Witnesseth, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by
the party of the second part, does hereby grant and release unto the party of the second part,the heirs or successors

All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,situate,lying and
beinginthe Town of Southold, County of Suffolk, State of New York, and
more particularly described as follows : Beginning at a point on the
southerly line of Main Road on the westerly line of a private road
known as "Maple Lane", said point being the northeasterly corner of the
rremises herein described: running thence along said westerly line of
"Eaple Lane" , two courses :
(1) S. 420 00 ' E. — 280.68 feet ; thence
(2) S. 310 30 ' E. - 110.20 feet to Lot 81, shown on "I`iap of
Cleaves Point, Section III" filed in the Suffolk County Clerk 's office
as Map #4650; thence along Lots 81, 80, 79, 78 and 77, shown on said
map, S. 66° 39 ' 50" W. - 505.35 feet to land now or formerly of Yuma
Corporation; thence along said land, N. 21' 04 ' W. - 225.29 feet to
land of Charles King; thence along said land of King, two courses :
(1) N. 660 39' 50" E. - 50.0 feet ; thence
(2) N. 210 04' W. - 150.0 feet to said southerly line of Main
Road; thence along said southerly line , N. 66° 39 ' 50" E. - 335.0 feet
to the point of beginning.
Together with a right of way over said Maple Lane 50 feet in width
from the southeasterly corner of the premises northerly to Main Road.
Being the same premises conveyed by BERNARD KAPLAN and THEODORE KAPLnN,
N a co-partnership d/b/a DAWN ESTATES SHOPPING CENTER, by deed dated
December 7, 1976 and recorded December 10, 1976 in Liber 8156 cp 171,
and by correction deed dated November 3, 1978 recorded November 15, 1978
in Liber 8533 cp 190.
j Subject to a purchase money first mortgage in the amount of $26,300.00
bearing interest at the rate of 8;o per annum which mortgage is intended
to be recorded simultaneously herewith.
Together with a!I right,title and interest, if any, of the party of the first part in and to any streets and roads abutting
the above described premises to the center lines thereof; Together with the appurtenances and all the estate and
rights of the party of the first part in and to said premises;To Have And To Hold the premises herein granted unto the
party of the second part,the heirs or successors and assigns of the party of the second part forever.
Q And the party of the first part covenants that the party of the first part has notdone or suffered anything whereby the
said premises have been encumbered in any way whatever,except as aforesaid.
And the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the pay.
ment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party"shall be construed as if it read"parties"whenever the sense of this indenture so requirei.
