DAVID F. NOCKLER, residing at # 16 Willow Place,
Malverne, New York 11565, STEPHEN E. NOCKLER, residing at # 3175
Soundview Avenue, Peconic, New York 11958 and PETER M. NOCKLER,
residing at # 440 Haver"lake Circl,'3, Apopka, Florida 3271-2, as tenants
in common,
party of the second part,
WITNESSETH~that the party of the first part, in consideration of ten dollars and other good
and valuabLe cons~deration, lawful money of the United States ~~~~
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being
XMmK at Peconic, Town of Southold, County of Suffolk and state
of New York, being more particularly bounded and described as
follows:
BEGINNING at a point where the easterly side of land formerly
of Silas A.H. Dayton intersects the northerly line of Sound View
Avenue; running thence north 47 degrees 9 minutes 40 seconds west,
1167 feet, more or less, to the high water mark of Long Island
Sound; thence easterly along the high water mark of Long Island
Sound a distance of 150 feet, more or less, to the westerly side
of a private road; thence north 47 degrees 9 minutes 40 seconds
east a distance of 1, 278.47 feet, more or less, to the northerly
side of Sound View Avenue; thence south 81 degrees 22 minutes 30
seconds west, 191.76 feet to the point or place of BEGINNING.
Together with all right, title and interest of the party
of the first part in and to the beach and land under water of Long
Island Sound in front of and adjacent to said premises.
SAID PREMISES being known as #3175 Soundview Avenue, Peconic, New
York 11958
Being and intended to be the same premises acquired by the grantors,
and described, in deed dated 10/30/91, recorded 10/31/91 in Liber
11362 at page 298. IRENE NOCKLER died on February 28, 2000.
TOGETHER with all right, title and interest, if any, ofthe party of the first part in and to any streets and roads abulling the above
described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of
the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,
the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said
premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied
first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it
read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above written.
