Glover, residing at 65255 North Road, Greenport, New York, tor party of the first part, and Chester Konarski and Josephine Konarski, his wife, both residing at 10 Middleton Road, Greenport, New York, y�o party of the second part, It WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot,_piece or parcel of land, with the buildings and improvements thereon erected, situate, 1~ lying and being in the Town of Southold, County of Suffolk, State of New York, shown and desigrsated un a map eiiiitieti, lyiviap of Fluetfieid, Town of , ta7 Southold", as and by lot 5, §2, which said map was filed in the office of the Clerk of the County of Suffolk as map #1351, February 6, 1942; ALL that certain piece or parcel of land situate, lying and being in the °.� Town of Southold, County of Suffolk, State of New York, shown and desig- nated on a map entitled, "Map of Fleetfield, Town of Southold", bounded and described as follows: beginning at a northwesterly corner of lot 5 as shown on said map; running thence in a general northerly direction and along the easterly line of Middleton Road, a distance of 30 feet; running thence in a general easterly or southeasterly direction to a point 20 feet northerly from the northeasterly corner of lot 5 as shown on said map; running thence in a general southerly direction to the northeasterly comer of lot 5; running thence in a general westerly direction, along the northerly line of lot 5, to the point or place of beginning. Said premises being part of lot 4 as shown on said map• — BEING and intended to be the same premises conveyed to the party of the first part by deed made by Donald F. Glover, dated June 8, 1960, recorded June 10, 1960, in said County Clerk's office, liber 4823 cp 407. SUBJECT to (1) any state of facts an accurate survey might show; (2) cove- nants, restrictions, easements, agreements, reservations and zoning reserva- tions of record, if any; (3) a mortgage made by Donald F. Glover to The First National Bank of Greenport, recorded in said County Clerk's office, upon which there is due and owing, as of July 1, 1976, the principal balance of $1847. 09, with interest, which the party of the second part agrees to assume and pay, and to that end joins in the execution and acknowiedge- e t. this st um,nt. I ( 1 t LK with a ng1tt, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
