ALESSI, residing at 115 Sussex Road, Elmont, New York, party of the first part,and VINCENT CAPARELLI and GLORI&APARELLI, his wife, both residing at 235 Jericho Turnpike, New Hyde Park, New York, party of the second part, WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable con- sideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being budkK at Silvermere near the Village of Greenport, in the Town of Southold, County of Suffolk and State of New York, bounded c.c and described as follows : CN.P BEGINNING at a point where the northerly line of a private road known as Silver Lane intersects the easterly line of land of Harry G. Steinmetz; running thence north 30 45 ' 00" east 98.66 feet to a point on the curved southerly line of a fifty foot private roadknown as Shore Drive; thence easterly along said curved southerly line of Shore Drive on a curve to the right having a radius of 2782 feet a distance of 58.78 feet to other land now or formerly of Clarence C. Roach and Adeline Me Roach; running thence along land last mentioned south 30 451 00" west 116.99 feet to the northerly line of Silver Lane; running thence along the northerly line of Silver Lane north 850 31t 40" ,y west 56.0 feet to the point or place of beginning. 4 > TOGETHER with a right of ingress and egress over Silver Lane, a tl private road 20 feet in width running along the southerly line of the premises hereinbefore described and through the land now or formerly of Charles Bashwiner and Amelia Bashwiner, grantors in deed dated June 4, 1962, recorded in liber 5178 page 07,in a general easterly direction to Silvermere Road, said right of way to be perpetual and to run with the land hereinbefore described. SUBJECT to covenants and restrictions of record, if any. SUBJECT to any state of facts an accurate survey may show. SUBJECT to the rights of othersover the right of way set forth herein. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HA17E AND TO HOLD the premises herein granted unto the party of the second part, the heirs or succ us and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered any- thing whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the-first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. he word "party" shall 5e construed as if it read "parties" whenever the sense of this indenture so requires.
