This Indenture, made the ya day of NovembeP,
in the.year nineteen hundred and eighty between JACK KAPLAN
and JILL KAPLAN, both residing at 220 Edgewood Avenue, Smithtown,
11787, and BARBARA KAPLAN, DEBORAH KAPLAN and PHYLLIS KAPIAN, all
residing at 26 Dawn Drive, Smithtown, New York 11787.

AND WREREAS. the said party of the first part, at the request of the party of the
second part, has agreed to give up and surrender the lands hereinafter described unto the party of
the second part, and to hold and retain the residue of the mortgaged lands as security for the money
remaining due on the said mortgage.
NOW TRIS INDENTURE WITNESSETR. that the said party of the first part,
in pursuance of said agreement, and in consideration of TWELVE THOUSAND SEVEN HUNDRED
TWENTY-EIGHT AND 00/100-------------($12,728.00)-- ---------- Dollars,
lawful money of the United States paid by the party of the second part does grant, release and quit-
claim, unto the party of the second part, all that part of said mortgaged lands described as follows:

BEGINNING at a point on the northeasterly side of Maple Lane (a
Private Road) where the same is intersected by the southerly side
of land now or formerly of North Fork Equities, Inc. , said point
of beginning being distant, 290.39 feet southeasterly as measured
along the northeasterly side of Maple Lane, from thecorner formed
by the intersection of the northeasterly side of Maple Lane with
the southerly side of Main Road (State Road);
RUNNING THENCE from said point or place of beginning along the
southerly side of land now or formerly of North Fork Equities, Inc. ,
North 55 degrees 25 minutes 20 seconds East, 171. 17 feet to land now
or formerly of R & Z Kaplan;
THENCE RUNNING along—said last mentioned land, South 34 degrees
34 minutes 40 seconds East, 289. 98 feetto other landnow or formerly
of North Fork Equities,' Inc. ;
RUNNING THENCE along said last mentioned land, South 55 degrees
25 minutes 20 seconds West, 186. 74 feet to the northeasterly side
of Maple Lane;
RUNNING THENCE along the northeasterly side of Maple Lane, North
31 degrees 30 minutes 00 seconds West, 290.40 feet to the point
or place of beginning.
TOGETHER with an easement of ingress and egress from the premises
above described to the nearest public highway.
TOGETHER with beach rights in and to that area adjoining Gardiner' s
Bay designated as "reserved for beach area" on a certain subdivi-
sion map filed in the Office. of the Clerk of the County of Suffolk
on September 10, 1957, as Map No. 2752.
TOGETHER with an easement of ingress and egress over those roads
shown on the filed subdivision map leading to the reserved for
beach area hereinabove described.
SUBJECT to any state of facts an accurate survey may show.
SUBJECT to covenants, restrictions, reservations, and utility ease-
ments of record, if any.
