Box 421 Mystic, CT 06355 RE: AMERICAN MUSEUM OF NATURAL HISTORY GREAT GULL ISLAND SCTM# 1000-130 Dear Mr. Neilson: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, August 19, 2009: RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Wetland Permit #6675 to allow for an alteration in the alignment of the proposed dock; rotate the landside end of approximately 5% counterclockwise to allow the hinged ramp landing to terminate along the northeast corner of the concrete bunker rather than the northwest comer of the bunker; and to construct the proposed docking facility using either wood or steel, and as depicted on the revised site plan prepared by Docko, Inc., last revised July 21, 2009, and received on July 28, 2009. Any other activity within 100' of the wetland boundary requires a permit from this office. This is not a determination from any other agency. Box 1179 ~ Southold, NY 11971 Re: Gull Island, Pier Reconslraction Permit - SCTM#1000-130 Dear Ms Standish: Following up on our approval of this project a year ago, it is respectfully requested that the American Museum of Natural History be granted an amendment to the previously issued permit to allow a very slight alteration in the alignment of the pier. The landside end of the structure will rotate approximately 5% counterclockwise to allow the hinged ramp landing to terminate along the northeast comer of the concrete bunker rather than the northwest comer of the bunker which was previously the landing point. The reason for this change is the deteriorated state of the armored shorefront along the northwesterly comer. We feel that the damage to existing concrete, the irregularity of the stones and the apparent loss of material due to wave impact and erosion, is worse on the noFuhwest comer than it is on the northeast comer. In addition, we would like to make sure that the Board of Trustees acknowledges that this pier can be built either of wood or steel. It appears that steel might actually be the less expensive and more enduring option because of the toughness of material and the ability to drive steel piles through obstructed soil and bottom sediments such as these. I trust that you will find these modifications to minor in nature; they do not change the width, height, encmachmem or configuration of the pier and hinged ramp system. I look forward to making the necessary presentation at the next regularly scheduled Board of Trustees meeting. Your favorable consideration is greatly appreciated. Box 1179 Southold, NY 11971 ~3, 2007 Re: Great Gull Island Permit Amendment We are pleased to transmit herewith a copy of the partial topographic and hydrographic survey for Great Gull Island, property of the American Museum of Natural I-Iisto~ in Block Island and Long Island Sound. Completion of this survey revealed a structural deficiency in the slab where the hinged ramp landing was proposed. We feet that it would be bett~ now to have the ramp tand~ immediately adjaeeat to the west face of the concrete b~mker on the top of bank above the pier to be re-built. Accordingly, we have changed the application drawings. TERMS AND CONDITIONS The Permittee American Museum of Natural History, residing at Great Gull Island, New York, as part of the consideration for the issuance of the Permit does understand and prescribe to the following: That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. That there will be no unreasonable interference with navigation as a result of the work herein authorized. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Department of Real Properties Office as a notice covenant and d~ed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this permit. That the said Board will be notified by the Permittee of the completion of the work authorized. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. James F. Box 421 Mystic, CT 06355 RE: AMERICAN MUSEUM OF NATURAL HISTORY NORTH SHORE OF GREAT GULL ISLAND SCTM# 1000-130 Dear Mr. Neilson: The Board of Town Trustees took the following action during its regular meeting held on Tuesday, July 24, 2007 regarding the above matter: WHEREAS, Docko, Inc. on behalf of AMERICAN MUSEUM OF NATURAL HISTORY applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated June 27, 2007, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on July 24, 2007, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of AMERICAN MUSEUM OF NATURAL HISTORY to reconstruct an existing 3' x 75' pier to 6' x 85', a 10' x 10' lower platform, two three-pile fender/tie-off dolphins and a removable 4' x 40' aluminum access ramp with pile supported hoist waterward of the apparent high water line, and as depicted on the plans prepared by Kieth B. However, such land may be used, and any rights otherwise acquired by this disposition may be exercised, as if no reservation of such materials had been made; except that, when such use results in the e~tr~etion of any such material from the land in quantities which may not be transferred or delivered without a license under the Atomic Energy Act of 19~6, as it nv exists or may hereafter be amended, such material shall be the property of the United States Atomic Energy Commission, and the Commission may require delivery of such material to it by any possessor thereof after such material has been separated as such from the ores in which it was contained° If the Commission requires the delivery of such material to it, it shall pay to the person ~ning or extracting the same, or to such other person as the Commission determines to be entitled thereto, such sums, including profits, as the Com- mission deenls fair and reasonable for the discove~r, n~ning~ development, production, extraction, and other services performcd with respect to such material prior to such delivery, but such payment shall not include any amount on account of the value of such material before removal from its place of deposit in nature. If the Commission does nob require delivery of such material to