party of the second part,
WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the
ALL that certain piece or parcel of land, situate and being at
Arshamomoque, Town of Southold, Suffolk County, and State of
New York, bounded and described as follows:
BEGINNING at a point on the north side of North Road as widened,
which point is the southeasterly corner of land conveyed by the
late Anthony Demmerle to Joseph A. Kaberle by deed dated May 16,
1944, and recorded in the Suffolk County Clerk' s Office on
May 18, 1944 in Liber 2358 of deeds at page 540; running thence
North 31 degrees 45 minutes West and along the easterly boundary
line of the land so conveyed by Anthony Demmerle in his lifetime
Fra to Joseph A. Kaberle, as aforesaid, 262.32 feet to Long Island
Sound; running thence easterly 71. 02 feet along Long Island
Sound to the land formerly of Emily Smith and now or formerly
of M. Smith; running thence South 31 degrees 45 minutes East
CLOCK and along last mentioned land 260.00 feet to the northerly
side of North Road, as widened; running thence South 47 degrees
f 59 minutes West along the northerly side of North Road, as
widened, 56 .80 feet; and running thence South 61 degrees 57
LOT minutes 30 seconds West and along the northerly side of North
Road, as widened; 14 .82 feet to the point or place of BEGINNING.
Being the same premises conveyed to the party of the first
part by deed recorded in Liber 6381 page 549 in the Suffolk
County Clerk ' s office.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streehs and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first pant covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
pQ the same first to the payment of the cost of the improvement before using any part of the total of the same for
M any other purpose.
7 The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
