Dominy 219 Griffing Ave., Riverhead, Suffolk County, N. Y-., �. as-Sheriff, of Suffolk 0ounty,/in the State of New York, party of of 429 Fourth St., Greegnport, Suffolk Count, N. Y., the first part, and Burt's Coal, Inca orated,/party o the second part, WHEREAS, by virtue of a certain writ of Execution issued out of the Supreme Court on the Fourth day of September 19569 on a judgment obtained in an action between Burt's Coal, Incorporated as Plaintiff and Michael 0. Capusno,d/b/a Village i qp Fuel Service, Defendant, on the 4th day of September, 1956 in c� o � favor of Burt's Coal,Inc orp orated and against Michael J. Capuano, m' m d/b/a Village Fuel Service for the sum of Eighteen Thousand, ', wa ' eight hundred forty-nine and 91/100 (x18,549.91) Dollara, as appears by judgment roll filed in the office of the Clerk of the Supreme Court, County of Suffolk, which said judgment was docket- ad in the office of the Clerk of the County of Suffolk, on the fourth day of September 1956, directed and delivered to the said Sheriff, commanding him that out of the personal property of III said judgment debtor in the County of Suffolk, he should satisfy said judgment, and if sufficient personal property could not be found, that then he should satisfy said judgment out of the real property belonging to the said judgment debtor on the day when the said judgment was so docketed in said County, or at any time there- after, in whose hands soever the same might be; and WHEREAS suf- ficient personal property of the said judgment debtor in said County could not be found, the said Sheriff in obedience to the ill command of the said execution did levy on and seize all the j� estate, right, title and interest which the said judgment debtor so bass of in and to the premises hereinafter conveyed and ' described, and on the 22nd day of Niay, one thousand nine hundred and fifty-eight sold the said premises at public vewlue, at the County Court house, Riverhead in the said County, having first given public notice of the time and place of such sale, by advertising the same according to law, at which sale the said premises were struck off to Burt's Coal, Incorporated for 1:" sum of Two Thousand and 60/100 ($200.00) Dollars, he being the highest bidder and that being the highest sum bidden for the same. LloER4734 PAGE377 i WHEREUPON, the said sheriff, after receiving from the said i purchaser the said sum of money so bidden as aforesaid, gave to said Burt's Coal,Incorporated, such certificate as is by law directed to be given and the certificate of such sale was duly filed in the office of the Clerk of the County of Suffolk and WHEREAS the time allowed by statute for the redemption of said premises has expired, NOW THIS INDENTURE WITNESSETH, That the said party of the first part, by virtue of the said Execution, and in pursuance of the act in such case made and provided, and in consideration of the sum of money so bidden as aforesaid, to him duly paid, HATH sold end by these presents DOTH grant and convey unto the said party of the second part, all the estate, right, title and interest which the said defendant had on the 4th day of September, One Thousand nine hundred and fifty six, or any time afterwards, of, In and to ALL Parcel #1 ALL that certain piece or parcel of land with the buildings and improvements thereon situate at Greenport, Town of Southold, Suffolk County, New York, bounded and described as follows: BEGINN)NG at a locust post on the ec.sterly line of Bay.L'oad, 763,22 feet southerly along said easterly line and along the easterly line of Inlet Lane from the southerly line of IAanhanset Avenue, being the southwesterly corner of land of Eugene Spalinger; from said point of beginning running elonp said lane. of Spalinger�,; i at right angles to said easterly line, N.rr038'40" E-165 feet, more or less, to ordinary high water mark of Gull land Inlet; thence southerly along said. high water wank to a point 125.0 feet southerly from the northerly boundary line hereinabove described, measured at right angles thereto, being the northerly boundary of land conveyed by [Michael J. Capuano by Inez Fordham by deeds dated June 5, 1953 and Sgptember 3, 1953 and recorded in Liber 3527 Page 373 and Liber 3700 page 1197. Parcel A2 ALL that certain piece or parcel of land situate at Greenport, SII Town of Southold, Suffolk County, New York, bounded and describe as follows, BEGINNING at a point on the westerly line of Wood Lane, 350 feet in a southerly direction from its intersection with the southerly line of bianhanset Avenue, being also the same point where the northerly line of land conveyed.M//r-about to be c onveyed� to Kenneth Trilcott intersects the westerly line of Wood Lane; running thence N E7005°00" W 100 feet to other land formerly of Inez Fordham; running thence along said land last mentioned N 02055' 00" E - 50 feet; running thence S 87005100" E-100 feet to the westerly line of Wood Lane; running thence S 02055'00" H to the point or place of beginning. BEING AND INTENDED to be the same premises conveyed by Douglas Jacobs and Jean T. Jacobs to Michael J. Capuano and Lois H.