it, the reservation hereby made shall be of no further force or effect. EXCEPTING ALSO from this conveyance and reserving to the party of the first part the right and privilege to place ~nd maintain on the premises herein conveyed, any aids to navigation which it may he found r~cessary to estshlish at any time in the ~ture. This conveyance is executed, delivered and accepted upon each of the following conditions subsequent, which shall be binding upon and enforceable against the party of the second part, its successors or assigns and each of them, and these conditions shall, in addition, constitute undertaking, bind- ing upon the party of the second part, its successors and assigns, which shall be independent of and survive the execution and delivery of this con- veyance. That during the aforesaid period from the date of this conveyance to June 13, 1969, the party of the second part will resell, mortgage, lease, encumber or other- wise dispose of the above described premises or any part thereof or interest therein only as the Department of Health, Education, and Welfare, or its successors in function, in accordance with its existing regulations, may authorize in writing. That one (1) year from the date of this conveyance and annually thereafter for the aforesaid period to June 13, 1969, unless the Secretary of Health, Edu- cation, and Welfare or its successor in function otherwise directs, the party of the first part will file with the Department of Health, Education, and Welfare or its successor in function, reports on the operation and maintenance of the above described premises and will furnish, as requested, such other pertinent data evidencing continuous use of the premises solely for the purposes set forth above in the paragraph noted first. In the event of a breach of any of the conditions set forth above, whether caused by the legal or other inability of said party of the second part, its successors or assigns, to perform any of the obligations herein set forth, all ri~t, title and interest in and to the above described property shall, at its option revert to and become the property of the United States of America, which shall have an immediate right of ent~- thereon, and the party of the second part, its successors c~ assigns, shall forfeit all right, title and interest in and to the above-described premises and in any and all of the tenements, hereditaments, and appurtenances thereunto belonging; PHOVIDED HO~'~ER, that the failure of the Department of Health, Education, and Welfar~ or its successor in function, to insist in any one or more instances upon complete performance of any of the said conditions shall not be construed as a waiver or a relinquishment of the future performance of any such conditions, but the obligations of the party of the second part, its successors or assigns with respect to such future performance shall continue in full force and effect; P~(OVIDED FURTHER that in the event the United States of America fails to exer- cise its option to re-enter the premises for any such breach of said conditions within twenty-one (21) years from the date of this conveyance, the conditions - 5 - Liber 3759 Page ~19 set forth above together with all rights of the United States of America to re-enter as in this paragraph provided, shall, as of that date, terminate and be extinguished. In the event title to the above-described premises is reverted to the United States of America for noncompliance or voluntarily reconveyed in lieu of reverter, the party of the second part, its successors or assigns, at the option of the Department of Health, Education, and Welfare or its successor in function, shall be responsible and shall be required to reimburse the United States of America for the decreased value of the above-described prop- erty not due to reasonable wear and tear, acts of God, and alterations and conversions made by the party of the second part, its successors or assigns to adapt the property to the educational use as hereinabove described, for ~nich the property was acquired. The United States of America shall, in addition therete, be reimbursed for such damages, including such costs as may be incurred in recovering title to or possession of the above described property, as it may sustain as a result of the noncompliance° The party of the second part may secure abrogation of the conditions numbered l, 2, and 3 herein by: ao Obtaining the consent of the Department of Health, Education, and Welfare oF its successor in function; and b. Payment to the United States of America of the public benefit allowance granted to the party of the second part of one hundred (100) percent of the current market value of one hundred dollars ($100.o0) less a credit at the rate of five (5) percent for each twelve (12) months during which the property has been utilized in accordance with the purposes specified in the application described in paragraph one (1) hereof. The party of the second part, by the acceptance of this conveyance, covenants and agrees, for itself, its successors and assigns, that the United States of ;~erica shall have the right during any period of emergency declared by the Presldenb of the United States or by the Congress of the United States to the full unrestricted possession, control and use of the premises hereby conveyed, or of any portion thereof, including any additions or improvements thereto made subsequent to this conveyance. Prior to the expiration or termination of the period of restricted use by the transferee, Liber 3759 Page ~20 - 6 - such use may be either exclusive or non-exclusive and shall not impose any obligation upon the Government to pay rent or any other fees or charges during the period of emergency, except that the Government shall (i) bear the entire cost of mair~tenance of such portion of the property used by it exclu- sively or over which it may have exclusive possession or control, (ii) pay the fair share, commensurate with the us% of the cost of maintenance of such of the property as it may use non-exclusively or over which it may have non- exclusive possession or cor~rol, (iii) pay a fair rental for the use of im- provements or additions to the premises made by the party of the second part without Goverr~ent aid, and (iv) be re~oonsible for any damage to the property caused by its use, reasonable wear and tear, and acts of God and the common ene~Ry excepted. