WITNESSETH, that the party of the first part, to whom letters testamentary were issued by the
Surrogate's Court, New York County, New York (File Nu. 2006-3502) on October 19, 2006 and by
virtue of the power end authority given in and by said last will and testament and/or by Article I 1 of the
Estates, Powers and TrusKs Law, and in consideration of FOUR 13UNDRED SIXTY FIVE T}IOLiSAND
(5465,OW.00) DOLLARS, paid by the party of the second part, does hereby grant and release unto the
party of the second pari, the distributees or successors end assigns of the party of the second part forever;
ALL that certain plot, piece or parcel of land with the buildings and improvements thereon erected,
situate, lying and being in the in the Village of Gn:cnport, 'Town ut' Southold, County of SulTolk and
State of New Yurk, bounded and described as follows:
BEGINNING at the corner fulmed by the intersection of the westerly side of First Street with the
southerly side of Broad Street;
RUNNING THENCE South 6 degrees 48 minutes 40 sewnds East ulong the ~vestcrly side of First
Strcct, a distance of 100 fcet to land now or formerly of Gertrude I. Warner;
RUNNING THENCL: along said last mentioned land South 83 degrees 34 minutes 30 seconds Wcst, a
distance of 110 fet:t w land now or formerly of Russell Terry;
RUNNING TIIF.NCE along said last mentioned land Noah 6 degrees 48 minutes 40 seconds West, a
distance of 100 feet to the southerly side of Broad Street, and
THF.NCC North 83 degrees 34 minutts 30 seconds East along the southerly side of Bmad SlreeL a
distance of 11 U fact to the comer the point or place of BEGINNING.
BF_ING AND IN'T'ENDED TO BE the same premises conveyed to Bernard T-i. Shustrin and Ann Shustrin
by deed from James E. Felt and Joanne Fcit dated May 26, 1988 and rccordcd Junc 20, 1988 in the
Office of the Suffolk County Clerk in Liber 10627, Page I51.
TOGETHER with all right, title and interest, if any, of the parry of the first part in and to any streets and
roads abutting the above described premises w the center line thereof,
TOGETHER with the appurtenances, and also the estate which the said decedent had at the time of
decedent's death in said premises, and also the estate therein, which the party of the first part has or has
the power to convey or dispose of, whether individually, or by virtue of said will or otherwise,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
distributees or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the f first part has not done or suffcrcd anything
whcrcby the said premises have been incumbcrcd in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of improvement and
will apply same first to the payment ol'the cost of improvement before using any port of the total of the
same for any other purpose.
The word "party" shall be construed as it' it reads "parries" whenever the sense of this indenture so
requires.
