THIS INDENTURE, made the 28th day of May nineteen hundred and seventy BETWEEN ROBERT H. PRESTON, residing at Middleton Road, Greenport, New York, ` party of the first part, and JOHN COSTELLO and SARA COSTELLO, his wife, bpth residing at Wiggins Lane, Greenport, New York, O� party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable con- sideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being)iix tbax East of the Village of Greenport; in the Town of Southold, Suffolk County, New York, designated as parts of lots Nos. 23, 24, and 25 on a certain map entitled "Map of Section Two Fordham Acres at Greenport; Town of Southold, Suffolk County, New York" and filed in the Suffolk County Clerk's CD Office on the 6th day of April, 1966, as Map No. 4605 and bounded and described as follows: BEGINNING at a concrete monument set on the easterly line of Wiggins Lane distant 200, 0 feet southerly along said easterly line from the intersection of said 'A0 easterly line with the southerly line of North Road, said point of beginning being the northwesterly corner of lot No. 23 as shown on said map; from said point of © beginning running thence along land now or formerly of Ernest Wiggins, North #_ 66 degrees 01 minutes 20 seconds East 284. 03 feet to a concrete monument and ° land now or formerly of Yuma Corp. ; running thence along land last mentioned South 21 degrees 26 minutes 20 seconds East 110. 11 feet to land now or formerly of the party of the second part; running thence along land last mentioned South 66 degrees 01 minutes 20 seconds West 279. 15 feet to said easterly line of Wiggins Lane; running thence along said easterly line of Wiggins Lane North 23 degrees 58 minutes 40 seconds West 110. 0 feet to a concrete monument and the point or place of beginning. BEING and intended to be a portion of the premises conveyed by Ruth F. Preston, Ida Belle Latham and Robert L. Muir to Robert H. Preston, the party of the first part herein, by deed dated April 17, 1968 and recorded in the Suffolk County Clerk's Office on May 24, 1968 in Liber 6353 of deeds at page 10. r TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to The center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered any- thing whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of,the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
