5. En-Consultants Inc., on behalf of CLEAVES POINT VILLAGE
requests a one year extension to Permit ~4224 to modify an
existing dock to a fixed pier of 6' X 245' with a 6' X i!0'
outer "T". Both fixed sections will have 20' section Of wave
baffles on alternate sides with i0' spacing, the out "T" will
have (2) 4' X 20' fixed finger docks with (2) pilings between, a
4' X 14' hinged ramp will extend off the mid-section of the main
fixed pier and rest upon a 6' X 100' series of floats, on north
side of this main float will be (4) 3' X 25' fixed floats with
(3) mooring pilings, and on the south side of the main float

SUFFOLK TIMES. PERTINENT CORRESPONDENCE MAY BE READ PRIOR TO
ASKING FOR COMMENTS FROM THE PUBLIC.

7:36 p.m. In the matter of VICTOR & ELLA BECK requests a

TRUSTEE KRUPSKI: Is there anyone here who would like to make a
comment on this, either for or against? CAC recommend an
approval that the applicant remove the two existing pilings
seaward of the dock to help aid to navigation.

TRUSTEE ~OLZAPFEL: I looked at it and I think there;s enough
water, there's plenty of water there. This is what was there
and they're just asking to replace it. I'll make a motion that

7:38 p.m. - In the matter of Land Use Co., on behalf of GERALD
RUPP requests a Coastal Erosion and Wetland Permit to
construct 80' of timber bulkhead, 100 c.y. of clean fill will be
utilized to backfill between the existing bluff and the
bulkhead. The bulkhead will tie into neighbors to the east and
west as per revised survey dated Aug. 9, 1995. Located: Sound
View Ave., 500' east of Mount Beulah Ave., 1,850' west of

TRUSTEE KRUPSKI: Is there anyone here who would like to speak
in favor or against the application?
MR. ANGELL: There is brush and trees that have been thrown
over the bluff. We really think they should be removed. I
think that will add to the erosion problem there.

TRUSTEE KRUPSKI: is there anyone here who would like to speak

GLENN JUST~: Unfortunately, not yet.
TRUSTEE KRUPSKI: Is there a problem?
GLENN: When we reduced the size of the walkway at the Trustees
inspection, we went back and did the modification process.
TRUSTEE KRUPSKI:
TRUSTEE KRUPSKI: When you reduce the size of the catwalk to 3'
over tidal wetlands you can also reduce the height.
GLENN: I don't know how much success...who did that. I've had
one recently with the Dept. of State who turned around and said
it's got to be 3 1/2' over the grade of marsh.

TRUSTEE KRUPSKI: OK. We spoke with the DEC and they said it
sounds reasonable if your reducing it to 3' it doesn't have to
be as high. But we didn't speak with the Dept. of State. You
could approve a catwalk of 18" and it wouldn't have to be 4'
high. It could be a lot lower and sun light could get through
it.
TRUSTEE HOLZAPFEL: I wouldn't act on this because the Board
hasn't seen this.
TRUSTEE KRUPSKI: I'll make a motion to table this application.

7:42 p.m. - In the matter of J.M.O. Consulting on behalf of
DOROTHY LUDECKER requests a Wetland Permit to construct a 3' X
48' catwalk, elev. 3 1/2' over grade of marsh, a 3' X 14' ramp
and a 6' X 20' float and 2- 2 pile dolphins. Located: 370
Koke Drive, ROW off Main Bayview Rd., Southold. SCTM ~87-5-2
TRUSTEE KRUPSKI: Is there anyone here who would like to speak
in favor or against the application. CAC reco~f,~,ends approval.
TRUSTEE WENCZEL: I have just one question for Glenn. You did
the planning on this one?
GLENN: Yes.
TRUSTEE W~NCZEL: Is it necessary for it to be this long?
GLENN: I went out there with the contractor and asked that
their minimum length be scheduled.
TRUSTEE WENCZEL: What kind of boat does he plan to moor on this?
GLENN: He's got an 18 or 19' boat.
TRUSTEE WENCZEL: That's particularly shallow in that part of
cove there?
GLENN: Yes.
TRUSTEE WENCZEL: A good 20 or 25' is salt marsh.
TRUSTEE KRUPSKI: How about holding it at a "T" instead of
straight out, or an "L"?
GLENN: You have to go further out to a fixed portion. And that
will be a seasonal dock with a floating ramp to come out in
season.

