THIS INDENTURE, made the 3'Y-3day of nineteen hundred and eighty
BETWEEN SAMUEL M. TULMAN and A LE T LMAN, his wife, both residing

party of the first part, and LEON C. MARCUS and KATHERINE ANN MARCUS,

WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
t paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs

}� AND the party of the first part covenants that the party of the
first part has not done or suffered anything whereby the said premises
have been incumbered in any way whatever, except as aforesaid.
/ TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

SCHEDULE A
BEGINNING at a point on the westerly line of a private right
of way, said point being distant north 5 degrees 09 minutes
10 seconds west 621.94 feet from a point on the northerly
line of Manhanset Avenue at the southeasterly corner of land
formerly of Herbert Fordham, now or formerly of Pell; run-
ning thence from said point or place of beginning along land
now or formerly of Pell north 39 degrees 46 minutes 50
seconds west 204.75 feet to a point in the head of a certain
strip of meadow and land formerly of Dow now or formerly of
Raynor, then along said land the following three courses and
distances :
(1 ) north 43 degrees 58 minutes 50 seconds east 197. 66 feet;
( 2) north 74 degrees 49 minutes 50 seconds east 106.32 feet;
( 3 ) south 84 degrees 17 minutes 00 seconds east 163 feet to
the ordinary high water mark of Gull Pond; thence southerly
along said high water mark the following two courses and
distances on a tie line course and bearing south 34 degrees
12 minutes east 99 .80 feet (2) on a tie line course of south
12 degrees 17 minutes east 104.44 feet to land of Raynor;
thence along said land south 87 degrees 22 minutes 00 seconds
west 148.0 feet; thence continuing along said land of Raynor
south 73 degrees 55 minutes 10 seconds west 215.0 feet to
the easterly side of a private right of way; thence through
same south 5 degrees 09 minutes 10 seconds east 63.41 feet
to the westerly side of said Right of Way to the point or
place of beginning .
TOGETHER with a right of way including the right to lay
pipes, wires and conduits for the purpose of supplying the
above described property with gas, telephone, water and
sewer service over the following described premises to be
used in conjunction with others:
BEGINNING at a monument on the northerly line of Manhanset
Avenue 325.90 feet easterly along said northerly line from
Anglers Road; from said point of beginning running along
land of Pell and along other land of the seller north 5
degrees 09 minutes 10 seconds west 685.35 feet to a point;
thence south 39 degrees 46 minutes 50 seconds east 35.21
feet; thence south 5 degrees 09 minutes 10 seconds west
662.92 feet to said northerly line of Manhanset Avenue;
thence along said northerly line two courses:
(1) north 87 degrees 05 minutes west 9 .65 feet; thence
(2) north 68 degrees 35 minutes west 11.63 feet to the point
of beginning .
