HALLER, residing at 45—C Bayview Avenue, �Jl \ RD #2, Southold, New York 11971, party of the second part, WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, DISTRICT: lying and being immix at Arshamamoque, in the Town of Southold, County of 100 U Suffolk, State of New York, shown, known and designated as Lots #84 and 85 on a certain Map entitled, "Map Snowing Subdivision of Property known as Summer Haven Belonging to William G. Herx, near Southold, Suffolk County, N.Y. , Surveyed December 4 , 1931 SECTION: by L. Wendell Squire, C.E. " and filed in the Suffolk County Clerk's Office on July 5 , 1933 as Map No. 1¢33. -y The said premises are bounded and described, with BLOCK: reference to said map as follows : On the southwest by the north- easterly line of Bayview Avenue a distance of Fifty (50) feet; on the northwest by the southeasterly line of Lot #86 a distance of One-Hundred Fifty (150) feet; on the northeast by land of LOT: Frank N. Tillinghast a 'distance of Fifty (50) feet and on the southeast by the northwesterly lien of Lot #83. TOGETHER WITH all of the right, title and interest of the party of the first part in and to the land lying in Bayview Avenue in front of and adjoining said premises to the center line thereof. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part and Walter Haller by Catherine M. ' Cassidy by Deed dated March 20 , 1953 recorded at the Suffolk County Clerk's Office at Liber 3491 cp 119 March 24 , 1953; it being a fact that said Walter Haller died June 2 , 1976 at the Eastern Long Island Hospital , 201 Manor Place, Greenport, Suffolk County, New York 11944. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVEASID TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and a4 lgns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the salve for any other purpose.' The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
