ALL that certain piece or parcel of land, together with the
buildings and improvements thereon, situate, lying and being at
Arshamomoque, in the Town of Southold, County of Suffolk and
State of New York, bounded and described as follows:-
BEGINNING at an iron bolt set on the southerly line of Island View
Lane sixty-five and twenty-four hundredths (65.24) feet westerly
along said southerly line from a concrete monument set at the
northwesterly corner of land conveyed by Frank Horn to Horton Barr,
running thence along other land of Frank Horn two courses as

one-hundredths (91-50) feet to the point of beginning.
The party of the second part shall also have an equal right
with Frank Horn andwith other owners of land along the Creek of
adoess to Peconic Bay.
The party of the second part shall also have as equal right
with Frank Horn and with other persona to whom the said Frank
HOrn may convey to the use for bathing and incidental purposes
of an area fronting on Peconlc Bay for a distance. of two hundred
(200) feet, the northerly line of said area to be two hundred
(200Y feet mouth of the southerly line of land of Horton Be",
and lying between a proposed private road and Peconic Bay.
This conveyance is subject to the following restrictions:

1. Not more than one private dwelling for the use of one family
shall be erected or maintained on said premises and no further
building shall be erected thereon except that additional rooms
may be added to the dwelling now thereon and except a small
irhed, tool house or general utility building or a two car garage
not exceeding fifteen feet in height to ridge pole.
2. No livestock, except domestic pets, shall be kept on the said
premises and no breeding of livestock domestic pate or birds
shall be permitted thereon.
3. No trees shall be*removed from said premises except to allow
for expansion of buildings and except such trees as may require
removal because of disease or other hazard.
And this conveyance is made subject to a mortgags 'now on the
premi Sea held by The First National Hank, Greenport, New York,
(Liber 2240 mp 26) having a total present unpaid balance of
principal in'the amount of $9295.42 and which.said mortgage the
parties of the second part hereto assume and agree to pay as part
of the consideration herein, and the parties of the second part
execute and acknowledge this instrument for the sole purpose of
evidencing their assumption of the aforesaid mortgage debt.
