party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other
valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the
second parr forever,
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being at Bayview. Town of Southold. County of Suffolk and State of
New York, bounded and described as follows:
BEGINNING at a point on the northerly side of other land now or formerly of Akscin at
the southeasterly comer of the premises herein described, said point being North 69
degrees 50 minutes 20 seconds West, 184.0 feet from the westerly side of Reydori~Drive;
RUNNING 'THENCE Noah 69 degrees 50 minutes 20 seconds_ Wcsy 236 feet t~ a point
marked by an iron pipe;
RUNNING 'THENCE North 20 degrees 11 minutes 20 seconds East, 179, feet to
Subdivision Map of Reydon Shores;
RUNNING THENCE South 69 degrees 50 minutes 20 seconds East, 241 feet; and
RUNNING 'THENCE South 21 degrees 49 minutes 30 seconds Wcst, 179.09 feet to the
point or place of BEGINNING.
TOGETHER with the right to the use, in common with others, of a right of way 25 feet in
width, the northerly line of said right of way being the southerly line of the premises
above described and extending easterly from the westerly comer of said premises and
running South 69 degrees 50 minutes 20 seconds East, 420 feet to the westerly side of
Reydon Drive, said right of way being for the purpose of ingress and egress to and from
said premises and to and from Reydon Drive and for the purpose of installation,
maintenance, repair and replacement of utility lines, pipes and conduits, on the surface,
above the surface and below the surface of said right of way, in such manner as not to
interfere with surface travel.
TOGETHER with all the right, title and interest of the parry ot'the first part ot; in, and to
that portion of that portion of Reydon Drive adjacent to said premises to the center lint
thereof, subject to public use.
TOGETHER with any right, if any, that the party of the first part may be entitled to
convey to the party ol'the second part, as follows:
(1) To use for boating, bathing and fishing, all that portion of beach lying in front of
Sections A and B, as shown on said Map, in common with the party of the first part and
with others who now have or hereafter may acquire rights in the same, subject, however,
to such reasonable rules and regulations with respect to the use thereof, as Reydon
Shores, inc. may from time to time put into elTect.
(2) The right of way of the roads, highways, streets or lanes shown on said Map and
over a road or highway known as Reydon Drive.
(3) To the reasonable use and enjoyment of that portion of the inland harbor owned
by Reydon Shores, Inc., and ro the use of a portion of the northerly lint of the bulkhead
and to such other portions of said bulkhead as may be set aside in common with other
plot owners of plots of Reydon Shores, Inc. to date and others who may hereafter acquire
title to land from Reydon Shores, Inc., subject to such reasonable rules and regulations as
Reydon Shores, Inc. may from time to time put info etTect, it being expressly understood
that Reydon Shores, Inc. shall not be liable in any way whatsoever for any aceident or
accidents that may occur in connection with the use and enjoyment of said, bulkhead and
harbor from any cause whatsoever.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first
part by decd dated December 13, 1977, and recorded December 30, 1977 in the Suffolk
County Clerk's OtTice in Libcr 8368, Pagc 443.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the
buildings and improvements thereon erected, in and to the party of the first part.
THE PAR'CY OF THE FIRST PART F~IEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as they may choosy, to change their remainderman
as follows:
TO or among any one or more members of a class consisting of the party of the first
part's descendants, in any degree, whether presently living or bom hercaRer, in such
proportions and amounts, without regard to equality, outright or in trust, as the party of
the first part may direct and appoint during her lifetime by properly written and
acknowledged instrument, and recorded prior to death, making specific reference to this
power of appointment. The party of the first part may not appoint themselves, their
estate. their creditors or the creditors of their estate, under any circumstances.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to
any streets and roads abutting the above described premises to the center lines thereof;
TOGS'I'HER with the appurtetrances and all the estate and rights of the party of the first
pari in and to said premises; TO HAVE AND TO HOLD the premises herein granted
unto the party of the second part, the heirs or successors and assigns of the party ofthc
second part forever.
AND the party of the first part covenants that the parry of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way
whau;ver, except as aforesaid.
AND the party of the first part, incompliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideretion for this conveyance and will
hold the right to receive such coruideration as a trust fund to be applied first for the
purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "panics" whenever the sense of this
indenture so requires.
IN WITNESS Wl•IEREOF, the party of the Rest part has duly executed this deed the day