7:45 the matter of Eh-COnSultants inc., on behalf of
a Coastal Erosion &~,Wetlan~ Permit
to construct 160+,/- t.f. of stone revetment against eroded bank
and backfill with 85+/- c.y. of clean sand to be trucked in from
upland source, construct a 3' X 20' stairway to connect to an
existing platform and stairs for pedestrian access over
revetment as per amended plans received 7/27/95. Located:
54005 North Road, Southoid. SCTM ~52-1-t
TRUSTEE KRUPSKI: Is there anyone here who would like to speak
in favor or against this application? CAC recommended approval
with provisions that after burying revetment that all fill be
planted with beach grass and also that the Trustees should
require the applicant to keep the structure maintained and

buried. Roy, I think we asked for this before but I'm not sure
we asked for this .... I think I spoke to Rob about this but I
can't remember when. But we would like the same sort of C &
R's because it's next to a Town Beach. The same as we got on
the Boyle application. In the event of any ..... which I find
really unlikely in this location. But as compared to Boyle
which there is a serious problem. The same sort of C & R's I
think would be appropriate here just because it's next to the
Town Beach and if it causes any erosion to the Town Beach
certainly the applicant should be liable.
ROY HAJE: I can't commit him to that without his approval. But
I can mention it to him and give him a copy of the Boyle one and
let you know.
TRUSTEE KRUPSKI: Personally I don't think it could happen here
but because it's next to the Town Beach it's our responsibility
is to protect the Town Beach from his structure the same as we
did with Boyle. Do you want us to table this or do you want us
to put it in conditionally?
ROY: If you put it in conditionally and he violently objects,
then what?
TRUSTEE KRUPSKI: Then he doesn't have anything. I could table
it and work it out. How are you making out with the DOS?
ROY: Not involved. We have DEC and a report of no permit
necessary.
TRUSTEE KRUPSKI: That's our only concern there. Is the Town
Beach. Unless you can come up with something tess restrictive
than C & R's. Unless the Board doesn't think that's necessarf
in this case and we can put a condition on the permit.
ROY: It gets involved. You have to file it and then wait for
it to be recorded and all thatf
TRUSTEE HOLZAPFEL: It seems funny to do it at one end of the
beach on not the other end. That isn't very consistent.
TEUSTEE KRUPSKI: I'll make a motion to table the application.

IV. ASSESSMENTS:
1. J.M.O. Consulting on behalf of LOUIS M. B~CONirequests a
W~i to construct 2 board walkways for the purpose of
crossing inter tidal marsh as located by the staff of
the NYSDEC, the northern most walk shall be 18" X 147' and be
constructed 18" over grade of marsh, and the southern most walk
18" X 112' constructed 18" over grade of marsh, also to allow
for the installation of a 6' X 12' X 4' seasonal waterfowl
pitblind to be located along the southern spit of the Island.
Located: Robins Island.. SCTM %134-3-5
TRUSTEE KRUPSKI: Is there anyone here who would like to speak
either for or against this application? Actually the question
about the elevation of the docks came up before this. We saw
Lou Chiarella in the field one day and we asked him about

