BITTNER, residing at Centerport, New York, J party of the first part, and WARREN T. BITTNER and BARBARA B. BITTNER, his wife, both residing at Centerport, New York v 40 party of the second part, a d v WITNESSETH,that the party of the first part, in consideration of ten dollars paid by the party of the second LL ac part, does hereby remise, release and quitclaim unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lyiag and being in the Village of Greenport, Town of Southold, County of Suffolk and State of New York, bounded and described as follows : BEGINNING at a concrete monument set on the northwesterly line of the North Road (CR 27) at the southeasterly corner of land formerly of J. Halligan and the southwesterly corner of the premises herein described; and running along said land formerly of J. Halligan, two courses, as follows : (1) N. 220 331 4011 W. 129.46 feet; thence (2) S. 730 501 20" W. 100 feet to land now or formerly of Mrs. Eva Ban�ss; thence along said land now or formerly of Mrs. Eva Bangs, N. no 421 10" W. 560 feet, more or less, to the ordinary high water mark of Long Island Sound; thence northeasterly along said ordinary high water mark of Long Island Sound, 200 feet, more or less, to land now or formerly of Daisy Dodge; thence along said land now or formerly of Daisy Dodge, S. 200 411 40" E. 660 feet, more or less, - to a concrete monument set on said northwesterly line of the North Road (CR 27) thence along said northwesterly line of the North Road (CR 27) two courses, as follows : 1) S. 360 331 20" W. 106. 06 feet; thence (2) S. 480 061 10" W. 145.2 feet to the point of BEGINNING. Containing three and seven tenths (3.7) acres, more or less. BEING AND INTENDED TO BE the same premises conveyed by LENA M. BERNSTON to the parties of the second part, by deed dated August 4th, 1958 and recorded in the Office of the Clerk of Suffolk County on August 6th, 1958 in Liber 4496 at Page 74. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part,in compliance with Section 13 of the Lien law,hereby covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
