Wickham, Bressler, Gordon & Geasa, P.C.. 13015 Main Road, Mattituck. New York 11952, party of the
first part, and
GEORGE S. SMALL AND BERTRICE W. SMALL, his wife, residing at 575 Crittens Lane. Southold.
New York 11971, party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten and 00/100-(510.00)--Dollars, and
other good and valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever.
ALL that certain plot, piece or parcel of land, situate, lying and being at Pine Neck. Southold. in the Town
of Southold, County of Suffolk and State of New York, more particularly bounded and described as
follows:
BEGINNING at a point on the northerly line of Crittens Lane (which point is South 89 degrees 28 minutes
40 seconds East a distance of 112.0 feet to a monument set at the southeasterly corner of Lot no. 32 as
shown upon a certain map entitled, `Map No. 2141' (and which point is the southwesterly comer of the
premises herein described):
RUNNING THENCE North 0 degrees 43 minutes 50 seconds West a distance of 153.58 Feet to the
southwesterly comer of premises heretofore conveyed by Ellsworth C. Grathwohl and Winifred F.
Grathwohl, his wife. to Rowland M. Timm and Elsie E. Timm, his wife;
RUNNING THENCE along said land of Timm, North 85 degrees 55 minutes 20 seconds East, a distance
of 183.36 feet;
RUNNING THENCE along land of Anderson. South 28 degrees 03 minutes 30 seconds West. a distance
of 192.17 feet to the northerly line of Crittens Lane:
RUNNING THENCE in a general westerly direction along the northerly line of Crittens Lane, on a curve to
the left having a radius of 100.0 feet, a distance of 20.72 feet;
RUNNING THENCE North 89 degrees 28 minutes 40 seconds West, a distance of 70.0 feet to the point or
place of BEGINNING.
BEING and intended to be the same premises conveyed to the party of the first part by deed dated 2/6/07,
recorded 219/07 in Liber 12491 page 730 in the Suffolk County Clerk's Office.
TOGETHER with all right, title and interest. if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part. the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part. in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust Lund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party' shall be construed as if it read 'parties' whenever the
sense of this indenture so requires.
