Van Tuyl, dated November 29th, 1927, and filed in the office of the Clerk of Suffolk county, New York, which lot is bounded on the North by Maple Street, 50 feet; on the East by lot number fifty-eight (58), 150 feet; on the South by lot number forty- four (44), 50 feet and on the West by land of School District number 10, To~~ of Southold, New York, 150 feet. And it is understood and agreed by the parties of the second part that certain streets shown on above said sub-division map and known as Oak Street, Maple Street, West Street and Seventh Avenue and running to the property of the Union School District No.lO on the westerly side of said sub-division map, have been closed at the junction with the said Union School District No.lO property and they are Dead End Streets. Being and intended to be the same premises conveyed to Anthony Fiore and Pearl Fiore, his wife, by deed recorded in Liber 3157 cp.560. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenan~es and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to Teceive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
