party of the first part, and Claudio Giovannelli, residing at 306 Sixth Street, Greenport,
New York,

WITNESSETH, that the party of the first part,in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and si s.of the rtv of the second part forever, all of his undivided one-half

ALL that certain plot, piece or parcel of lard, with the buildings and improvements thereon erected, situate,
lying and being in the Town of Southold, County of SuTfolk and State of New York,
bounded and described as follows:
BEGINNING at a concrete monument set on the southerly line of the Main Road
d (State Rt. 25) at the northwesterly corner of land now or formerly of Brown and
the northeasterly corner of land now or formerly of Johnson; running thence along
the southerly line of said Main Road, north 77°54140" east, 200 feet; thence along
other land now or formerly of Brown, two courses, as follows: (1) south 1020130"
west, 300 feet; thence (2) south 77°54140" west, 200 feet to said land of Johnson;
thence along said land, north 1°20'30" east, 300 feet to the point or place of
beginning.
BEING and intended to be the same premises conveyed by Robert R. Brown to
Frederick L. Schultze and Claudio Giovannelli by deed dated June 9, 1960,recorded
June 13 , 1960 in the Suffolk County Clerk's office, liber 4823 of conveyances,
page 459.
SUBJECT to (1) any state of facts an accurate survey might show; (2) covenants,
restrictions, easements, agreements, reservations, and zoning regulations of
record, if any; and (3) to a mortgage made by and between the grantees in the
aforesaid deed and the North Fork Bank and 'frust Company, dated March 1,
1963, recorded March 5, 1963, in said County Clerk's office, liber 4055 of
mortgages, page 368, originally in the amount of $20, 000 and modified and
extended by agreement between said parties, in that amount, dated December 3,
1963, recorded December 18, 1963, in said County Clerk's office, liber 4272 of
mortgages, page 225, which said mortgage the party of the second part herein,
Claudio Giovannelli, agrees to assume and pay, and to that end executes and
acknowledges this indenture.
TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HA AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, Covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