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the below Policy Standards and therefore is CONSISTENT with the LWRP; provided that the proposed action meets sub-policies 6.3 and 9.4 outlined below. 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The applicant must demonstrate that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [1] Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion; [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependant activities; [3] Whether the dock will unduly interfere with transit by the public along the public beaches or foreshore; [4] Whether the dock will significantly impair the use or value of waterfront property adjacent to or near the dock; [5] Whether the dock will cause degradation of surface water quality and natural resources; [6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats; [7] Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses including eelgrass (Zostera marina) and widgeon grass (Ruppia maritima) or shellfish; [8] Whether the dock will unduly restrict tidal flow or water circulation; [9] whether the dock will be safe when constructed; [10] Whether the dock will adversely affect views, viewsheds and vistas important to the community; [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and [12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. It is recommended that the Board evaluate whether the proposed dock will "extend beyond the minimum necessary for access to navigable waters" to meet sub-policy 9.4 below. 9.4 Assure public access to public trust lands and navigable waters. Provide access to, and reasonable recreational use of navigable waters and public trust lands under water. Provide for free and unobstructed public use of all navigable waters below the line of mean high water for navlgation~ recreation~ and other public trust purposes~ including the incidental ri~lhts of public anchoring. Structures extending beyond the minimum necessary for access to navigable waters impair public trust interests and open space values associated with the water's surface. Allow such structures only in the following circumstances: a. when necessary for practical and convenient operation of water- dependent industry or commerce, and provided that obstruction of commercial navigation does not result. b. for commercial recreational boating facilities provided that: (i) the loss of navigable waters and use of underwater lands is offset by sufficient public benefit, and (ii) obstruction of commercial navigation does not result. when the principal purpose of the structure is necessary: (i) to provide public access for recreational uses (ii) for improvements for navigation (iii) for protection from coastal hazards, or (iv) for essential public transportation and transmission facilities. The pier must be rebuilt in order to re-establish an interface between transport and provisioning vessels and the shoreline. The long-standing pier at this site was built by the U. S. Army in 1947 and consisted of large creosote, pressure-treated pine piles driven through the rocky and gravely bottom sediments. These piles were clamped together with split caps of large pressure-treated timbers to which stringers and subsequently decking, was attached. This pier was originally built as a food and trash disposal chute from the fort cooking facilities and had been maintained on an "as needed" basis, since the American Museum of Natural History took possession of the island, primarily replacing decking and timber framing; now the structure must be completely rebuilt. Previous maintenance efforts preceded the enactment of Local Law No. 6 by the Town of Southold and did not impact more than 50% of the pier structure. PERMITTING This pier reconstruction process will be virtually complete replacement and thus will require authorizations from the U. S. Army Corps of Engineers with a consistency determination for conformance to the Coastal Zone Management Program of the State of New York as administered by the Department of State, a Tidal Wetlands by the New York State Department of Environmental Conservation and a Wetlands Permit fi'om the Town of Southold. This narrative statement provides information to supplement the application forms for each of these agencies. SITE CONDITIONS The pier is built along the rocky shorefront on the north edge of Great Gull Island at about the mid-point of the island. It projects north into Long Island Sound a distance of approximately 75 feet waterward oftbe mean low water line. Boulders pre-dominate the surface characteristics of the shoreline and the shallow sub-tidal zone. The water is frequently rough in this area and creates such an agitated state that sandy bottom sediments have been eroded and scoured out of the foreshore. Virtually all of the shoreline boulders throughout the upper reaches of the foreshore and the inter-tidal and shallow sub-tidal zones, are constantly "sand-blasted" and, as a result, are basically devoid of vegetation. There was no observed submerged aquatic vegetation in the vicinity of the pier nor were any tidal wetlands grasses or dune grasses observed on the upper reaches of the shore. Photographs of the site are attached for reference in this regard. It is surmised from the notable lack of habitat and vegetation on the shore or throughout the inter-tidal or shallow sub-tidal zone, that there will be no adverse environmental impact on aquatic resources as a result of this pier construction project. 