that. So that when we saw this application we pretty much
didn't have any objections to it.
TRUSTEE HOLZAPFEL: Glenn, did the DEC say anything about this?
GLENN: Chuck Hamilton is handling all Robins Island matters
personally and three weeks ago he was at the wash out at the
Westhampton Dunes and last 2 weeks he was at the Rocky Point
so I don't think he's been in the office for the last 3 weeks.
We've gotten the OK from the Army Corps and the DOS with
favorable c~Lents so far.
TRUSTEE KRUPSK]: That's why we weren't upset because we had
discussed it before with the Board and we're in tune with it.
TRUSTEE HOLZAPFEL: I'll make a motion that we give a Negative
Declaration.
TRUSTEE ALBERTSON: Second. ALL AYES
.2. J.M.O. Consulting on behalf of ANN KWASNESKI requests a
Wetland Permit to reconstruct within 18", 110' of timber
bulkhead with a 24' return along western property and backfill
with 20 c.y. of clean sand to be trucked in from an upland
source. Located: North Parish Road, Southold. SCTM ~71-1-10
TRUSTEE KRUPSKI: is there anyone here who would like to speak
in favor or against this application?
TRUSTEE WENCZEL: I looked at this and that 24' return is new
construction rlght?
GLENN: Yes.
TRUSTEE WE~CZEL: That wasn't really clear in the application.
What I would simply like to do is just amend the wording of
this. So if we could make that little change, I'll make a
motion we give a Negative Declaration.
MR. ANGELL: Could you hold on a second. On the plan, is an
indication that they want a new built walkway. Is that included
in the request on this permit?-
GLENN: No. That walkway that runs along the west side would be
the center most groin and the walkway that runs down the bank,
that where the stairs are, they want to reconstruct that in the
same configuration as well.
MR. ANGELL: We recommend the approval of the walkway behind
the bulkhead but not on the groin.
TRUSTEE KRUPSKI: Can you come up here and amend this.
TRUSTEE WENCZEL: You think the walkway behind ~he...
MR. ANGELL: The walkway behind the bulkhead is OK. The one
that goes out on the groin we think is inappropriate.
TRUSTEE F~RUPSKI: Why is that.
TRUSTEE WENCZEL: It's pre-existing.
MR. ANGELL: The walkway doesn't belong on the beach. A groin
is there to protect the sand. A walkway is not needed. Let
them walk on the beach.
(All are talking at once and discussing this)
TRUSTEE WENCZEL: Peter can you make an assessment?
TRUSTEE WENCZEL: We're gonna assess this without the .... I'm
not sure quite what to do here.
TRUSTEE KRUPSKI: You could still neg. dec. it and deny that if
you want to.

TRUSTEE WENCZEL: Then t go with my original motion to Neg. Dec.
this.
~R. ANGELL: I wanted to bring it up now so that we're not
arguing next month.
TRUSTEE ALBERTSON: Second. ALL AYES
3. En-Consultants Inc., on behalf of WILLIAM ELS requests a
Wetland & Coastal Erosion Permit to construct a 160' retaining
wall with 40' angled return on west side. Wall will connect to
landward end of return on east side. Structure will be armored
with I+ ton s~one on filter cloth, backfilled with 375 c.y. of
sand trucked in from Duck Pond Road to wesE, and construct a 4'
X 170' stairway with (2) 4' X 8' platforms for access to
beach. Located: ROW off Bridge Lane and Oregon Rd.,
Cutchogue. SCTM ~72-1-1-.10
TRUSTEE KRUPSKI: The Board looked at this.
MR. ANGELL: We requested that the Trustees follow their most
recent bulkhead policy and that was to bury the bulkhead and
angled to the west and plant and fill with beach grass and
elev. stairs at an adequate height.
TRUSTEE KRUPSKI: It's pretty much what the neighbor had to the
other side. It's all stabilized to the east, they're all
planted and the whole bluff stabled. We want planting in the
permit.
ROY: You want the bulkhead buried?
TRUSTEE KRUPSKi: You know, how Corso and Stritzler were
done.
ROY: Stritzlers' is not buried yet, but it will be when we
get a little more moisture on the bank and it will all come
down. it's almost a vertical bank and they built it right at
the bottom so when it slumps then it will slump because it is
all bare and it will completely cover that and then they could
re-vegetate. It doesn't make sense to re-vegetate a bank that's
not stablel Whereas Corso, which is right to the west. You
could see it from this property, is built into the bank and is
completely covered and is stable in the back. The angle of
repose is correct so that it's stable and they can re-vegetate.
And the CAC is recommending vegetating everything.
ROY: Are you saying that they bring in fill ta~bury the
bulkhead?
TRUSTEE KRUPSKI: Not necessarily. It depends on the site. A
lot of times the top has to be cut back. There's no sense in
plantinq it if it's unstable. The top has to be cut back to
make a proper angle. Just building a bulkhead is like half a
job. You have to stabilize the bluff behind it and replant it.
Using that fill as backfill to cover the bulkhead. The fills on
site. The top has to be cut back anyway. Our recommendation is
that the bulkhead be placed as close to the toe and then you get
your correct angle on the bluff and then replant and
re-vegetate.
MR. ANGELL: But the seaward side be buried too.
ROY: What I can't envision is if you bury the bulkhead how that
material on the outside is gonna for any given period of time.

