ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying
and being in the SEE SCHEDULE "A" ATTAC~
Being and Intended To Be part of the same premises described in the deed to the
parties of the first part herein by deed dated 9-4-81 recorded 9-11-81 in
Liber 9068 page 207.
An easement is reserved for grantors, their successors and/or assigns along
that portion of the property adjoining the driveway designated to serve
the three waterfront lots for the sole purpose of insgall%ng agd. maintaining,
a gate across said driveway(s). This easement shalllpermit~t~e constrRcti0B~
of necessary support structures and associated appurtenanc'es,includ~ng,
but not limited to utilities. For clarification, the waterfront lots are lot
numbers 42, 43 and 44 on the Map of Angel Shores situate at Bayview, Town of
Southold which map was filed on 8-23-95 in the Office of the Clerk of Suffolk
County as Map No. 9729.
TOGETHER with all right, title anti interest, if any, of the party of the first part of, in and to any streets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive tile consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

County as Map No. 9729, being more particularly described as follows:
BEGINNING on the westerly side of Avenue of Trees at the intersection forming the
division line between Lots 41 and 42 on Filed Map No. 9729;
THENCE along the last meritioned division line, North 78 degrees 43' 01" West
156.61 feet to a point;
THENCE South 29 degrees 56' 53" West 247.54 feet to the northerly side of a 50'
wide right of way known as Sunset Lane;
THENCE along the 50' wide right of way known as Sunset Lane, South 67 degrees 35'
20" East 142.10 feet to a point;
THENCE North 35 degrees 02' 40" East 261.91 feet to the westerly side of Avenue of.
