APPROVE MINUTES: Approve Minutes of August 26, 1998 Regular
Meeting. TRUSTEE KRUPSKI moved to postpone approval until all
Trustees have had the opportunity to review them, TRUSTEE SMITH
seconded. ALL AYES
I. MONTHLY REPORT: The Trustees monthly report for August
1998: A check for $4,303.98 was forwarded to the Supervisor's
Office for the General Fund.
II. PUBLIC NOTICES: Public Notices are posted on the Town
Clerk's Bulletin Board for review.
III. AMENDMENTS/WAIVERS/CHANGES:
1. Proper-T Services on behalf of ROBERT K. SCRIPPS requests an
Amendment to Permit ~4004 to increase the length of the ramp
from 14' to 16' change the orientation of the float so that it

is perpendicular to the shore instead of parallel to it, and
relocate the two 2-pile dolphins appropriately to secure the

TRUSTEE KRUPSKI: Is there anyone who would like to speak either
for or against the application? The Board looked at this last
week.
CAC: We tabled it because it wasn't staked.
DI~ANE: WaS'it staked when you guys went out?
TRUSTEE FOSTER: There were flags in the trees.
TRUSTEE KRUPSKI: It wasn't clearly staked.
CAC: I think those flags were there to identify the path than
anythin~ else.
TRUSTEE KRUPSKI: We weren't quite sure, however, from what we
saw, th~ wetland line is clearly delineated there, with the
bulkhead. Our feeling was a.30' non-turf buffer a non-clearing
buffer would be adequate to protect the wetlands. Basically the
proposed pool is 80' back so it gives them plenty of room for
activity around the front.
TRUSTEE FOSTER: And to maintain that be~m.
CAC: That must be fill from dredging of the creek.
TRUSTEE KRUPSKI: That's gonna keep anything from washing
directly into the creek.
CAC: So they're gonna leave that there?
TRUSTEE KRUPSKI: Yes. That will be part of the buffer.
CAC: Because if they were to try to level it out obviously it
would be in the wetland.
TRUSTEE KRUPSKI: In this case where there is a bulkhead and a
wetland you never know what they thing the wetland line is, but
the bulkhead makes it very clear.
TRUSTEE SMITH: Move to close the public hearing.
TRUSTEE FOSTER: Second. ALL AYES
TRUSTEE KRUPSKI: I'll make a motion that we approve the
application provided that from the bulkhead landward there be a
30' non-turf/non-fertilized buffer.

a single family dwelling with septic ystem, driveway & deck.
Located: 485 Orchard Lane, Southold. SCTM #89-2-7
TRUSTEE KRUPSKI: Is there anyone who would like to speak in
favor of the application?
~RTIN ~RAL~: I'm here to speak in favor of the application?
TRUSTEE KRUPSKI: The Board inspected the site and we had a few
concerns there. There was a problem with the wetland line. If

