PHIS INDENTURE,made the fifth day of February a nineteen hundred and sixty-five. BETWRFN RUTH F. PRESTON, residing at Middleton Road, Greenport, New York; IDA BELLE LATHAM, residing at Orient, New York; and ROBERT L, MUIR, residing at Mattituck, New York, v party of the first part,and RUTH F. PRESTON, residing at Middleton Road, Greenport, New York, party of the second part, WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration paid by the party of the second part,does hereby grant and release unto the party of the second pmt,the heirs or successors and assigns of the party of the second part forever, ALL that certain plot,piece or parcel of land,with the buildings and improvements then son erected,situate, lying and being itudo east of the Village of Greenport, in the Town of Southold, Suffolk County, New York, bounded and described as follows: BEGINNING at a point on a boundary line between land of the parties of the first part and land now or formerly of Dawn Estates Builders Corp. 260,0 feet southerly along said boundary line from a monument at the southeasterly corner of land now or formerly of Yuma Corp., from said point of beginning running along said land of Dawn Estates Builders Corp. two courses: (1) South 20 degrees 50 minutes 10 seconds East 129.05 feet; thence i (2) South 21 degrees 24 minutes 20 seconds East 50 feet, more or less, to ordinary high water mark of Gull Pond; thence southwesterly along said high water mark about 100 feet to the easterly edge of a dredged canal; thence northerly along said easterly edge of said dredged canal about 100 feet to land conveyed or about to be conveyed by the parties of the first part to Charles King and wife; thence along said land and across the southerly end of a 50 foot right of way and passing through two monuments North 56 degrees 39 minutes 50 seconds East 160 feet, more or less, to the point or place of beginning. TOGETHER with a right of way 50 feet in width from the northeasterly corner of the premises northerly and then westerly and then again northerly and then' again westerly and then again northerly about 1470 feet to the North Road. This deed is given for the purpose of correcting an error in the description in a deed by the parties of the first part hereto to the party of the second part hereto executed, acknowledged and delivered on the 9th day of March, 1964, and recorded in the Suffolk County Clerk's Office on April 30, 1964, in Liber 5536 of Deeds at page 94. TOGETHER svid,all right,title and interest,if any,of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises;TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever,except as aforesaid. AND the party of the first part,in compliance with Section 13 of the Lim Law,covenants dat the party of the first part will receive the consideration for this conveyance and will hold the right to receive such cansid- eratfon m as a trust fund to be applied first for the purpose of paying the cost of the fmprovemt and will apply the same first to the payment of the cost of the fmprovemmt before using my part of the total of the same for any other purpose.
