LEIB, his wife, eM�+ both residing at 25 Stephen Place, Valley Stream, New York, party of the second part, WITNESSETH,that the party of the first part, in consideration of Tea Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs !tor successors and assigns of the party of the second part forever, # ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, 2 lying and being inAka at Greenport, Town of Southold, County of Suffolk and State of rNew York, known and designated as and by lot number 5, on a certain map entitled, "Map of Eastern Shores at Greenport, filed in the office of the Clerk r of the County of Suffolk, April 27, 1964 as map number 4021, { ` TOGETHER with the beach rights appurtenant to said lot No. -5, granted to 5 the party of the first part herein by deed dated September 22, 1969, and recorded �. in the Suffolk County Clerk's Office in Liber 6650 of deeds page 352. THE conveyance hereunder is subject to a certain mortgage executed by Sanford E. Thornhill and Jane R. Thornhill, his wife, as mortgagors to the Suffolk County Federal Savings and Loan Association, as mortgagee, which mortgage is dated September 10, 1964, and recorded in the Suffolk County Clerk's Office on September 21, 1964 in Liber 4477 of mortgages at page 132 as said mortgage was modified by agreement dated October 21, 1969, which said modification agreement was recorded in the Suffolk County Clerk's y Office on November 14, 1969, in Liber 5725 of mortgages at page 476, and on `? which mortgage as modified there is now due the sum of $17, 167. 83 with interest I { thereon at the rate of 7-1/2% per annum from January 1, 1972, and that the .C3 ; grantees hereby assume and covenant to pay such mortgage debt and interest as rr+ part of the consideration for this conveyance. AND the party of the first part covenants that the party of the first part has not done or suffered anything 3whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party o the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fond to be applied first for the purpose of paying the cost of the improvement and will apple - _ the-same first to the payment of the cost of the improvement before using any part of the total of the same for 'any other purpose. -The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
