TERMS AND CONDITIONS The Permittee Thomas Byrne & Veronica Kaliski. residing at 2345 Bavview Avenue, Southold, New York, as part of the consideration for the issuance of the Permit does understand and prescribe to the following: I. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That iffuture operations of the Town of South old require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Department of Real Properties Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee ofthe completion of the work authorized. 10. Box 316 Greenport, NY 11944 RE: THOMAS BYRNE & VERONICA KALISKI 2345 BAYVIEW AVENUE, SOUTH OLD SCTM# 52-5-1 Dear Mr. Uellendahl: The Board of Town Trustees took the following action during its regular meeting held on Tuesday, July 24, 2007 regarding the above matter: WHEREAS, Frank Uellendahl on behalf of THOMAS BYRNE & VERONICA KALISKI applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated June 27, 2007, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: installation of gutters and drywells to contain roof runoff, a line of staked hay bales to be installed 30 feet from the bulkhead prior to construction, a 15 foot non-turf buffer, and 2 . . WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on July 24,2007, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of THOMAS BYRNE & VERONICA KALISKI to construct a second-floor addition, first floor kitchen extension and deck extension with the condition of the installation of gutters and drywells to contain roof runoff, a line of staked hay bales to be installed 30 feet from the bulkhead prior to construction, and a 15 foot non-turf buffer, and as depicted on the site plans prepared by Frank Uellendahl, last dated July 25,2007, and received on July 27,2007. Permit to construct and complete project will expire two years from the date the permit is signed. PROPERTY FACTS/DESCRIPTION: The applicants' 16,753 square foot parcel has 85 feet along Bayview Avenue and is improved with a single-family dwelling as shown on the September 19, 2006 survey prepared by John Metzger, Peconic Surveyors, P.C. BASIS OF APPLICATION: Request for Variances under Sections 280-116B and 280-124, based on the Building Inspector's February 20, 2007 Notice of Disapproval concerning an application for a building permit to construct as-built and new additions/alterations to the existing single-family dwelling, which are less than 35 feet from the front lot line, less than 75 feet from the bulkhead, and less than 10 feet on a single side yard. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated May 2, 2007 states that the application is considered a malter for local determination as there appears to be no significant county-wide or inter-community impact. TOWN CODE CHAPTER 268 LWRP DETERMINATION IExemot): The second-story is over an existing first fioor area of a dwelling, exempt as a minor action. It is also noted that a major portion of the second-floor additions is beyond the 75 ft. zoning code setback restriction of the bulkhead, and therefore not subject to jurisdiction of the Zoning Board of Appeals. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 31,2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants seek variances for: (a) a proposed second-fioor addition at 16.3 feet from the Bayview Avenue and 73 feet to the bulkhead; (b) 60 feet from the bulkhead from the new stairs of the new deck reconstruction; (c) 4.5 feet from the side lot line to the proposed first floor deck extension, as shown on the 5/30/2007 site plan drawing A-1 Band 4/20/2007 elevation drawing A-3, prepared by Frank Uellendahl, Architect. REASONS FOR BOARD ACTION: On the basis of testimony presented. materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed second floor addition will be on the north side of the house above the existing dwelling, which has a pre-existing non-conforming front yard setback along Bayview Avenue extension dead ends at Arshamomaque Pond, providing water access to owners. There are no neighbors to the north, and the proposed addition is similar to other second floor additions in the neighborhood along Rausch Lane and Bayview Avenue. The proposed deck extensions replace and modestly enlarge an existing deck in the rear yard where there is privacy from the streets and neighbors. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the buildable area on this oddly shaped lot with two front yards is very limited. 3. The variances granted herein are not substantial. The proposed lot coverage will be under 14%, including the decks. The proposed side yard setback for the new deck reduces the existing setback from 6' to 4.5' but only on a small portion on the southem comer. This small deck extension is necessary because the existing garage, which is above grade, will be converted to a first floor fitness room with an exterior door providing access to the rear yard. The setbacks from the bulkhead vary from conforming at 75' to 73' and 60' to the pre- existing bulkhead stairs. 4. The difficulty has not been self-created but is the result of the siting of the existing house on an oddly shaped lot with two front yards. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of new deck construction and a second floor addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Oliva. seconded by Member Dinizio, and duly carried, to GRANT the variance as applied for, as shown on the 513012007 site plan drawing A-1 Band 412012007 elevation drawing A-3, prepared by Frank Uellendahl, Architect. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps. are not authorized under this application when involving nonconformities under the zoning code.
