THIS INDENTURE, made the day of May, 1965, between BEOLAH E.
SCHOON6LAKER, residing at 8712 Whetstone Road, Evansville, Indiana,
party of the first part, and LESTER Y. CLERKE, residing at 84-02
' 165th Street, Jamaica, New York, party of the second part,
WITNESSETH, that the party of the first part, in consideration of
Ten Dollars and other valuable consideration paid by the party of
— the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party
of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings
and improvements thereon erected, situate, lying and being partly
in and partly outside of, the Village of Greenport, in the Town
o£ Southold, County of Suffolk, and State of New York, bounded and
described as follows:

corner of said incorporated Village of Greenport; thence along
other lands formerly of said Inez Fordham, being Parcel #2 herein,
South 34 degrees 20 minutes East, 131.50 feet to a point on the
s high water mark of Greenport Harbor, as shown on Giant by the Statk
of New York to said Inez Fordham dated May 18, 1934; thence along
jsaid high water mark, three courses, as follows:
1. S 7 degrees 10 minutes East 55.0 feet, thence
2. N 75 degrees 22 minutes West 160 feet, thence
_I3, N 82 degrees 12 minutes West 57.85 feet to the south
easterly corner of said land of Isabella G. Lawton; thence along

West, Two hundred Twenty and 76 one-hundredths (220.76) feet to th
point or place of beginning.
EXCEPTING THEREFROM the premises heretofore conveyed by

TOGETHER with a right of way for the purposes of ingress

the northerly part of said land heretofore conveyed to said Isabel
Lawton and Norman W. Andrews and wife, to Beach Place, a public
street in said village of Greenport for uses and purposes as set
forth in deeds of record,

Ali SUBJECT to a right of way conveyed to the village of
Greenport as set forth in Liber 2430 of conveyances page 321
� SAID PREMISES BEING the same premises as described in
Parcel 1 in deed from Inez Fordham to Beulah E. Schoonmaker dated
October 31, 1947 and recorded in the Suffolk County Clerk's office
on November 6, 1947 in Liber 2772 cp 173, excepting the land here-
tofore conveyed to Andrews.

BEGINNING at a concrete monument set in the northeaster-
', ly line of other property of Beulah E. Schoonmaker (Being Parcel
#1 herein), said line being the northeasterly boundry of the In-
corporated Village of Greenport, at that point, said monument bein
51.42 feet, measured along said line, northwesterly from the monu-I
ment set at the southeasterly corner of said Incorporated Village pf
Greenport; running thence North 85 degrees 38 minutes 40 seconds
- East from the true meridian on a straight line, which said straight
line if projected westerly would meet the easterly line of the
Village Street known as Beach Place at a right angle, one hundred
(100) feet through an iron pipe, set as a monument, and continuing
on a straight line twenty (20) feet, more or less, to ordinary hig
water mark of Gardiners, or Marion,Bay; running thence southerly
along the ordinary high water mark of said bay, approximately one
hundred seventy-two (172) feet to other land of said Beulah E.
- Schoonmaker (being parcel #3 herein); running thence northwesterly,
along said other land of said Beulah E. Schoonmaker (being partly
along parcel 3 herein and partly along parcel #1 herein) approxi- li
mately one hundred sixty feet, more or less, to a monument set at
the southeast corner of said Incorporated Village of Greenport,
running thence North 54 degrees 33 minutes, 50 seconds West 51.42
feet to the point or place of beginning. The foregoing descriptio
was prepared by Otto W. Van Tuyl, licensed surveyor, from surveys
made, and monuments set by him.
- Together with all the right, title and interest of the
seller in the waters, or lands under the waters of that part of
Gardner's or Marion, Bay, adjacent to the above described premises.
BEING the sane premises as conveyed by Inez Fordham to
Beulah E. Schoonmaker by deed dated December 30, 1948 and recorded
in the Suffolk County Clerk's office January 24, 1949 in Liber 291
of conveyances at page 206
PARCEL #3 All of the right, title, and interest of the seller
of in and to the following:
ALL that parcel of land now or formerly under the waters
- of Greenport Harbor in the County of Suffolk, State of New York
- that was granted to said Inez Fordham by the State of New York by
Letters Patent dated May 18, 1934 and recorded in Book of Patents
No. 68 at Page 42 and recorded in the Suffolk County Clerk's offic
on June 11, 1934, save only that portion of said land heretofore
conveyed to said Isabella G. Lawton, by deed aforesaid, which re-
maining portion is bounded and described as follows: Beginning at
a point on the ordinary high water line of Greenport Harbor as of

May 18, 1934 at the south west corner of the premises hereinabove
_y described and being the southeast corner of land Of said Isabella

1. South 82 degrees 12 minutes East 57.85 feet,
thence 2. South 75 degrees 22 minutes East 160 feet,
thence 3. North 7 degrees 10 minutes West 55 feet to a concrete
monument; thence as of May 18, 1934 through the waters of Greenpor
Harbor four courses as.follows:
1. South 37 degrees 30 minutes East 142 feet, thence
2. South 38 degrees 29 minutes East 180 feet, thence
3. North 84 degrees_ 12 minutes West 433,62 feet to the
southeast corner of land under waters-£ said Isabella G. Lawton,
thence 4. North 7 degrees 45 minutes East 205.24 feet along
said land of Isabella G. Lawton tothe pont of beginning.
Containing 1.51 acres, more or less, together with all
upland new included in the foregoing description.
EXCDPIING therefrom that portion of said premises, if an
heretofore conveyed to Norman W. Andrews and wife
BEING the same premises as Parcel #II in the aforement. P
ed deed made by Inez Fordham to Beulah E. Schoe maker dated October .
31, 1947, recorded November 6, 1947 in Liber 2772 ep 173, except
the said portion thereof heretofore conveyed to Andrews.
TOGETHER with all right, title and interest, if any, of the party
of the first part in and to any streets and roads abutting the
above described premises to the centre lines thereof, TOGETHER
with the appurtenances and all the estate and rights of the party
- of the first part in and to said premises; TO HAVE AND TO HOLD
- the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the
first part has not done or suffered anything whereby the said
premises have been encumbered in any way whatever, except as afore
said.
AND the party of the first part, in compliance with Section 13 of
the Lien Law, covenants that the party of the first part will re-
ceive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first
for the purpose of paying the cost of the improvement and will app y
the same first to the payment of the cost of the improvement befor
using any part of the total of the same for any other purpose.
The word '1paty" shall be construed as if it read "parties'' wheneve
the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed
this deed the day and year first above written.
