\' WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
ik or successors and assigns of the party of the second part forever,
CALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
s lying and being*x*K at Arshamomoque in the Town of Southold, County of Suffolk
and •State of New York and bounded and described as follows :
BEGINNING at the northwesterly corner thereof at a point formed by the
intersection of the southerly line of lands of the Long Island Railroad
Company with the easterly line of Kerwin Blvd. , so called, as shown on
a certain map entitled, "Amended Map A, Peconic Bay Estates situate at
Arshamomoque, Town of Southold, New York" made by Otto W. Van Tuyl
under date of May 12, 1933 and filed in the Suffolk County Clerk's
Office as Map No. 1124, RUNNING THENCE along the southerly line of lands ,
of said Long Island Railroad Company, North 55 degrees 01 minutes East
268 feet to a gutter as shown on said Map No. 1124; THENCE southeasterly'
along said gutter and continuing along the southwesterly high water
mark of the Creek as shown on said Map No. 1124 in a general south-
easterly direction to a point, said point being land now or formerly
of Wm. S. Clarke and Marjorie M. Clarke; FROM said point South 550
01' 00" West a distance of 390 feet more or less to the easterly line
of Kerwin Blvd; THENCE along the easterly line of Kerwin Blvd. North
34059 ' 00" West a distance of 336.34 feet to the point or place of ,
BEGINNING.
BEING AND INTENDED to be the same parcel as conveyed to the party,of
the first part by that certain deed dated November 19, 1970 and
recorded in the Suffolk County Clerk's Office on November 24, 1970
in Liber 6844 at page 439.
SUBJECT HOWEVER, to a purchase money mortgage in the principal sum of
'$26,300.00 intended to be recorded simultaneously herewith.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything A
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
-the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
