JURGENS and EDITH L. JURGENS, his wife, residing at (no street #) Tuckers Lane, Southold, New York party of the first part, and HENRY C. WEISMANN and CHARLOTTE H. WEISMANN, his wife, residing at 41A Moriches Road, St. James, New York party of the second part, WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, ppi�ece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New York, known and designated as Lot No. 36, as shown on a certain map entitled "Map of Southold Shores at Arshomomaque, Town of Southold, Suffolk County, New York" made by Otto W. VanTuyl and Son, licensed land surveyors, Greenport, N. Y. , dated July 1, 1963, and filed in the office of the Clerk of the County of Suffolk, N. Y. on August 29, 1963, as Map No. 3853. TOGETHER with the right to use, in common with others, Lot #52, as shown on the filed map for the purpose of bathing and beach activity and the right to use, in common with others, the boat basin for the purpose of mooring and anchorage of pleasure boats therein. C4 TOGETHER with an easement for ingress and egress over the streets shown on / c� C I,- said filed map to the nearest public road. L') SUBJECT to any state of facts an accurate survey might show, and to covenants, h I restrictions, easements, agreements, reservations and zoning regulations of \i record, if any . V f X \j TOGETHER with all of the right, title and interest of the party of the first part, if any, of and to lands lying below the high water mark and the boat basin and any and all islands or bars therein. y w ¢ TOGETHER with all right, title and interest if any, of the party of the first part in and to any streets and roads abutting the above described premises 4the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
