fact
that there was a bulkhead on either side of the property. The
storms amazingly enough, I assume that it would seem that the
neighbors structures of the bulkheads protected this during the
severe winter storms because we've seen it before and after. In
any case the concerns of the CAC are duly noted and I think
this is one of those, situations where mitigations call for and
to impose a lengthy impact process and you'll ultimately find
that there is no endangered species and all the neighbors have
built houses similar. And it comes down to prove it or buy it.

6' X 32'. The overall length of the proposed fixed pier is

floating wave curtain. A tongue and groove wave curtain will be
attached to center of fixed pier (MLW). A new 6' X 8' fixed
platform will be added to the west side of fixed pier and the
existing 3' X 14' ramp and (6) 6' X 20' floating docks placed on
west side of fixed pier and secured by additional pilings. (11)
pilings will be placed at various distances west of fixed pier,
(5) pilings will be placed 20' east of fixed pier to create
slips. Additional pilings will of course be needed for fixed
pier and floats. Purpose of project is to create a more secure

5. C & S Engineers, Inc. on behalf of The Town of Southold -
ELIZABETH AIRPORT to overlay both runways with asphalt in
accordance with Federal Aviation Administration (FAA)
specifications. In an effort to minimize disruption of ferry
operations and runway closure at the airport, the contractor
will have the option of constructing a temporary asphalt plant
on airport property. Locating-the plant on site will provide
the Town with more control over the installation of the
asphalt. The temporary asphalt plant, if constructed, will be
located northeast of runway 30, approx, halfway between the

ends of runways 25 & 30 on an existing gravel road. The
temporary plant will be completely dismantled upon completion of
the runway overlay project. The selected contractor will choose
which type of plant to build as there are basically three types
of plants currently in use: batch, mix, and continuous mix
plants. The major components of an asphalt plant include the
cold feed system, the asphalt supply system, the aggregate
dryer, mixing tower, and emission control tower. The plant
tower consists of several elements; hot elevator, screen deck
hot bins, weigh hopper, asphalt cement weigh bucket, and
pugmill. Aggregate will be stockpiled at the plant. ThH
project also includes the construction of a riprap berm
approx. 220 feet long. The proposed berm shall be situated
between the west end of runway 7 and the Sound. Beach grass
will be planted in accordance with NYSDEC specifications in
the sandy area that is situated between the west end of runway 7
and the eastern edge of the riprap. The purpose of the
riprap berm is to alleviate the build up of sand on runway 7
end. Located Fishers Island.
