BARGAIN AD1D SALE DEED
WITS COVENANTS
THIS INDBNTOitB, made the ~ day of 2007
BETWEEN John Cardina]Q and oan Cardi le, residing at 634
Baldwin Drive, Rivervale, NJ 07675, party of the first part,
AND the COIINTY OF SIIFP'OLK, a municipal corporation of the
State of New York, having its principal office at the Suffolk
County Center, Center Drive, Riverhead, New York 11901, party of
the second part,
WITNESSETH, that the party of the first part, in
consideration of FOUR HUNDRED THOUSAND and 00/100 DOLLARS
($400,000.00) and other valuable consideration paid by the party
of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the
party of the second part forever,
ALL, that certain piece or parcel of land, situated in the
Town of Southold,. County•of Suffolk, and State of New York, more
particularly bounded and described as follows: (see description
annexed hereto and, made a part hereof):

THIS'DEED is given in accordance with Article XXXVI of the
Suffolk County Charter, Resolution No. 412-2005, Resolution
No.621-2004, and Resolution No. 117-2006 on file with the Clerk
of the Suffolk County Legislature.
BEING AND INTEDIDSD to be the same premises conveyed to the
grantors by deed from Barbara Claps dated 2/10/97 recorded
2/24/97 in Liber liBl7 page 584.
TOGETHER with all right, title and interest, if any, of the.
party of the first part in and to any streets and roads abutting
the above described premises to the center lines thereof;
TOGET~R with the appurtenances and all the estate and
rights of the party of the first part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of
the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever, except
as aforesaid.
AND the party of the first part, in compliance with Section
13 of the Lien Law, covenants that the party of the first part
will receive the consideration for this conveyance and will hold
the right to receive such consideration as a trust fund to be
applied first for the purpose of paying the cost of the
improvement and will apply the same first to the payment of the
cost of the improvement before using any part of the total of
the same for any other purpose.
AND the party of the second part in accordance with Chapter
XXXVI of the Suffolk County Charter (Suffolk County Resolution
No. 840-2004), including but not limited to §§ 36-1(A)(1) and
(BI thereof, and Suffolk County Resolution No. 412-2005, severs
herewith~,Workforce Housing Development Right ("WHDR") from
the aforestated piece or parcel of land.
AND the following paragraph shall constitute a covenant and
restriction which shall run with the land in perpetuity:

ALL that certain plot, piece or parcel of land known as Lo17 on "Map of
Subdivision, Willow Point", filed in the Suffolk County Clerk's Office on June 16,
1966 as Map No. 4652, situate, lying and being at prshamomaque, Town of
Southold, County of Suffolk, State of New•York, and shown on a survey prepared
by L.K. McLean Associates, P.C. dated September 19, 2006. Said parcel being
more particularly bounded and described as follows:
BEGINNING at a point on the northerly boundary of Budd's Pond Road, at the
division line between the subject parcel on the east, and lands now or formerlyof
Ante Grando and Srecka Grando on the west, said point of beginning being the
following four courses and distances along the northerly boundary'of Budd's
Pond Road from a point formed by the intersection of an arc connecting the said
northerly boundary of Budd's Pand Road with the easterly boundary of Bay
Home Road;
1. north 50 degrees 45 minutes 00 seconds east, a distance of 325.00 feet to a
point of curvature; thence
2. northeasterly, along the arc of a curve to the rrght having a radius of 519.26
feet, an arc length of 99.70 feet to a point of tangency; thence
3. north 61 degrees 45 minutes 00 seconds east, a distance of 125.00 feet to a
point of curvature; thence
4. easterly, along the arc of a curve to the right having a radius of 115.47 feet, an
arc length of 25.00 feet to the point or place of beginning;
THENCE from said point of beginning, north 02 degrees 33 minutes 20 seconds
west along said aforementioned division line, a dlstance of 175.79 feet to a point
on the southerly boundary of Main Road, S.R. 25;
THENCE north 59 degrees 40 minutes 00 seconds east, along said southerly
boundary, a distance of 143.63 feet io a point on the division line between the
subject parcel on the west, and lands now or formerly of Philip O'Hara, Lawrence
Dalton, Charles Friedman and Eli Green on the east;
THENCE south 30 degrees 20 minutes 00 seconds east, along said division line,
a distance of 110.00 feet to a point on the division line between the subject
parcel on the northwest, and the lands now or formerly of Marisa Jurinovic on the
southeast;
THENCE south 24 degrees 17 minutes 10 seconds west, along said division line,
a distance of 184.68 feet to a point an the aforementioned northerly boundary of
Budd's Pond Road;

THENCE westerly, along the arc of a curve to the left having a radius of 115.47
feet, an arc length of 100.00 feet to the point or place of BEGINNING.
This aforestated piece or parcel was purchased using SOS
(Save Open Space) Bond Act funds in accordance with Suffolk
County Resolution No. 840-2004 (Chapter XXXVI of the Suffolk
County Charter) and Suffolk County Resolution No. 412-2005, for
the Transfer of Development Rights Program, which WHDR(s) were
severed for workforce housing purposes, and this piece or parcel
is deemed permanently sterilized and must remain as open space
in the Suffolk County inventory.
TAE iliORD "PARTY" shall be construed as if it read "parties"
whenever the sense of this indenture so requires.
