PITMAN, of 2 Coppell Drive,Tenafly, N.J., and VINA ELIZABETH SCHULTZ, of 54 W. Ivy Lane, chgle- wood, N.J., as Executors of the Estate of William H. Pitman, under the last will and testament of William H. Pitman,late of the Borough of Tenafly, in the County of Bergen and State part of New Jersey, deceased, parties of the first', and IRVING G. PITMAN and SUZANNE M. PITMAN, his wife, of 2 Coppell Driv , Tenafly, N.J., parties of the second part, WITNESSETH, that the parties of the first part, by virtueofthe power and authority to them given in �. and by said last will and testament, and In consideration of - - - Five thousand ($5,000.00) - - - - - Dollars , lawful money of the United States, paid by the parties of the second part, do hereby grant and release unto the pantie of the second part, their heirs and assigns forever, ALL those certain lots, pieces or parcels of land,situate lying and being in the Town of Southold, County of Suffolk and State of New York, bounded and described as fellows: FIRST TRACT: BEGINNING at a point five feet Easterly from apo marked by a locust post, which point is dis- tant South 550 15' East four hundred (400) feet from the North corner of a tract of land conveyed by the parties of thefirst part to Levis W. Brown, said north corner of said Lewis W. Brown's lot being distant South 35 38' East seven hundred and twenty-one and nine tenthe (721.9) feet from a granite road monument set at apoint in the south- erly side of the North Road or King's Highway, distant F' therein ten hundred and ninety-two and three tenths (1092.3] feet westerly from the point where the said southerly side of the North Road is intersected by the Easterly boundary line of lands conveyed to the party of the first Dart by Mary L. Basch by deed dated August 27, 1019, recorded August 28, 1919 in the Suffolk County Clerk's Office in Liber 962 Of Deeds, page 160, said Easterly line of lands of Valentin Ruch (party of the first part) being also the Westerly line of lands now or formerly of one Ryder, said point of inter- section being marked by a granite merestone; and from sai.d point of beg:^ring rugning South 550 15' East fifty (50) feet; thence Soath 34 45' West one hundred and ninety (19 0) feet more or less to the hip hw,a.ter mark of Arshamomoque Ba thence Northwesterly alonv� said highwater mark the several courses thereof fifty (501 feet more or less to a point '.. where said highwater mark of Arshamomoque Bay is inter- sected by a line drawn Darallel to the second course here- inabove described and distant fifty (50) feet Northwest- erly therefrom; thence North 340 45' East along said line LgER1186 PAGE456 drawn parallel to the second �^urse hereinabove described - one hundred ninety-six (196) feet, more or less to the - point or place of beginning. TOGETHER with an equal right with the parties cf the - first part in and to the lands under the waters of Arshamom - - que Bay lying Southwesterly of the lends hereinabove described. - TOGETHER with a twenty-five (25) foot right of way over other lands of the said Valentine Ruch, party of the first part, us now laid out running from the Sings.Highway or North Road to the waters of Long Island Sound. _- - SUBJECT, however, to the following covenants, restrletio s and condtions: _ First, that the party of the second part will not erect or permit to be erected any dwelling or structure on that - portion of said premises lying Southwesterly of a line drawn parallel to the first course of said premises and distant Southwesterly one hundred twenty-five (125)feet therefrom. Second, that the sewage and waste water upon said premis s _ shall be disposed of by the party of the second part in such a manner as not to contaminate the potable water supe y _ thereon and upon the adjoining premises and so as not to contaminate the waters of said Arshamomoque Hay and shall - be disposed of in such a manner as shall be approved by the public health authorities of the State of New York. - SECOND TRACT: BEGINNING at a point on the easterly side of a twenty-five fpot right of way which nuns from land now or formerly of parties of the first part to the main North Road or icings Highway where the northwesterly line of land _ of Vine, 1;. Pitman would if extended in a straight line intersect the easterly line of said right of way running thence in a northeasterly direction a distance of one hun- dred and fifty (150) feet thence running at a right angle - _ to the last mentioned course and in a southeasterly di- rection a distance of fifty feet thence running at right angles to the last mentioned course and parallel to the _ first course in a southwesterly direction to the easterly line of said right of way thence along the easterly line of said right of way to the point or place of beginning.
