CATANESE , residinat 336 Burkhard Avenue , ` Mineola, New York and PATSVATANESE , residing at 301 Rose Lane, Smithtown , New York, �. party of the first part, and MURRAY JACOBS and SELMA JACOBS, his wife, both residing tp at 5 Diamond Drive, Plainview, New York , 3 3,00 party of the second part, WfrNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, - lyingandbeingbaftm at Arshmomoque, in the Town of Southold, County of i Suffolk ,and State of New York , more particularly- bounded- and described ` as `follows : BEGINNING at a monument set in the southerly side of a traveled Right of Way 16 feet wide and distant 1240 feet more or less easterly as measured along the southerly side of Right of Way from the easterly side of Main (State) Road, said monument marking the northwesterly corner of land formerly of Sage and now of Suda ; thence running south 24 degrees 48 minutes 50 seconds west along last mentioned land 133 feet more or less to the shore of the Basin , so called; thence running westerly along the shore ,of said Basin 120 feet more or less ; thence running north 24 de- grees '48 minutes 50 seconds east along the lands of Sage 100 feet more or less to a monument set on the southerly side of said Right of Way ; thence running south 65 degrees 11 minutes 10 seconds east along said southerly side of said Right of Way 118 feet to the monument at the point' or place of beginning. Grantors herein are the same persons as the grantees in deed dated 10/16/72 recorded 10/23/72 in liber 7266 cp 226 . SUBJECT to any state of facts an accurate survey may show. SUBJECT to covenants , restrictions and public utility and highway ease- ments contained in former instruments of record , if any. TOGETHER with a right of way for ingress and egress in common with others over the said right of way on which the premises abut, from the northeasterly corner of said premises in a westerly direction out to Main Road. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the sante for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
