BEING AND INTENDED to be the same premises conveyed to ANGELO A. ANGELI and IRENE ANGELI, his wife, by Deed dated December 3, 1969 and recorded in the Suffolk County Clerk's Office on December 3, 1969, in Liber 6668 of Deeds, at page 492, and subject to Covenants and Restrictions of record. (Liber 5738 cop 105) 2 THIS CONVEYANCE is subject to a mortgage/held by Southold 'Savings Bank in the amount of $9,000.00, now reduced to $8,793.68. The parties of the second part hereby assume the payment of and agree to pay the unpaid principal balance of the mortgage, and the parties of the second part have executed and acknowledged this instrument for the sole purpose of evidencing such assumption and agreement to pay. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