1 CONSTRUCTION METHODOLOGY This project will have to be buih from the water using barge mounted crane and mechanical equipment including compressors for the pile driving equipment as well as some of the pneumatic tools. The water gets deep fairly rapidly with the sub-surface sediments profile being approximately one foot vertically for ten feet horizontally. Large boulders exist just east of the berthing area and there is a dispersed line of stone remnants from a previously existing, demolished, solid wharf immediately west of the pier site dictating that the barge approach will have to be from a straight northerly direction into the work area leaving very little maneuvering latitude by the construction barge and service vessels. The first part of the project will be the partial demolition or removal of the existing pier components, primarily the pile remnants. They should be cut off at the water surface or pulled, depending on the need for barge access close to shore and interference they may pose in the new pier components. Most of these piles according to records of the AMNH indicate that these piles are 50 to 60 years old and it is very likely that they may break in the extraction process. New piles will be driven at 10 foot bent intervals and connected with split caps (clamps) of hefty, pressure treated Southern pine timbers on the order of 6 x 12's, not for loading issues affecting the piers' usage, but because of climatological factors. Connections will utilize l-inch galvanized, heavy duty timber bolts. It is anticipated that bracing piles should be used rather than diagonal cross braces between adjacent piles on each bent although both have been shown on the detail. These brace piles should be notched into the vertical support piles to provide maximum support with minimum dependence on the bolts. Once the bents are in place, deck support stringers will be mounted to the piles at 16-inch intervals across the tops of the split caps. It is anticipated that the deck width will be 6 feet clear with stringers installed across the width of the split caps as required by the decking. Decking is anticipated to be industrial grade steel or heavy duty fiberglass grating mounted crosswise to the stringers. This open grating will allow most of the uplift forces from storm driven waves at high tide to be directed through the structure rather than creating impact forces on the structure. The geometry of the rebuilt pier should extend 10 feet further north beyond the end of the existing pier to enable boats to maneuver to the pier without potential damage fi'om striking the boulder located approximately 50 feet east of the end of the existing pier as shown in the application drawings. In addition, a low level platform should be built for off-loading and transfer of supplies and personnel safely at low tides. The shore side end of the pier will be just landward the apparent low water line. The exact location will be dependant on driving conditions through the boulders at the landward end of the pier. It is envisioned that the most suitable transition to the shore will be accomplished by installing a 40-foot aluminum ramp. This ramp would be hinged and mounted to the end of the pier and will have a pair of piles and hoisting beams near the landward end to allow the shore landing end to be hoisted and secured up for storm conditions to keep it out of breaking waves on the shore to the extent possible. The elevation of the pier will be set at 9 feet above mean low water. This will allow the structure to be clear of much of the adverse wave energy conditions with flood tidal elevation of 5 feet and waves up to 4 feet. Three pile dolphins will be driven in line with the face of the end of the pier and at the location shown on the application drawings so as to create secure tie-offpoints for bow and stem lines and yet also provide a bracing point for the boat to maneuver against for arrivals and departures. The pier and tie-off dolphin configurations favor berthing with the bow to the west which represents the desired berthing position for the vast majority for wind and sea conditions. It is recommended that the piles for this project be either 12 to 14 inch Greenheart piles or 14 to 16 inch pressure treated Southern pines because of the significant and virtually constant rough sea conditions and the loads that the transport vessel thus exerts on the structure; this must be a heavy duty structure. The island belongs to the American Museum of Natural History and we have worked their since 1969 using a dock originally built by the government when the island was the site of Fort Michie. Last fall the planking of the dock lifted off. Some of the pilings need to be replaced. If there were a time that you could look at the dock I would be happy to arrange a boat to bring you over and take you back once you had seen the dock so that you could consider the possibility of a issuing a permit so that we could repair the dock. FCAF Revtsed 12/6193 THE A~RICA MUSEUM OF NATURAL ~TORY GREAT GULL ISLAND, TOWN OF SOUTHOLD, NEW YORK JUNE 22, 2007 GENERAL The American Museum of Natural History owns Great Gull Island, identified as Town of Southold Tax Assessor parcel 1000-30-1 Great Gull Island. The site is generally moderately sloped, sandy gravel earthen materials, vegetated with grass, brash, ground cover and trees. The frontage of the property is approximately 2,500 feet along Long Island Sound. There are no abutters. The waterfront consists of a boulder covered beach with no observed tidal wetlands vegetation. The pier which serves as the only landing point for service and transport vessels at Great Gull Island has been demolished by two strong coastal storms (nor'easters) in October of 2006 and April of 2007. The pier must be rebuilt in order to re-establish an interface between transport and provisioning vessels and the shoreline. The long-standing pier at this site was built by the U. S. Army in 1947 and consisted of large creosote, pressure-treated pine piles driven