TRUSTEE KP~PSKI: It depends in a storm event. And I think the
feeling of the Board is that once you cut down the angle you
have so much sand available there, push it out and make
everything stable, make it a one shot project for the property.
As far as the re-vegetation goes, that's the whole point is to
stabilize the upland. To bring in sand, there's material on the
site, and I don't know why you would want to bring in sand.
ROY: That's an important point, if that's what was in the
theory, if they have to bring in sand you have to excavate the
cost of that ...... A portion of the bluff can be collapsed as
they often do to get a more stable slope and there's your
immediate on-site source of backfill.
TRUSTEE ~RUPSKI: That's what we recommended in the other
applications.
ROY: This one too, we put it back. If you noticed considerable
further than the other'bulkhead. Because people don't want to
spend this money either for the tremendous amount of fill if
they have to bring it in.
TRUSTEE KRUPSKI: But even in this site the fill is there, they
own the whole bluff, they shouldn't have bring in a grain of
sand. You push the bluff down and make it flatter. The flatter
they make it the more stable it is and the better the planting
is gonna hold. They really help themselves in the long run.
It might hurt to loose ten feet of lawn, but in the long run
they've got a really stable bluff that's not gonna go away.
TRUSTEE HOLZAPFEL: Just for your own information, DEC has in
the past, also, if you bury it, they've done away with the rock
revetment in front of it.
MR. ANGELL: tt would be cheaper in the long run, to bring
sand in rather than rock revetment. It allows the sand that's
moving down the beach to replenish the neighbor. As soon as you
put the bulkhead up, the sand just washes away in the storm, and
there goes the beach. And then the next storm attacks the
bulkhead and the neighbors property that's not bulkheaded.
TRUSTEE HOLZAPFEL: I'll make a motion that we Negative Dec. it
under the concept that the bulkhead will be buried.
TRUSTEE WENCZEL: Second. ALL AYES
4. En-Consu!tants Inc., on behalf of ELiNO DENA JR.,
requests a Coasta! Erosion & Wetland Permit to ~nstall 281 1.f.
of steel retaining wall as close to toe of existing eroded slope
as is feasible to install tie-back system. Backfill with 1,200
c.y. of clean fill to be trucked in from upland source and place
a stone splash pad 12+/-' landward of wall. Repair (or replace
if necessary) pedestrian access to beach. Located: R.O.W. off
County Rd. 48, Southold. SCTM ~73-5-1
TRUSTEE HOLZAPFEL: I'm not sure i looked at the right property,
to be honest with you.
ROY: Is there an old dilapidated house on 5op?
TRUSTEE HOLZAPFEL: About 2 feet from the edge of the bluff?
ROY: That's the right property.
TRUSTEE HOLZAPFEL: Do you go down the long dirt road.
ROY: Yes.
TRUSTEE HOLZAPFEL: And it's the last one to the east.

ROY: Yes. No. To the west.
TRUSTEE HOLZAPFEL: I don't see any problem with this except for
what we just went through.
MR. ANGELL: We recommended the same thing here. We suggested
that maybe plant with beach grass and be buried also.
TRUSTEE KRUPSKI: Again, the same sort of scenario. Push it all
the way back and cut the bluff back and stabilize it.
TRUSTEE ALBERTSON: How close to the bluff is his house.
TRUSTEE HOLZAPFEL: A few feet.
ROY: This might not be so easy. Because the house is extremely
close to the crest of the bluff. You can't cut back that crest
there at all. That's where the house is. As it turns out the
worst erosion is right at the house for whatever reason. We
have it back pretty far.
TRUSTEE HOLZAPFEL: Yes, it's at the base. the description puts
it at the base.
ROY: This has to be pretty high because we have to stabilize
that very steep bluff as possible. He has a severe situation
there. The lot is pretty shallow so you cant do anything as far
as moving houses around.
TRUSTEE KRUPSKI: What you have on the survey it sort of concave
where the house. Will the bullhead be straight across then?
ROY: No, we have some breaks in it. It's not a straight line.
It follows pretty much the contour of the toe.
TRUSTEE HOLZAPFEL: I would make a motion that we Negative Dec.
this application.

5. ROBERT J. SHANK requests a Wetland Permit to raise existing
house and decks to Federal Flood Plane level. Approx. 20 c.y.
