THIS INDENTURE made the of October, 1956,
between MALCOLM D. SIMPSON, as Executor and Trustee of the
estate of and under the Last Will and Testament, and Codicil
and Second Codicil thereto, of RACHEL BERGAMINI, late of the
Town of Southold, County of Suffolk, State of New York, de-
ceased, residing at 4633 Delafield Avenue, Riverdale, Bronx
County, New York, party of the first part, and WILLIAM AUGUSTUS
BERGAMINI, residing at 74 Spring Street, Catskill, New York,
HERBERT M. BERGAMINI, residing at (no street address), Lake
Placid, New York, and JOHN VAN WIE BERGAMINI, residing at (no
street address), Rowayton, Connecticut, parties of the second
part,
WITNESSETH:
Thatthe party of the first part, by virtue of the
power and authority to him given in and by said Last Will and
Testament and Codicil and Second Codicil, and in consideration -
of Three ($3.00) Dollars, lawful money of the United States
paid by the parties of the second part, does hereby grant and
release unto the parties of .the second part, their heirs and
assigns forever,
ALL that tract or parcel of land, together
with the building and improvements thereon, situate,
lying and being in Arshamomaque near Southold in the
Town of Southold, in the County of Suffolk, State of
New York, bounded Northerly by Long Island Sound;
Easterly by land owned or formerly of Gloria
Cummings; Southerly by the North Road; and Westerly i
by land now or formerly ofThomas Price, being resi-
dential property containing by estimation one-
eighth (1/8th) of an acre be the same more or less. !''w
TOGETHER with the appurtenances and also the
estate which the said testatrix had at the time of
her decease in said premises, and also the estate
therein, which the party of the first part has or .
has power to convey or dispose of, whether in-
dividually, or by authority of said will and codicils
or otherwise.
TO HAVE AND TO HOLD the.premises herein granted J
unto the.parties of the second part, their heirs and assigns
forever, as tenants in common and notes ,Joint tenants.