through the rocky and gravely bottom sediments. These piles were clumped together with split caps of large pressure-treated timbers to which stringers and subsequently decking, was attached. This pier was originally built as a food and trash disposal chute from the fort cooking facilities and had been maintained on an "as needed" basis, since the American Museum of Natural History took possession of the island, primarily replacing decking and timber framing; now the structure must be completely rebuilt. Previous maintenance efforts preceded the enactment of Local Law No. 6 by the Town of Southold and did not impact more than 50% of the pier structure. This supplemental narrative has been prepared in accordance with the requirements of Town of Southold, Ordinance No. 6, 2004, and the Waterfront Revitalization Program related to docks and shorefront improvements. In addition, applicable coastal policies under the New York State Coastal Management Act are addressed herein for review by the New York State Department of State and Department of Environmental Conservation. DESCRIPTION OF WORK As mentioned in the introductory paragraph, tiffs project is to reconstruct a fixed wood pile and timber pier from the shore out into Long Island Sound in accordance with existing guidelines set forth in the Town of Southold ordinance No. 6, 2004. It is envisioned that this structure will be built ntilizJng the following general sequence and methodology. This project will have to be built from the water using barge mounted crane and mechanical equipment including compressors for the pile driving equipment as well as some of the pneumatic tools. The water gets deep fairly rapidly with the sub-surface sediments profile being approximately one foot vertically for ten feet horizontally. Large boulders exist just east of the berthing area and there is a dispersed line of stone remnants from a previously existing, demolished, solid wharf immediately west of the pier site dictating that the barge approach will have to be from a straight northerly direction into the work area leaving very little maneuvering latitude by the construction barge and service vessels. The first part of tl~project will be the partial demolition i~removal of the existing pier components, primarily the pile remnants. They should be cut off at the water surface or pulled, depending on the need for barge access close to shore and conflicts they may create for the installation of the new pier components. According to records of the AMNI-I indicate that these piles are 50 to 60 years old and it is very likely that they may break in the extraction process. New piles will be driven at 10 foot bent intervals with a bearing capacity of 20 (+/-) tons, proceeding fi.om the shore out, and connected with split caps (clamps) of hefty, pressure treated Southern pine timbers on the order of 6 x 12's, not for loading issues affecting the piers' usage, so much as climatological factors. Connections will utilize minimumldnch galvanized, heavy duty timber bolts. It is anticipated that bracing piles should be used mtber than diagonal cross braces between adjacent piles on each bent although both have been shown on the detail. These bmoc piles should be notched into the vertical support piles to provide maximum support with minimum dependence on the bolts. Once the bents are in place, deck support stringers will be mounted to the piles at 16-inch intervals across the tops of the split caps. It is anticipated that the deck width will be 6 feet clear with stringers installed across the width of the split caps as required by the decking. Decking is anticipated to be industrial grade steel ox heavy duty fiberglass grating mounted crosswise to the stringers. This open grating will allow most of the uplift forces from storm driven waves at high tide to be directed through the structure rather than creating impact forces on the structure. The geometry of the rebuilt pier should extend 10 feet further north beyond the end of the existing pier to enable boats to maneuver to the pier without potential damage from striking the boulder located approximately 50 feet east of the end of the existing pier as shown in the application drawings. In addition, a low level platform should be built for off-loading and transfer of supplies and personnel safely at low tides. A davit will be installed on the back side platform support pile for heavy or awkward load transfers. The shore side end of the pier will be just landward the apparent low water line. The exact location will be dependant on driving conditions through the boulders at the landward end of the pier. It is envisioned that the most suitable transition to the shore will be accomplished by installing a 40-foot aluminum ramp. This ramp would be hinged and mounted to the end of the pier and will have a pair of piles and hoisting beams near the landward end to allow the shore landing end to be hoisted and secured up for storm conditions to keep it out of breaking waves on the shore to the extent possible. Safety rails 48 inches above the deck will be installed along all edges of the pier not usable for berthing. The elevation of the pier will be set at 9 feet above mean low water. This will allow the structure to be clear of much of the adverse wave energy conditions with flood tidal elevation of 5 feet and waves up to 4 feet. There will be no utilities on the pier. PERMITTING This pier reconstruction process will be virtually complete replacement and thus will require authorizations from the U. S. Army Corps of Engineers with a consistency determination for conformance to the Coastal Zone Management Program of the State of New York as administered by the Department of State, a Tidal Wetlands by the New York State Department of Environmental Conservation and a Wetlands Permit fi.om the Town of Southold. This narrative statement provides information to supplement the application forms for each of these agencies. SITE CONDITIONS