feet to a parcel of beach fronting on Pipes Cove; said beach being
about 50 feet on said 25 foot private road, about 75 feet on said
Pipes Cove and about 140 feet in depth.
TOGETHER with a right to use the "Community Beach" which said
"Community Beach" shall be reserved solely for the purpose of recrea-
tion and use of the various owners of properties known as 'Cove Circle"'
and shall be subject to such reasonable rules and regulations as the
parties of the first part, or their successors or assigns may imposa; , "
SUBJECT TO THE FOLLOWING COVENANTS AND RESTRICTIONS:
1. No fence or hedge shall be erected or permitted upon said premises -
exceeding four (4) feet in height.
2. No building or other structure shall be erected or permitted which;`:'
measured from its main foundation walls, shall be within ten (10) feet
of any lot, boundary or property line.
3. The premises of any structure thereon shall be used solely for
residential purposes, and shall not at any time be used for the pur
pose of any trade, manufacture or business of any description, nor
shall anything be maintained, carried on, suffered or permitted upon
the premises or any part thereof, which shall be dangerous, noxious
or offensive, provided, however, that the land may be cultivated for
private garden and landscape purposes.
4. That only such animals as are commonly considered as the customary , :
domesticated pet type shall be kept on the premises .
5. The parties of the second part further understand that the property
aforementioned is located within a private development known as :'Cove
Park" , and therefore, agrees that in the event an association of
owners is formed, said parties of the second part will subscribe to
and become a member of said association, and further agrees to abide `
by and be governed by all the rules and regulations that may be pro-
mulgated by said association.
6. That dwelling erected shall contain a minimum of 800 square feet, :E
and shall not exceed two (2) stories in height.
7 . That at no time shall vehicles be parked on any part of the privrate
road, nor shall said road be obstructed or encumbered by objects or r
materials of any kind or nature.
8. That in order to promote the good general appearance of the de-
velopment, all buildings erected must have the finished siding and
finished roof affixed and installed, within six (6) months after the
commencement date of the erection of said structure.
9.Together with and subject to an easement for ingress and egress over
the private road, sometimes referred to as the extension of Clark
Street, into Sixth Street, Greenport, Town of Southold, County of {
Suffolk, New York, and also to the 25 foot private road sometimes re-
ferred to as Elsworth Circle.
10. No structure of a temporary 'charaoter such as a trailer, base-
ment, tent, shack, garage or other outbuilding shall be used as a
residence on a residential plot either temporarily or permanently nor
shall .any dwelling under construction be permitted to be used as a
residence until the outside and roof have been fully and completely
finished and painted.