,you could come up here for a few seconds I'll explain the
concerns we had. The wetland line measured here is 75', but the
wetlands come up here (indicating on the survey) and it was like
45' right here and go out to the neighbors property.
MR. KRALL: There is another copy of the survey with the
adjoining property. The wetlands come down like this and it
might explain a little bit better. There is in our favor, there
is a lot less wetland here than there is next door. There is
all woods here.
TRUSTEE KRUPSKI: What we did on the last application we impose
a buffer between the wetlands and your house. You can't disturb
it at all. If you want to ask this lady if you could trim some
trees for a view that's understandable. We don't want the trees
taken out and we don't want the soil disturbed in that area. So
the 75' is accurate here but it's not accurate right here
(indicating on survey).
MR. KRALL: We're not doing anything there. It's the end of the
house.
TRUSTEE KRUPSKI: I know, but we're concerned about is the fill
that is gonna be brought in and how it's gonna affect run off
onto your neighbor, and how your gonna put a house there by the
haybales.
MR. KRALL: We were very much in touch with the people out here
as far as how close we could build to the water and we were told
what the setbacks were and we went to the local surveyor and
then I said to move it back to 75'. We were told we could build
outside that envelop or within that envelop. Up until this
point I think we tried to do everything by the book.
TRUSTEE KRUPSKI: We don't have a problem with that.
TRUSTEE FOSTER: 75' is kind of a non-disturbance area. I do
this for a living and I .....
MRS. KRALL: I was there when he (the surveyor) put these things
on. He did it very ...... he just went so fast, the haybales. He
just put them there.
TRUSTEE FOSTER: When you go to build a house right in here and
put in a foundation I don't know how your gonna stay behind the
haybales. You kave an over cut and your pouring a foundation in
here. If you put in yards and yards of fill in there your gonna
create all kinds of run off.
TRUSTEE KRUPSKI: If you want to push the haybales ten or
fifteen feet this way (indicating towards the water) because you
need room to work in there.
MRS. KRALL: That's what I'm trying to say, I saw him do this
and he just said you need haybales there. He just plopped them
down anywhere and I understand what you are saying that he
shouldn't have done it that way.
TRUSTEE KRUPSKI: It doesn't work that way. It's impossible.
TRUSTEE FOSTER: See what happens if you get approved like this,
you have to live with this. You can't work any further than
these haybales. If you apply to us to put the haybales out 10
or 15 feet further and we approve that, that gives you room to
work with.
MRS. KRALL: Is that the problem?

TRUSTEE FOSTER: That was one of the reasons unless they come in
with a helicopter they're not gonna do the job.
TRUSTEE KRUPSKI: You just have to put the haybales on the
survey. Another it gives you room to grade away from the
foundation area. You need room to work around there. You can
grade no further than the haybales.
MR. KRALL: What we want to do is...we guessed at the 1,000
yards because I went to the architect and we worked off these
elevations and I put plus and minus on the application because
it says more or less. What I want to do is bring it up to the
8' elevation. That's the elevation we need here to have for
living space. I want to have living space on the bottom floor
if we can.
TRUSTEE FOSTER: Bottom floor meaning basement area?
MR. KRALL: No, the lowest floor.
TRUSTEE FOSTER: The foundation area. So you can elevate this
your gonna have a bathroom down there and you have to get
gravity and pitch out to the septic system and you have to be
three feet above water.
MR. KRALL: Basically we're gonna build a foundation on the
ground and backfill around it up to the height so the ground
floor level is 8' elevation.
TRUSTEE KRUPSKI: So what you hame to show us then is the new
haybale line and a new grading plan. Is the foundation just
gonna stick out there? Will it be filled against the foundation?
MR. KRALL: Not really. We have a deck here. I didn't plan on
disturbing the ground with this in mind.
TRUSTEE KRUPSKI: That's fine because that shows the fill lines.
MR. KRALL: It might be up. The inside will be ...... The
architect is working on this right now. I told him to stop
because I didn't know where we were gonna go from here tonight.
CAC: We had approval and there's no comments. When we say it
before we had noted the same thing about the line and footage.
MR. KRALL: The DEC wants to see more. They want to see where
the cesspools are gonna be and they didn't ask for that in the
beginning and where the driveway will be.
TRUSTEE SMITH: I'll move to close the hearing.
TRUSTEE POLIWODA: Second. ALL AYES
TRUSTEE FOSTER: I'll move to approve the application subject to
having haybales moved 15' towards Driad's Basin and indicate
containment for roof runoff on the plan.
TRUSTEE POLIWODA: Seconded. ALL AYES
7. ~i~tN~NDT~requests a~e~land 'permit t% relocate
basement storm door from western side of house to southern side,
remove existing porch and replace with a 12' X 20' enclosed
room, a raised 12' X 28' deck to same height as enclosed room, a
roof over an 8' X 5' porch and replace steps in front of house
with new steps. Located: 980 Deep Hole Drive, Mattituck. SCTM
#115-12-14
TRUSTEE SMITH: Artie you looked at thisTRUSTEE FOSTER: I did
and I don't see a problem with this. All the information shown
on this is correct.
TRUSTEE SMITH: I recommend we close the hearing.