The pier is built along the rocky shomfront on the north edge of Gmat Gull Island at about the mid-point of the island. It projects north into Long Island Sound a distance of approximately 75 feet waterward of the mean low water line. Boulders pre-dominate the surface characteristics of the shoreline and the shallow sub-tidal zone. The water is frequently rough in this area and crates such an agitated state that sandy bottom sediments have been eroded and scoured out of the foreshore. Virtually all of the shoreline boulders throughout the upper reaches of the foreshore and the inter-tidal and shallow sub-tidal zones, are constantly "sand-blasted" and, as a result, are basically devoid of vegetation. There was no observed submerged aquatic vegetation in the vicinity of the pier nor were any tidal wetlands grasses or dane grasses observed on the upper reaches of the shore. Photographs of the site are attached for reference in this regard. It is surmised from the notable lack of habitat and vegetation on the shore or throughout the inter-tidal or shallow sub-tidal zone, that there will be no adverse environmental impact on aquatic resources as a result of this pier construction project. Three pile dolphins will be driven in line with the face of the end of the pier and at the location shown on the application drawings so as to create secure tie-offpoints for bow and stem lines and yet also provide a bracing point for the boat to maneuver against for arrivals and departures. The pier and tie-off dolphin configurations favor berthing with the bow to the west which represents the desired berthing position for the vast majority for wind and sea conditions. It is recommended that the piles for this project be either 12 to 14 inch Greenheart piles or 14 to 16 inch pressure treated Southern pines because of the significant and virtually constant rough sea conditions and the loads that the transport vessel thus exerts on the structure; this must be a heavy duty structure. LOCAL WATERFRONT REVITALIZATION POLICIES The Town of Southold, LWRP policies that are applicable to the Great Gull Island pier and dock proposal are a local refinement of the Long Island Sound Regional Coastal Management Program policies that apply throughout Long Island Sound. The site is on the north shore of Great Gull Island and is characterized by undeveloped coast. The developed coast policies are applicable as follows: Policy 1 is to foster a pattern of development that enhances community character and preserves natural resources to the maximum extent and minimizes adverse impacts on the environment, Policy 2 is to preserve historic resources, Policy 3 is to enhance and protect scenic resources and visual quality. The proposed dock facility is consistent with waterfront development on Fishers Island and in coastal areas. The pier is made of timbers and utilizes the materials allowable under Local Law #6 and consistent with other adjacent dock facilities and characteristics for the visual and scenic considerations in the cove. The encroachment has been minimized to the maximum possible extent to be consistent with DEC policies and the structure is at an elevation consistent with the safe and efficient use of the waters and consistent with the tidal range of this site. NATURAL COAST P~CIES The Natural Coastal Policies are 4 through 8 and require consideration as follows: Policy 4 - Minimize loss of life, structures and natural resources from flooding and erosion, Policy 5 - Protect and improve water quality Policy 6 - Protect and restore the quality and function of the eeo-system, Policy 7 - Protect and improve air quality, Policy 8 - Minimize environmental degradation primarily from solid waste and hazardous substances. The proposed structure for the essential transportation access / docking facility has been laid out and configured so as to be consistent with the DEC permit requirements for such structures. As such, it provides adequate height to clear environmental resources of concern and the materials to be utilized are consistent with Town of Southold's Local Law #6 regarding environmental quality and the use of pressure-treated Southern Yellow Pine timber components in particular. There will be no adverse impacts on air quality as a result of this structure. PUBLIC COAST POLICIES Policy 9 sets forth a priority to provide for public access and recreational use of coastal waters, public lands and public resources of the Town. This project restores an essential boat docking facility for access, transportation and provisioning of personnel on the island and so is consistent with this policy. No public access or recreational use is required or provided. WORKING COAST POLICIES The policies of this section relate to the following: Policy 10 - Protection of the Town's water-dependent uses and promoting new water_ dependent uses in suitable locations, Policy 11 - Promoting sustainable usc of living marine resources, Policy 12 - Protect agricultural lands, While most of the Working Coast Policies are not applicable to this site or this type of project, Policy 10, promoting water-dependent uses and the citing of water-dependent uses in appropriate areas is applicable and the proposed project has been laid out to make the most beneficial use of the land and locating the dock facility in the most appropriate point of the land where access down the bank will not require excessive structural facilities but instead can be accommodated with a removable rump rather than fixed stairs or bridging. This project has been laid out with specific reference to and review of the Waterfront Revitalization Progrum policies as well as local Law No. 6 and is considered to be consistent. In summary, the dock is typical of essential transportation boat docking facilities along coastal New England. The structure has been minimized in size, height, and structure so as to be consistent with facilities of a similar nature and the minimum necessary components to accommodate safe and efficient boating operations from this site and yet survive stormy climatic conditions which frequently arise and from which there is no protection. 