by the party of the second part, does hereby grant and release unto the party of the second part, the heirs, or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and beingtmihe at East Marion, Town of Southold, County of Suffolk, State of
New York, more particularly bounded and described as follows:
BEGINNING at the southerly terminus of the easterly line of a private road leading
southerly from the Main Road, 2101.37 feet southerly along said easterly line from
the Main Road, said point of beginning being the northeasterly corner of the
premises herein described; from said point of beginning running along land of
Kavanagh, south 31°15150" east, 624 feet, more or less, to ordinary high water
mark of Gardiner's Bay; thence sbuthwesterly, along the said high water mark, 360
feet, more or less, to land "reserved for beach area, " as shown on "Map of
Cleaves Point, " Section 1, filed in the Suffolk County Clerk's office as map 2752;
thence along said land, north 44°03130" west, 183 feet; thence along the easterly
line of a 15 foot right of way shown on said map, north 12°53110" east, 131.27 feet;
thence along lot 6 as shown on said map, north 8°13110" east, 121.02 feet; thence
along lot 5 as shown on said map, north 0°22'40" east, 124. 15 feet; thence along
lot 4 as shown on said map, north 16°08120" west, 131. 56 feet; thence along lot 1 as
shown on said map and across the southerly end of said private road, north '
56037110" east, 125 feet to the point or place of beginning.
EXCEPTING therefrom a trapezoid shaped piece encroaching on the easterly line
of the premises near the southeasterly corner thereof, on which is presently erected
part of a concrete patio attached to a beach house located an the premises adjoining
on the east, as shown on a survey made by VanTuyl & Son, dated November 10,
1969, a copy of which is attached hereto as Schedule A.
BEING and intended to be part of the same premises conveyed to the party of the
first part by deed made by Cleaves Point Corp. dated September 4, 1964, recorded
in said county clerk's office September 11, 1964, liber 5612 of conveyances, at
page 485.
SUBJECT to any state of facts an accurate survey might show, and to covenants,
restrictions, easements, agreements, reservations, and zoning regulations of
record, if any.
TOGETHER with (1) the right of ingress and egress over the above mentioned
private road, in common with others, from the Main Road to the premises
