TERMS AND CONDITIONS The Permittee Christopher & Amy Astlev, residing at 460 North View Drive, Orient, New York, as part of the consideration for the issuance of the Permit does understand and prescribe to the following: That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. That there will be no unreasonable interference with navigation as a result of the work herein authorized. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. The ?ermittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Department of Real Properties Office as a notice covenant and deed restriction to the deed of the subject parcel. Applicant: Chris & Amy Astley at 460 North View Drive, Orient SCTM # 1000-13-01-5.2 Dear President King and Members of The Board of Trustees, Nina and I recently received the certified letter from our neighbor stating the public hearing date of Wednesday, January 24 at 6:30pm to hear the applicant's request for the expansion of their existing house, placement of two decks, pool and mechanicals on a non- conforming small blufflot(0.821 acres) all of which is within 100 of the bluff line. We respectfully submit the following information for your consideration prior to your upcoming site visit. Our home is directly to the west of the applicants and is also on the bluff. It has come to our attention that a significant portion of the bluff has failed and collapsed on the property directly east and adjacent to the applicants. We are helping that neighbor by passing along information we obtained from the New York State Depa, i. ment of Environmental Conservation in order to reestablish vegetation growth. He is making best efforts to help the situation. Our concern is that the applicants are proposing a massive tripling of their existing square footage and as such grossly and negatively impacting the stability of the bluff and environment. The neighbor's lot is tiny and barely contains the existing house. Our greatest concerns are their following proposals: a) to place a screened porch 18 feet from the top of the bluff. We imagine that concrete footing excavations and placement will be required at such close distance to the bluff. b) to place a swimming pool five feet away from our property line. The ground elevation of the proposed pool is roughly 15 feet higher than our property level. It is estimated that the mass of the water is roughly 30 tons and as such we are extremely concerned about the stability of the soil directly above our adjacent property. Potential soil collapse along with tons of water damage would be catastrophic to our property, the bluff and environment. Please reference the applicant's architectural drawings which indicate falling contour elevations directly west of the proposed pool. In discussions with the applicants advising them of the difficulties in their proposal, they agreed to not build a swimming pool, which decreases the amount of OVerall coverage of the lot by buildings to meet the code limitation, and to move the screened porch to increase the setback from the bluff from the requeeted 18' to 26', as ~1[ as reducing the size of the porch over the existing patio existing In this location. 2. The benefit sought by the applicant~ Cannot be achieved by some meth(~d, feasible for the applicants to pursue, other than an area variance. There is no other loCation on the property for the placement of a bed and bath addition and a SCreened perch. 3. The variances granted herein ara substantial. The code requires a 40-fcot setback from the front yard. and the new addition ~ill be only 26.9 feet. The screened porch would require a 100 foot setback from the bluff, and is only 29'1" from the top of the bluff. 4. The difficulty has been self-created as the applicants chose to plan for additions knowing the setback requirements of the codes. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6.