4 In summary, this project does not interfere with public access or use of public trust waters and lands of the State, it does not interfere with navigation, it will not create soil or sedimentation erosion problems, it does not adversely environmental resources and in the area where the facility must span the intertidal zone at the shore line, the facility has been located in the area so as not to so as not to adversely affect any of the environmental or habitat conditions. The height of the structure has been specifically addressed so as to remain above most tidal conditions and storm driven waves and uses a lower platform for ease of access at lower tides and calmer conditions. The dock facility has also been located reaching out to the deepest water so that bottom contact will not be an issue and keep the vessel out of breaking waves induced by the shoaling sediments and to minimize adverse environmental impacts. More than 95% of the shoreline will remain in a natural state as a result of these considerations for design. There is no loss of valuable marine and wetland habitat and no water quality degradation as a result of this project. Reference is made to the NYS DEC study from 2000 indicating the suitability of pressure-treated Southern Yellow Pine piles and / or super- structure components for this type of purpose. In accordance with Local Law ~6, decking for both the float and the pier and the ramp treads will bo of synthetic materials. No natural protective features or processes will bo adversely impacted as a result of the proposed decking facility. This project is consistent with zoning policies and ordinances for the Town. The dock facility will be an accessory to the research facilities which are based seasonally at this site. There will be no development of the upland related to this dock facility that will create point sources of pollution or drainage. This project is considered to be provide boat access facilities compatible with the natural resource values and characteristics of the site. REQUIREMENTS OF SECTION 97-25 OF THE WETLANDS LAW 6~ 2004 The permittee acknowledges that the validity of this permit is subject to the approval of other governmental or municipal authorities. The permittee does, by the acceptance of this permit, assume all responsibility for operations undertaken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the permittee also agrees to indenmify and save harmless the Town and its officers. The permittoe gives consent to the Town and its officers, employees and agents to enter upon the premises where such operations are being conducted to make such inspections to determine whether said operations are being conducted in conformity with the permit. The permittee will notify the Trustees in writing one week prior to initiation of any and all operations. The permittee will notify the Trustees in writing upon completion of operations such that the site can be inspected for issuance for a certificate of compliance. In response to Sub-section 2a and the General Rules for Standards of Residential and Commercial Docks, the following additional information is offered. 5 Permits for the work ave being applied for through the Town, US ACOE, NYS DEC and a coastal zone consistency determination by the NYS DOS. The new piles to be installed will be of sturdy, durable and stable materials; in all likelihood, Greenhart or CCA pressure-treated Southern Yellow Pine (SYP) piles with new split caps and braces of the same SYP materials. These members will be a minimum of 3 x 10's and as large as, 6 x 12's with at least one 1-inch bolt per connection, and in most cases, two 1-inch bolts per couneetion. This pier is a fixed, pile-supported timber structure with a float and therefore will not adversely affect the free circulation of water or reduce the effects of fluctuating water levels in Darbie's Cove. In addition, the pier does not present any adverse modification of the shoreline. The pier's elevation is such that only in extreme high flood tides will the structure be inundated. The structure's SYP timber materials are specifically grown for this purpose and are capable of withstanding full immersion and represent the standard of the industry. With the connections described above, this structure will be able to survive repeated inundations and exposure to 3-foot breaking waves at high tide elevations. The pier support and battered bracing will include driving new piles at 10-foot intervals to the maximum extent possible in order to obtain the desired pier alignment and support intervals. Boulder location will have an impact on pile locations. The use of CCA pressure-treated piles and timbers can be approved for this project in accordance with Local Law 6. The pier will not be decked with CCA pressure-treated Southern Pine. This pier / walkway will probably be industrial-style grating to provide a safe pedestrian surface for access between the shore and berthed boat. Rails will be installed on the pier for safety. The pier is almost centered on the property. The 15-foot clearance specified in this paragraph should not be an issue because the there is only one land owner involved and there are no adjoiners. Upon receipt of the permit for this project, appropriate permit numbers and a Town permit placard will be affixed to the most seaward face of the pier for identification from the water. There are permanent structures located above the pier decking other than the safety rail and the davit which are fixed by function. It is currently possible to provide a five-foot passage way on the upland to get around this pier and that access ability will be retained between the mean low and mean high water lines. There is room to walk under the pier at low fide, however, foot traffic in this area is virtually non-existent. 6 NEW YORK STATE COASTAL MANAGEMENT PROGRAM These application documents include a copy of the Federal Consistency Assessment Form utilized for the New York State Coastal Management Program under the jurisdiction of the New York State Department of State. The following policies have been identified as pertinent to this application and the reason for consistency associated with this project is outlined in each respective case. Policy 2 -Water Dependent Uses - This project is to construct a fully functional water dependent use, a recreational boating dock facility at this site in support of recreational boating. Policy 5 - Use of Existing Developed Shorefront - There is no longer any developed shoreline on this site. This project utilizes existing shorefront which has been altered by previous dock and wharf structures but the rough sea conditions have diminished resources such as growth of tidal wetlands vegetation. The project will be to re-build a pier and extend it to a logical shoreward terminus to make it safe and reliably usable in most weather conditions. Policy 7 - Significant Fish & Wildlife Habitat - Protection of si~tmificant fish and wildlife habitat has been considered in the development of this project layout. The dock to the shoreward point of beginning will be over a boulder shoreline devoid of vegetation and with little habitat value because of the constant battering by waves. The entire island is a refuge, primarily for terns. Policy 8 - Protection & Preservation of Habitat - Protection and preservation of habitat has also been considered in this project and the dock structure is being kept to its minimal configuration and of materials consistent with standards of the industry and restrictions set forth in the Wetlands Law, No. 6, 2004 set forth by the Town of Southold and standards of the NYS DEC. Policy 11 - Minimize Damage to Natural Resources - The dock construction project has been laid out in such a way so as to minimize damage to natural resources as identified in Policy 7 above. Policy 14 - No Measurable Increase in Flooding - This project consists of construction of an open wood pile and timber pier which in no way adversely affects waterflow and circulation in Long Island Sound or flooding potential of the area. Flood levels all around the island are dictated by water levels in Long Island Sound and Block Island Sound and this structure will have no adveme influence on those levels. Policy 15 - No Dredgin~ - Dredging is not required in this project. The dock system has been laid out in its current location and configuration to avoid any dredging requirements. The depth of 8 feet has been reached not so much for avoiding adverse impacts of bottom disturbance but to keep clear of the boulder at the east end of the docking facility for the safety and welfare of the crew and station personnel. The waters are so rough that boats must be berthed bow out leaving the propellers and redders in five feet or deeper water. Most berthing will be of short duration and will take place offthe end of the pier. 7 t' Policy 19 - Impact on Access - Public access will not be jeopardized or impeded as a result of this project. As a matter of fact, there is almost no public access usage of the public trust lands or waters at this site. The intertidal zone is significantly covered by boulders and the shallow sub-tidal waters do not present any opportunity or enticement for public access in the area Thus, public access to the State's lands and waters will not be adversely affected by the project. Policy 20 - Public Trust Compatibility with Existing Adjoining Properties and Land Uses- Public Trust compatibility and land nses have also been considered in this project and, although these are no neighbors, the docking facility has been minimized. This docking facility wilt not interfere with existing or the likely configuration of future facilities, adjacent islands, or public access to public trust lands or waters of the State or the logical allocation of littoral development fights. Policy 21 - Water Dependent Recreation - This project is consistent with water-dependent policies set forth in this section. Policy 24 -Scenic Resources, Impairment or Loss - This policy is designed for functionality and to the extent possible, to prevent impairment or loss of scenic resources. The construction of the fixed wood pile and timber pier will not represent a new encroachment or structure which would create a loss of scenic resources; it is replacing a pre-existing and long-standing docking facility. The height, length and mass of the structure are purely defensive to maintain long-term structural integrity in a rough water site. Policy 25 - Enhance Overall Scenic QualiW - The new dock structure will be consistent with the scenic quality of the area and prevent loss of scenic resources as described in Policy 24 above. Policy 44 - Preserve and Protect Tidal Wetlands - The conslxuction of the fixed wood pile and timber pier has taken advantage of an un-vegetated shoreline caused by the sea conditions and will avoid adverse wetlands impact. The raised height of the pier should allow opportunities for the growth of wetlands vegetation to an extent, beneath the wood pier if sea conditions ever permit enough sediment to accrete in the inter-tidal zone (but that is highly unlikely). SUMMARY This project proposes a replacement fixed pier for essential boating access to and from Great Gull Island for manning and provisioning a scientific research facility. A copy of all US Army Corps of Engineers, NYS DEC and Town of Southold applications are attached as substantiation for this project. This project complies with reasonable applicable standards of the New York State Coastal Management Act, NYS / DEC Tidal Wetland Regulations and criteria for approval, the Town of Southold Waterfront Revitalization Program and Local Ordinance No. 6, 2004 and its approval is respectfully requested.
